MINUTES OF A RECOLAR MEETING
Wednesday, October 22, 1980

The meeting of the Planning Commission was called to order by Chairman vanTamelen
at 8:12 p.m. in the Council Chambers of the Town Hall.
ROLL CALL:
Present: Commissioners Carico, Dochnahl, Kuranoff, Lachenbruch, vanTamelen
Absent: Commissioners Pydell and Stewart (excused absences)
Also Present: City Engineer/Planner John A. Carlson, Assistant Planner Pat Webb,
Secretary Leslie Penfold
CONSENT CALENDAR:
MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Commissioner Carico and
seconded by Commissioner Lachenbruch that the Consent Calendar be approved as sub-
mitted, namely:
1. Approval of Minutes: Minutes of October 8, 1980 Planning Commission meeting
2. Setting of Dates of Public Hearings:
1) Lands of Elihu Abrahams, File EISA 3-80
2) Lands of Peterson, File #SA 4-80
3) Lands of Westwind Farms, File #CUP 8022-77
4) Lands of Bellucci, File 4CUP 3-80 and #VAR 12-80
5) Lands of Tokheim & Creen, File #PM 5-80
REPORT FROM VARIANCE AND PERMIT COMMISSION:
Commissioner Carico reported that there were two variance requests on the Agenda, 1)
Lands of ZepP, File #VAR 9-80, request to construct a swimming pool within fifteen
feet of the rear yard setback, (she noted that the adjacent property to the rear is the
City of Palo Alto), the Commissioners approved the request• 2) Lands of Sokoloff, File#
VAR 11-80, request to construct a windscreen over six feet high and a thirty foot max-
imum encroachment into the rear yard setback, the Commissioners denied the request.
D. PUBLIC HEARINGS:
1) CONSIDERING AMENDMENT TO CHAPTER 5 OF TITLE 9 OF THE LOS ALTOS HILLS MUNICIPAL CODE
ENTITLED °ZONING LAW OF THE T019N OF LOS ALTOS HILLS", ARTICLE 5.1 ENTITLED 'OUTDOOR
LIC,HTINC"
It was requested by staff to continue this item to the Planning Commission meeting
of November 12, 1980. It was passed by consensus to continue this item.
2) LANDS OF MERIDETH, FILE PSA 2-80, Elena Road, Paul Nowack & Associates, Engineers
It was requested by staff to continue this item, due to a delay in receiving required
information from Engineer. It was passed by consensus to continue this item.

3) LANDS OF KANE, File #TN 6-80, 27700 Lupine Road, Paul Nowack & Associates, Engineers
Request for Recommendation of Approval for Negative Declaration and Tentative Map.
Mr. Carlson recommended consideration of the Negative Declaration for the above
request.
The Public Hearing was opened and closed with no one speaking for or against this item.
MOTION SECONDED AND PASSED UNANIMOUSLY: It was moved by Commissioner Dochnahl and
seconded by Commissioner Kuranoff to recommend approval of the Negative Declaration
for the Lands of Kane, File #TM 6-80.
Mr. Carlson reviewed the above request as detailed in his staff report dated October
16, 1980. He noted that the only negative aspect regarding this subdivision is the
intense visibility of the four lots. Thereafter the hearing was opened to the dis-
cussion by the public.
Mr. Ralph Kane, Applicant, objected to the path location on Via Feliz, he felt it
would be an invasion of privacy to the owner of the lot. He also objected to the
County Health Department requirement to upgrade his system to current standards,
he indicated that the system had been cleaned and pumped recently and has had no
problems with it, he felt it is adequate for his home.
Mrs. Fran Stevenson, Chairman Pathway Committee, indicated that the path easement
mentioned is not necessarily for immediate use, but for the future.
` Commissioner Lachenbruch noted that possibly the applicant dedicate a ten foot (10')
path easement with the condition it be accepted or not accepted at the time a
connector path is established.
Mr. Simons, 27693 Lupine Road, spoke against the dedication of a ten foot (10')
easement for a Pathway.
Mr. Betz, 27751 Lupine Road, spoke against dedication of the pathway easement.
Commissioners discussed the Possibility of requiring landscaping for the entire
subdivision rather than at the time of Site Development.
The Public Hearing was closed and a review of the Conditions began, with the following
changes being made.
CONDITION B.A.- CONDITIONAL EXCEPTION: MOTION SECONDED AND PASSED UNANIMOUSLY: It
was moved by Commissioner Dochnahl and seconded by Commissioner Cation to consider
a Conditional Exception to approve a forty foot (40') right of way and a forty foot
(401) bulb.
CONDITION 1.C.: MOTION SECONDED AND CARRIED: It was moved by Commissioner Kuranoff
and seconded by Commissioner Docbnahl to amend Condition 1,C. as follows: An irrevo-
cable offer of dedication for equestrian and Pedestrian easement for purposes of a
connecting pathway from Via Feliz to Byrd Lane. When the connecting portion to Byrd
Lane is obtained, or when an alternative connecting Pathway between Via Feliz and
Byrd Lane is obtained, this offer shall be accepted by the Town.

