Bleisch and Celia Bleisch have offered for dedication an easement for storm drain purposes to the Town; and.. WHEREAS,the City Council of the Town has read and considered that dedication of easement for storm drain purposes; NOW,THEREFORE,the City Council of the Town of Los Altos Hills does RESOLVE as follows: Section 1. The Town of Los Altos Hills hereby accepts the dedication of the storm drain easement at 12640 Robleda Road on behalf of the public. Section 2. The Town of Los Altos Hills shall enter into and the Mayor is hereby authorized and directed to execute the Dedication of Easement for Storm Drain Purposes, a copy of which is attached hereto. Bleisch and Celia Bleisch ("Bleischs") in favor of the Town of Los Altos Hills, a municipal corporation of the State of California ("Town"), effective as of the date of execution by the Town. RECITALS A. Bleischs own property located at 12640 Robleda Road in the Town of Los Altos Hills, California. The property is more particularly described as the 1.00 acrea lot in the Record of Survey recorded November 7, 1956, in Book 75 of Official Records of Santa Clara County at page 28. B. Bleischs desire to dedicate an easement in this property to the Town for storm drain purposes and Town wishes to accept such a dedication. NOW, THEREFORE, IT IS AGREED by the parties as follows: 1. Storm Drain. Bleischs hereby dedicate to the Town an easement as described in Exhibit "A" and shown in Exhibit "B" attached hereto for public storm drain purposes, including, but not limited to, construction and maintenance of storm drainage facilities and appurtenances. 2. Acceptance. The Town has accepted this Dedication of the easement by Resolution No. 48-94 and has authorized the Mayor to execute this document on its behalf. 3. Binding Effect. The Provisions contained in this Dedication shall run with the land and shall be binding upon and inure to the benefit of the respective successors and assigns of the parties to this Dedication. 4. Landscaping. Upon the initial construction of the storm drain facilities, Town shall replace any existing landscaping that is disturbed and repair the existing stucco wall if necessary.
