REGULAR MEETING Wednesday, August 13, 1980 Reel 87, Side 2, Tr. 2, 561 to 654 The meetina of the Variance and Permit Commission was called to order at 7:00 p.m. in the Council Chambers of Town Hall by Chairman Dochnahl. ROLL CALL: Present: Commissioners Rydell and Dochnahl Absent: Commissioner Carico Also Present: City Engineer/Planner John Carlson, Secretary Ethel Hopkins APPROVAL OF MINUTES: The Minutes of July 9 were declared approved as submitted. Commissioner Rydell made the motion for approval. PUBLIC HEARINGS: 1. LANDS OF WOLKEN, File #VAR. 7-80, 27345 Deersprinas Way, Joseph Parello, Enqineer, Request for Recortmendati on of Approval for variance in Side Setback for Wine Cellar: Mr. Carlson discussed the above request, noting that the driveway access had been moved to provide a better access and less intrusion on neighbors. The six reasons providing justification for the need for the variance were listed on his staff report dated August 7. He noted further that there would be little visible change to the property as the proposed structure would be underground, that neighbors had signed the aoplication indicating their agreement with the request, and that the only visible intrusion would be the entrance to the cellar and people walkina to that entrance. Thereafter the hearing was opened to the public discussion. Peter Wolken, Applicant, requested that the variance be recommended for approval, as he wanted to begin construction as soon as possible so as to avoid winter rains. The public hearing was closed. Commissioners discussed whether the proposed structure might be located at another place on the property and were told that the area proposed was the most appropriate location for the wine cellar, as there would be landscaping and other problems with another location. MOTION SECONDED AND UNANIMOUSLY APPROVED: It was moved by Commissioner Rydell and seconded by Commissioner Dochnahl that a fifteen foot (15') variance for the Lands of Wolken, File #VAR. 7-80, be recommended for approval, with justification as provided f by the City Engineer's August 7 staff report. No conditions were added. V' A short discussion on requirements of Section 2.2.204 of the Municipal Code is not reported here because it was discovered that the City Engineer's Code on this matter was not up to date. The above section was amended by Reprint No. 9 dated VARIANCE AND PERMIT COMMISSION MINUTES Page two `, 1. LANDS OF WOLKEN, File #VAR. 7-80: (continued) January 31, 1977, and the sentence requiring Planning Commission approval of the actions of the Variance and Permit Commission recommendations was deleted.