CONDITION 1.D.: PASSED BY CONSENSUS to amend Condition I.D. to read as follows:
The owner shall dedicate a ten foot (10') equestrian and pedestrian and bicycle
46, path easements as shown on the Tentative Map, dated "Revised October 15, 1980"
on the northerly side of the subdivision.
CONDITION 1.D.: Condition I.D. shall be renumbered as Condition 1.E
CONDITION 1.P.; PASSED BY CONSENSUS to add Condition 1.F. to read as follows:
The owner shall dedicate a ten foot (101) equestrian and pedestrian easement
along westerly boundary of Parcel One.
Commissioners and applicant discussed Condition 3.A., that would require the applicant
to underground all utilities as required by Muncipal Code. They discussed the possibility
of allowing Mr. Kane to hold off modifying the property until Parcel one, two and three
are developed. Commissioners felt before a final decision could be made on Condition 3.A.
the City Attorney, Mr. Gillio should be contacted.
MOTION SECONDED AND PASSED UNANI11OUSLY: It was moved by Commissioner Kuranoff and
seconded by Commissioner Dochnahl to continue the Lands of Kane, TMff 2-80 until the
December 10, 1980 Planning Commission meeting.
Mr. Kane will request in writing a time extension until December 18, 1980.
E. OLD BUSINESS:
1) STATUS REPORT FROM COMMITTEE ON MR. LYNCH'S CABOOSE:
Commissioner Rydell was not present to give his report on the caboose. Commissioners
discussed briefly the landscaping that Mr. Lynch has been doing, but were still
concerned with the painting of the caboose, primarily the ends.
2) PROPOSED MASTER PATHWAY ELEMENT
Mrs. Fran Stevenson, Chairman Pathway Committee, reviewed the pathway map as
presented, noting that the map indicates all paths and trails foreseeable in
the future, although the map does not show which paths and trails are existing
and which are proposed. There are thirteen large properties which would involve
new trails and paths, that still need to be accepted. Some portions of these
properties have trails and paths which were already approved as part of the
1966 Pathway Map. For information purposes, the Horsemans Association did a
rough count of horses in the Hills, there are over 1,000 horses, this does indicate
that the paths and trails are needed in Los Altos Hills for travel.
Mrs. Carol Gottlieb, 24290 Summerhill Avenue, gave a brief background of the time
and hours spent working on the pathways, all paths have been studied carefully by
the Pathway Committee past and present. She thanked staff and members of the Planning
Commission for their help on the pathway element, and especially Mr. Carlson for his
time and dedication to this project.
Mrs. Saviano, 12620 Corte Madera Loan, spoke in favor of the Town's pathways and did
believe that the Town is in need of a Master Pathway Element.
Mrs. Artemas Ginzton, 28014 Natoma Road, commented on the hours of research spent
working on pathways, and suggested that instead of showing a proposed location for
paths across a large undeveloped parcel, arrows pointing across the parcel could be pse
where paths enter, The arrows would show the intent of a path, but would leave the
exact location until the parcel develops.
Mr. Carlson informed the Commission that the map presented shows all trails and paths
which would be adopted into the General Plan. The map would be drawn by a Draftsman
and have overlays to represent each type of path.

Commissioners discussed with staff if it would be possible to indicate on the maps
1 with "arrows" as suggested by Mrs. Cinzton. Staff felt this would be beneficial
kw and would work on the project for the next meeting.
Mr. Peter Davis, 26990 Orchard Hill Lane, spoke in favor of the pathway element
and encouraged the Planning Commission to accept the Master Pathway Element
as presented to them.
Commissioners began discussion on the element, both Planning Commission and Pathway
Committee did not agree with Principle ill as presented, there were 5 alternatives
given at this meeting which were to be typed and returned at the next Planning
Commission meeting. It was by consensus to continue this item to a workshop meeting
on October 29, 1980 for further review of the element and maps.
3) DEVELOPMENT INTENSITY LIMITATION ORDINANCE
It was passed by consensus to continue this item to a workshop meeting on October
29, 1980.
F. NEW BUSINESS:
1) Mr. Carlson reported the State passed two housing bills which would Pertain to
Los Altos Hills, 1) llobilehome Zoning and Movement: this bill will require by
January 1981, local agencies to either allow mobilehomes in single family zones
or other designated zones. Local governments can not prohibit mobilehomesg 2)
Requirement of all cities and counties by October 1, 1980 must have a Housing
Element as part of its General Plan. It must set out a specific program, including,
positive use of zoning Powers, by which a community will meet its fair share
of regional housing, needs. ABAG is to define "fair share".
Commissioners discussed both bills briefly and felt that the City Attorney should
be contacted for futher information.
There being no further new or old business, the meeting, was continued at 12:25 a.m.,
to a workshop meeting on October 29, 1980 at 7.45 n.m.
