MINUTES OF A REGULAR MEETING
Wednesday, February 13, 1980

Chairman Carico called the meeting of the Variance and Permit Commission to order
at 7:00 p.m. in the Council Chambers of the Town Hall.
ROLL CALL:
Present: Commissioners Stewart, Dochnahl, Carico
Absent: None
Also Present: City Engineer/Planner John Carlson, Secretary Ethel Hopkins
APPROVAL OF MINUTES:
MOTION SECONDED AND CARRIED: It was moved by Commissioner Dochnahl and seconded
by Commissioner Carico that the Minutes of January 23 be approved as submitted.
Commissioners Dochnahl and Carico voted for the motion; Commissioner Stewart, however,
abstained because he had not attended the January 23rd meeting.

for Tennis Court continued from January 23rd meeting):
Mr. Carlson continued the discussion on the above variance, noting that efforts to
obtain an idea of what the ultimate development of the Duvenek property would be had
proven unsuccessful. He noted that the applicant had re -submitted plans which would
require only a ten foot encroachment into the setback area. The width of the court
had been reduced from sixty to fifty-five feet. No other changes had been made.
Thereafter, the hearing was opened to the public discussion.
Mr. Morley, A a cant, discussed the shape of the lot and the constraints placed on
eve opment as a resu t and the subsequent reasons for requesting a variance. He
requested a recommendation of approval of the variance.
Commissioner Stewart reminded Mr. Morley that the conditions of the Rancho Murietta
Subdivision prevented the requesting of a variance because of the creek along the
property. He also noted that the costliness of constructing a bridge as access to
the adjacent Duvenek property would not be a deterrant to development of that property,
land values being what they are in the area. He suggested revising the plans again,
moving the proposed dwelling further back from the setback area and eliminating one
of the garage areas.
The public hearing was closed, and Commissioners discussed the disposition of the
request. Commissioner Carico commended the applicant's proposed development as
it retained the rural quality of the area, lessened impact on Murietta, and kept
trees intact. She noted, however, the the question of hardship was difficult to
establish. Commissioners discussed various ways that the applicant might develop
his lot without having to have a variance, and then passed the following motion:

MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Commissioner Stewart and
seconded by Commissioner Dochnahl to recommend denial without prejudice for the
Lands of Morley, File #VAR. 7065-79. (5-- »i�4UC" )
The applicant was advised that he could appeal the recommendation to the full Planning
Commission.
Mr. Morley noted that the creek area on this property was filled with all kinds of
debris. He asked Mr. Carlson to initiate the request to clear this area of the debris.
ADJOURNMENT:
There being no old or new business, it was moved by Commissioner Stewart and approved
by all present that the meeting be adjourned. Adjournment occurred at 7:35 p.m.

Motion amended by Minutes of February 27:
It was moved by Commissioner Stewart and seconded by Commissioner Dochnahl
that because the application for variance for the Lands of Morley, File
#YAR. 7065-79, could not meet conditions (1), (2) and (3) of the conditions
for the granting of a variance, that it be recommended that .this application
be denied without prejudice.
