HomeMy WebLinkAbout03/26/19800 N VARIANCE AND PERMIT COMMISSION Town of Los Altos Hills 26379 Fremont Road Los Altos Hills, California MINUTES OF A REGULAR MEETING Wednesday, March 26, 1980 Reel 84, Side 1, Tr. 1, 795 to 1014 The meeting of the Variance and Permit Commission was called to order by Chairman Rydell at 7:00 p.m. ROLL CALL: Present: Commissioners Lachenbruch, Stewart and Rydell Absent: None Also Present: City Engineer/Planner John Carlson, Secretary Ethel Hopkins APPROVAL OF MINUTES: The Minutes of March 12 were amended as follows: The last line of page one was changed to read ..located in another location other than above the heat storage tank." Thereafter the Minutes were approved as amended on The—motion of Commissioner Stewart seconded by Commissioner Lachenbruch. Commissioner Rydell abstained from the voting. The Minutes were declared approved on the "aye" votes of the two ow Commissioners. PUBLIC HEARINGS: 1. LANDS OF MAREK, File #VAR. 3-80, 25151 Tepa Way, Request for Recommendation of pp Aroval of Variance in Side and Rear Setback for the Construction of a Garage: Mr. Carlson reviewed the above request as covered in his staff report of March 20, noting that there was no additional impervious surface with the garage addition proposed and that the present garage use was restricted because of the original lot development. Commissioner Lachenbruch asked about the crack in the retaining wall near the pro- posed garage addition, and requested that it be determined whether this would affect the new construction. He also asked about the ownership of the common driveway ease- ment. Thereafter the hearing was opened to the public discussion. John Marek, Applicant, noted that the underlying fee title was owned by Mr. and Mrs. David Hu�at the Mareks and Hobarts have a non-exclusive driveway and parking easement for the driveway. He questioned the accuracy of the staff report in stating the amount of the variance request. Also, he noted that they had been observing the crack in the retaining wall, that it had changed very little in the past ten years, that the vertical displacement had been caused by the movement of the ground below the retaining wall, and that the retaining wall had very little to do with the 4 proposed construction. He suggested that perhaps the building inspector may wish to observe the area during inspections on the addition. He asked that the variance be approved. LANDS OF MAREK, File #VAR. 3-80: (continued) PASSED BY CONSENSUS: To rewrite the heading and first sentence of the staff report to read: Public hearing to consider a variance to allow an encroachment of 13 feet into the side setback and 11 feet into the rear setback for a garage. That the Variance and Permit Commission approve a variance to allow construction of a garage within 17 feet of the southeastern property line and within 19 feet of the eastern property line. MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Commissioner Lachenbruch and seconded by Commissioner Stewart to add the following as a condition: The area between the common driveway to the Hummel residence and the retaining wall shall be planted with shrubs to a height not less than six feet (6') for the purpose of screening the new structure from the view of the driveway. Commissioner Lachenbruch raised the issue of whether drainage improvements should be required on the property. Mr. Carlson noted that this had been discussed at the Sub- division Committee Meeting, but since there would be no increase in impervious surface and no change in the drainage patterns, it had been determined that no much could be done at this time. MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Commissioner Stewart and seconded by Commissioner Lachenbruch to recommend approval of the Lands of Marek, File #VAR. 3-80, with the condition added by the Commission. OLD BUSINESS: Commissioner Lachenbruch discussed City Council action on the recently recommended variance for the Lands of Cheng, noting that the Council had suggested installing the panels on the roof area. He concurred with Commissioner Stewart that the argument against having a backup generator for a power source was a weak one. ADJOURNMENT: There being no further new or old business, the meeting was adjourned at 7:30 on the motion of Commissioner Stewart, seconded by Commissioner Lachenbruch.
