HomeMy WebLinkAbout02/27/1980J VARIANCE AND PERMIT COMMISSION ` Town of Los Altos Hills (r 26379 Fremont Road Los Altos Hills, California MINUTES OF A REGULAR MEETING Wednesday, February 27, 1980 Reel 83, Side 2, Tr. 2, 648 to 876 The meeting of the Variance and Permit Commission was called to order at 7:04 p.m. by Chairman Carico in the Council Chambers of the Town Hall. ROLL CALL: Present: Commissioners Carico and Stewart Absent: Commissioner Rydell Also Present: City Planner/Engineer John Carlson, Secretary Ethel Hopkins APPROVAL OF MINUTES: The Minutes of the February 13th meeting were amended on page two under the motion on the Lands of Morley to read: It was moved by Commissioner Stewart and seconded by Commissioner Dochnahl that because the application for variance for the Lands of Morley, File #VAR. 7065-79, could not meet conditions (1), (2) and (3) of the con- ditions for the granting of a variance,that it be recommended that this application be denied without prejudice. Thereafter the Minutes of February 13 were declared approved as amended by Chairman Carico. PUBLIC HEARINGS: 1. LANDS OF CLARK, File #SA 1-80, Altadena and Kingsley, John Riley, Engineer, ' Request for Recommendation of Approval of Site Approval: Mr. Carlson reviewed the background for the above request as outlined in his staff report dated February 22. Additional information discussed was that the subject site was in an old drainage swale and also that he recommended the filina of a parcel map to be added as one of the conditions for the Site Approval. Commissioners discussed the procedure for combining the acreage for the Lands of Clark into a single parcel and whether they were actino according to Code require- ments in requiring that the applicant file a parcel map as a condition of the Site Approval, Dr. Fink's lawsuit against the Town on the ownership of Kingsley Avenue, and whether in recommending approval of Mr. Clark's request the Commission would be exposing the Town to another lawsuit. The hearing was opened to the public discussion. Malcolm Clark, A licant, 235 Waverl Street, Menlo Park, discussed possible accesses he had to is property and the verbal agreement a had with Dr. Fink for access over the driveway on Kingsley Avenue. He was advised by Commissioner Stewart to obtain a written statement on this promise of access. V Commissioner Stewart observed that there would be pathways on all sides of the property. He asked whether a path in the right-of-way would be sufficient. LANDS OF CLARK, File #SA 1-80: (continued) She discussed pathways and pathway destinations in the area, ntoing that Dr. Fink had given permission for horsemen to cross his property to reach Esther Clark Park. She requested that a Type II path be constructed along Lowell Avenue because of the bog conditions in the area which were a hazard to school cMle��ldren u�ngyvthe pat�h ales aTi Commissioner Stewart discussed whether a,/path right-of-way should b(� obtained along 1 Kingsley Avenue, held by the Town unti the lawsuit by Dr. Fink is settled tial `7�� of-, and then relinquished t was later decided that this would not be required because of a lack of path connections. The public hearing was closed, and the following motions passed: MOTION SECONDED AND PASSED UNANIMOUSLY: seconded by Commissioner Carico to amend install a Type IIA path along the Lowell right-of-way. It was moved by Commissioner Stewart and Condition 3.A to read: The owner shall Avenue property line within the street MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Commissioner Stewart and seconded by Commissioner Carico to recommend approval of the Lands of Clark, File #SA 1-80, with conditions as amended, and with the following additional condition: The applicant shall file a parcel map combining Lots 31, 32, 33, 34, 35, 36 and 37 4 into a single parcel with one assessor's parcel number. This condition shall be subject to approval by the City Attorney.
