California MINUTES OF A REGULAR 14EETING Wednesday, September 24, 1980 Reel 89, Side I, Tract I, 000 - 870 The meeting of the Planning Commission was called to order by Chairman Kuranoff at 7:45 p.m. in the Council Chambers of the Town Hall. ROLL CALL: Present: Commissioners Dochnahl, Kuranoff, Lachenbruch, Rydell Absent: Commissioners Carica, Stewart, vanTamelen (excused absenses) Also Present: City Engineer/Planner John A. Carlson, Assistant Planner Pat Webb, Secretary Leslie Penfold CONSENT CALENDAR: MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Commissioner Rydell and seconded by Commissioner Dochnahl that the Consent Calendar be approved as submitted, namely: 1. Apnroval of Minutes: a) Minutes of August 13, 1980 - Variance and Permit Commission b) Minutes of September 10, 1980 2. Setting of Dates of Public Hearings: a) Variance and Permit Commission, Lands of Zepp, File #VAR 9-80 b) Planning Commission, October 8, 1980 - Development Intensity Limitation Ordinance; October 22, 1980- Lands of Kane, File #TM 6-80 REPORT FROM CITY COUNCIL MEETING OF SEPTEMBER 17, 1980: No report was given, Commissioner Carica attended the City Council meeting but was not present to give a report. Commissioner Rydell asked Mr. Carlson what the City Council's action was on the Lands of Lynch. Mr. Carlson reported that the City Council concurred with the City Attorney's opinion and stated that if the residents wished they could obtain a second opinion on their own. Next representative to the City Council meeting of October 1, 1980 will be Commissioner Rydell. PUBLIC HEARINGS: 1) LANDS OF WEST14IND FARMS, File #CUP 8022-77, 27400 Altamont Road, Request for Recommen- dation of Approval of Amended Conditional Use Permit. Ms. Webb referred to her staff report dated September 19, 1980. Also stating that there was one neighbor that had phoned regarding Westwind Farms, requesting further PLANNING COMMISSION MINUTES OF SEPTEMBER 24, 1980 PACE TWO PUBLIC HEARINGS: (continued) ti landscaping be installed for screening and the need for dust control caused from the riding rings. Staff recommended approval of the additional riding ring with changes to the Conditional Use Permit Conditions as stated in staff report dated September 19, 1980. Commissioner Lachenbruch was concerned with the amount of grading that would be required for the riding rings and indicated the landscaping should be required for screening. The hearing, was opened for public discussion. Mr. Bob Stutz, Chairman of the Board of Directors for Westwind Farms, indicated that West - wind was requesting the addition of one 150'x250' riding ring and one 20'x60' meter dra- sage ring. The location picked for the rings would be the least amount of grading and the less obtrusive to adjacent neighbors. Commissioners indicated the application lacked the necessary information for recommending approval of an amendment to the Conditional Use Permit. Staff was instructed to prepare adetailed staff report with the following information: 1) Plan to show - placement of riding rings, road, and parking; 2) Quantities of cut and fill for the rings; 3) Original Purpose, as set by the Friends of Westwind and the City Council; 4) Summary of the Friends of Westwind Charter; 5) Detail existing activities now in process and for later dates; 6) Long range five (5) year plan, (to be supplied to Commission prior to Public Hearing). MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Commissioner Dochnabl and seconded by Commissioner Rydell to continue the Lands of Westwind Farms to a Field Trip, which will be scheduled after staff report is prepared. OLD BUSINESS: 1) PROPOSED MASTER PATHWAY ELEMENT: As requested by the Pathway Committee, this item was continued until the next Planning Commission Meeting. 2) PROPOSED LIGHTING ORDINANCE: Commissioners discussed the proposed Ordinance, making minor changes to the draft. MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Commissioner Rydell and seconded by Commissioner Lachenbruch to accept the proposed Ordinance, subject to staff providing the amount of lumens not to be exceeded, as measured from offsite the property. NEW BUSINESS: 1) Request for Conditional Exception for the Lands of Abrahams, prior to submittal of Tentative Map. Mr. Carlson referred to his staff report dated September 19, 1980, indicating that this Property was originally subdivided in 1957, with the idea three (3) lots would be formed. There have been two (2) recent Municipal Code changes that would effect this idea. PLANNING COMMISSION MINUTES OF SEPTEMBER 24, 1980 PAGE THREE NEW BUSINESS: (continued) Staff referred to Section 9-4.1501 of the Municipal Code, regarding the Planning Commissions consideration for recommending annroval to the City Council. Staff recommended that the Planning Commission recommend approval to the City Council based on the following: 1) Reduction in street dedication, fifty feet (50'), would allow development intensity as originally established in 1957; and 2) Proposed increase in front Yard building setback lines would establish the same setback as if the street were dedicated to Code Standards. Commissioners felt that since this item did not comply with the current street dedication ordinance and also the current slope density ordinance, they were hesitant to recommend approval to the City Council. They felt the amount of acreage for subdivision would be too intense for development on three lots. Dexter Ahlgren, 20320 Highway 9, Boulder Creek, Engineer, Represented the applicant, spoke for annroval of granting a Conditional Exception. Stated that the applicant would conform to the Town's current setback ordinance for the front yard. Carl Munsev, 2557 Dumbarton Avenue, Palo Alto, Builder/Developer, stated the homes that would be nronosed for this subdivision would not be as large in size as those being built in the Town at this time and further indicated that the amount of Having on the lots would be considerably less. MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Commissioner Dochnahl and seconded by Commissioner Kuranoff to move for Denial of the Conditional Exception for the Lands of Abrahams, for the following reasons: 1) Condition (a) relating to special circumstances or conditions, under Section 9-4.1501 of the Municipal Code, can not be satisfied for the Conditional Excep- tion for the right of way; and 2) Exception to slope density provisions, Section 9-4.604 (b.7) of the Municipal Code is not justified by Ordinance. 2.) CPANGINC SITE DEVELOPMENT DAY, TUESDAY Staff indicated that changing the day from Thursday afternoon to Tuesday afternoon would cut down in loss of staff's time, also be beneficial to Commissioners to combine Subdivision and Site Development meeting on Tuesday afternoons. Commissioners felt that this was a very pond idea to keep the meetings together on one day, but wanted to consult the other members of the Planning Commission before making a decision.
