I, 000 -End; Side I, Tr. II, 000-312 The meeting of the Planning Commission was called to order by Chariman vanTamelen at 8:00 p.m. in the Council Chambers of the Town Hall. ROLL CALL: Present: Commissioners Carica, Dochnahl, Lachenbruch, Stewart, Chairman vanTamelen Absent: Commissioners Kuranoff and Rydell (excused absence) Also Present: City Engineer/Planner John A. Carlson, Assistant Planner Pat Webb, Secretaries Leslie Penfold and Ethel Hopkins Press: Flo Pallakoff, Los Altos Town Crier CONSENT CALENDAR: The following items were removed from the Consent Calendar: 1) Minutes of August 13, 1980. MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Commissioner Dochnahl and seconded by Commissioner Stewart that the balance of the Consent Calendar be approved, namely: 440 2) Setting of Dates for Public Hearings of September 10, 1980: (a) Variance and Permit Commission: Lands of Strayer, File #VAR 6-80 (b) Planning Commission: Lands of Lynch, File #A 4438 and #A 4485 3) Acceptance for Filing Tentative Map: (a) Lands of Kane, File #TM 6-80 The minutes of August 13, 1980 were amended as follows: 1) On page four, Commissioner Lachenbruch requested that the next to last paragarph, eigth sentence be revised to read as follows: "...(2) sum of cut and fill would be in excess of twelve feet (12') and in conflict with the Tennis Court Policy;... 2) On page six, last paragraph, sixth sentence, Commissioner Lachenbruch requested this be revised to read as follows: "When enough research material was ready so informal meeting that appropriate formulas and curves could be plotted, another with developers representatives such as Ken Pastrof, Woolworth Construction, and including Paul Nowack was to be arranged by the Planning Commission Secretary." Minutes as amended were unanimously approved. REPORT FROM VARIANCE AND PERMIT COMMISSION MEETING OF AUGUST 27, 1980: Commissioner Dochnahl reported that the Variance and Permit Commission recommended denial of an encroachment into the side yard setback for the Lands of Spilker, File #VAR 8-80. The applicant was given three (3) alternatives to this denial: 1) Build the addition not within the setback so that a variance would not be needed; 2) Present new plans to Variance and Permit or; 3) appeal to the City Council in writing within ten (10) days. PLANNING COMMISSION MINUTES - AUGUST 27, 1980 Page Two REPORT FROM CITY COUNCIL MEETING OF AUGUST 20, 1980: Chairman vanTamelen reported that 1) Councilman Perkins suggested that a Resolution be adopted stating the Towns objection to the Arastradero Road planning, this is to be sent the City Council of Palo Alto; and 2) There were many concerned residents in the area of Ravensbury that have petitioned for removal of the caboose on Mr. Lynch's property at 25701 Lomita Linda Court, the City Counicl has referred this item back to the Planning Commission for futher consideration, to be heard September 10, 1980. Next representative to City Council meeting of September 3, 1980 will be Commissioner Carico. PUBLIC HEARINGS: 1. LANDS OF BELLUCCI. File 42104-79, 26220 Moody Road, Paul Nowack & Associates, Engineers, Request for Recommendation of Approval of Tentative Map, 3 Lots: Mr. Carlson recommended approval of the Tentative Map with conditions as set forth in staff report dated August 22, 1980. The hearing was opened for public disccusion. There was a general discussion of all points expressed in Mr. Carlsons staff report. Mrs. Stutz Pathway Committee, reviewed general information for pathways in the area and spoke for pathway committee requests as stated in staff report. Commissioner Stewart expressed preference for designating open space easements on only parcel 351-03-009, as opposed to designating open space easement on the total area, including parcel 351-03-010. Commissioner Stewart stated that if it were designated on the total area it would hinder property rights of new owners and thespresent subdivider. It was asked of Mr. Carlson if the property should be addressed as the total area or just parcel 351-03-009 which is being presented at this time. Mr. Carlson stated that the Conditions of Approval apply to the property as a whole, parcels 1, 2, & 3, (designated on Tentative Map dated received August 27, 1980), and the propetty marked "not a portion of this subdivision". Mr. Bellucci and Mr. Nowack spoke for approval of the Conditions of Approval for only the 3 Lot subdivision,not all the property awned by Mr. Bellucci. MOTION SECONDED AND FAILED: It was moved by Commissioner Stewart and seconded by Commissioner Lachenbruch to apply the Conditions of Approval only to Parcel 351-03-009. VOTE: AYES: Commissioners Lachenbruch and Stewart NOES: Commissioners Carico, Dochnahl and vanTamelen ABSTAIN: None It was the consensus that the Conditions of Approval would apply to the total Bellucci property unless otherwise stated. Commissioners began a discussion on Conditions of Approval.. with the following changes being made: 4W CONDITION 1.B: MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Commissioner Stewart and seconded by Commissioner Carico that Condition 1.B. be amended to delete sentence 1 and substitute the following: The owner shall dedicate an open space conservation easement to go from the intersection of the Lands of Los Altos Hills and Lot 6 of Rancho Murietta, parallel to the southern boundary of the Lands of Bellucci, across parcel 3 and lands east of that parcel for parcels APN 351-03-009, --1 vct_na_ntn so„tcnre 2 remains as written. PLANNING COMMISSION MINUTES - AUGUST 27, 1980 Page three PUBLIC HEARINGS: (continued) CONDITION 1.D: MOTION SECONDED AND PASSED BY CONSENSUS: It was moved by Conm<issioner Stewart and seconded by Commissioner vanTamelen to amend Condition I.D. to read as follows: "The owner shall dedicate on parcels one and two a storm drainage easement and open space conservation easement..." (the rest