MINUTES OF A REGULAR MEETING
Wednesday, January 23, 1980

Chairman Dochnahl called the meeting of the Variance and Permit Commission to order
at 6:30 p.m. in the Council Chambers of the Town Hall.
ROLL CALL:
Present: Commissioners Rydell, Carico and Dochnahl
Absent: None
Also Present: City Enqineer/Planner John Carlson, Secretary Ethel Hopkins
APPROVAL OF MINUTES:
There being no corrections to the Minutes, Chairman Dochnahl declared the Minutes of
December 12, 1979 approved as submitted.
g PUBLIC HEARINGS
1. LANDS OF CLIFTON, File #VAR. 7066-80, 13495 Country Way (Lot #3), Peter Wright
Shaw, Landscape rc itect, Request for Recommendation of Approval of Variance
in Side Yard for Play Court:
Mr. Carlson discussed the above request as detailed in his staff report dated
January 17 and as further amplified by Mr. Clifton's letter of January 18. Other
matters reviewed were the development on adjacent properties, the amount of cut
required to build the play court, and landscape screening.
Commissioner Carico questioned whether at some future date the play court area could
be converted into a tennis court. She was told that it could not be because the play
court would be only one third of the size needed for a tennis court. Thereafter the
hearing was opened to the public discussion.
Peter Wri ht Shaw, Landsca e Architect 125 Universit Avenue, Palo Alto, discussed
t e reasons for t e size of t e court, why the court could not be diminished in size
or relocated, adjacent properties and how they would be affected by the court, and
then requested that the Commission recommend approval.
The public hearing was closed, and the reasons for the granting of the variance were
reviewed, and conditions discussed. The following motion was passed:
MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Commissioner Carico and
seconded by Commissioner Rydell to recommend approval of the Lands of Clifton, File
%W #VAR. 7066-80, with conditions.
2. LANDS OF MORLEY, File #VAR. 7065-79, 12345 Murietta Lane, Request for Variance
for Tennis Court:
Mr. Carlson discussed the subject request as detailed in his January 17 staff report.
He noted that it was possible to fit a tennis court on the oroperty without a variance

and then reviewed the reasons for the recommendation of denial. After a short
discussion, the meeting was opened to the public hearing.

there was no neighbor objection to his proposed development, and he questioned whether
there would be development at the rear of the property for at least a decade.

Comments from Commissioners included: Commissioner Rydell stated he was not in favor
of the development as proposed. Commissioner Carico noted that the proposed develop-
ment had the least impact on neighbors or land, and she recommended that the request
for variance be lessened by moving the tennis court further up on the lot. She commended
the developer for his attempt to retain the rural atmosphere of the area. Doth Commission
ers Rydell and Dochnahl asked that the City Engineer look into the future development of
the Duvenek area behind the Morley property to determine whether development will be
allowed within sixty feet of the property line separating the Lands of Duvenek and Lands
of Morley.
MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Commissioner Rydell and seconded
by Commissioner Carico to continue the Lands of Morley, File #VAR. 7065-79, until
the meeting of February 13.