remains as written). CONDITION 1.G.1: MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Commission Lachenbruch and seconded by Commissioner Stewart that Condition 1.G.1 be amended to read as follows: Over the open space conservation easement of 1.B., specific pathways are to be designated within this region within a 3 year time period, at which time the portions of the right of way not needed for the specific pathways will be abandoned. It was the consensus that a survey should take place in the area where pathways would be installed, Mr. Nowack offered his services at no cost for this project. CONDITION. I.G.2: PASSED BY CONSENSUS: It was moved by Commissioner Stewart and passed by consensus to amend 1.C.2. as follows: A ten foot (10') easement from Franchmont Avenue to the 735 foot contour as suggested by the Pathway Committee will be considered when this parcel is further developed. Mr. Bellucci, Applicant, stated that he was willing to dedicate an easement at the 300 foot contour, that someday could go through to the Duveneck property and west to Rhus ( Ridge for a future pathway to connect in with the Master Pathway Plan. Mrs. Stutz Pathway Committee, stated that this would not be sufficient for the Pathway committee request. Felt that an upper trail could be established to lead to Windmill ' Meadows and other properties, but remarked that it would be necessary for a trail down through the Bellucci property to the roadway. CONDITION 4.A: Passed by consensus that Condition 4.A. shall be amended as follows: All residences shall be connected to the sanitary sewer. CONDITION 4.B• Passed by consensus that Condition 4.B. shall be amended to read as forro-w-�-.-= septic tanks or cesspools for residences shall be pumped and filled. CONDITION 5.A: MOTION SECONDED AND PASSED UNADIIMOUSLY: It was moved by Commissioner Dochnahl and seconded by Commissioner Stewart to delete Condition 5.A. to be added as a conditional exception: Condition 10.A. CONDITION 5.C: MOTION SECONDED AND CARRIED: It was moved by Commissioner vanTamelen and seconded by Commissioner Lachenbruch to delete Condition 5.C. VOTE: AYES: Commissioners vanTamelen, Lachenbruch, Rydell, Stewart, Dochnahl NOES: Commissioner Carico ABSTAIN: None CONDITION 7.A: Amended to read as follows: All fencing and related structures within the road right of way and path easement shall be removed. Mr. Bellucci stated that he was opposed to Condition 7.A. as in staff report dated August 22, 1980. CONDITION 7.B: MOTION SECONDED AND CARRIED: It was moved by Commissioner Carico and seconded by -commissioner Stewart to delete Condition 7.B. VOTE: AYES: Commissioners Cation, Lachenbruch, Stewart, Dochnahl NOES: Commissioner vanTamelen ABSTAIN: None PLANNING COMMISSION MINUTES - AUGUST 27, 1980 Page Four PUBLIC HEARINGS: (continued) CONDITIONS B.A.B.C: PASSED BY CONSENSUS: It was moved by Commissioner Stewart and passed by consensus to amend Conditions B.A., B., & C. to read as follows: On any future development of Parcel 113, Conditions S.A., B. & C. shall be considered as listed in staff report dated August 22, 1980. CONDITION 9.A: PASSED BY CONSENSUS: It was moved by Commissioner Stewart and passed by consensus to amend Condition 9.A. to read as follows:B'ior to filing of the Final Map, the stucco house, as shown on Tentative Map dated "Received August 27, 1980", shall either be relocated as indicated on the Tentative Map or removed from Parcel 1; or a new Conditional Use Permit for a secondary dwelling shall be obtained through the Town. CONDITION 9.B: MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Commissioner Stewart and seconded by Commissioner Carica to delete Condition 9.B. CONDITION 9.C: PASSED BY CONSENSUS: It was moved by Commissioner Stewart and passed by consensus to delete Condition 9.C. CONDITION 10.d): MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Commissioner Lacbenbruch and seconded by Commissioner Dochnahl to delete condition 10.d) on staff report dated August 22, 1980. Mr. Bellucci, objected to the fees and asked for deletion of Condition 10.d). CONDITIONAL EXCEPTION: CONDITION 10.A. to read as follows: Grant request of applicant for Conditional Exception to allow use of private water well on Parcel 2, in lieu of Go requiring connection to Purissima Hills County Water Distrtict. Town assumes no responsibility for water quality. CONDITIONS 10.a),b),c)shall be renumbered as follows: CONDITIONS 11. a), b), c) with no changes. '7. Bellucci verbally agreed to all conditions as amended. MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Commissioner Carico and seconded by Commissioner Stewart to recommend approval of the Lands of Bellucci, File fiTM 2104-79, with Conditions of Approval as amended. OLD BUSINESS: 1) PROPOSED FENCE ORDINANCE: The Commissioners discussed among themselves the proposed fence ordinance, feeling that it needed more clarification, it was sent back to staff for rewriting. 2) The Design Review Ordinance, Impervious Surface Ordinance and Pathway Element are in subcommittees for further review and will be presented to the Planning Commission as soon as possible. 4W 3) Chairman vanTamelen noted that the Site Development Handout has been revised. 6W PLANNING COMMISSION MINUTES - AUGUST 27, 1980 Page Five NEW BUSINESS: 1) PLANNING COMMISSION SUGGESTIONS FOR TOWN'S 25th ANNIVERSARY CELEBRATION: Commissioner Dochnahl briefly discussed the preparations that the Anniversary Committee has in mind for the celebration. Any suggestions from Commissioners should be referred to Commissioner Dochnahl, since he will represent the Plan- ning Commission at the Committee meetings. 2) POSSIBLE WORKSHOP DATE: Chairman vanTamelen discussed the possibility of dates being set for the month of October, to discuss any item in need of further consideration. Possibilities: 1. Architerctural Control 2. Fencing 3. Lighting 4. Impervious Surfacing 5.
