MINUTES OF A REGULAR MEETING
Wednesday, January 13, 1982

Chairman Stewart called the meeting to order at 7:35 p.m. in the Town
Hall Council Chambers.
A. ROLL CALL & PLEDGE OF ALLEGIANCE:
Present: Commissioners Carica, Dochnahl, Lachenbruch, Stewart and
Chairman Rydell (arrived at 8:OOp,m,)
Absent: Commissioners Xuranoff & vanTamelen
Also Present: Assistant Planner Pat Webb; Secretary Leslie Penfeld
B. CONSENT CALENDAR:
Item Removed - 3.c. (Commissioner Lachenbruch)
MOTION SECONDED AND CARRIED: Moved by Stewart, seconded by Lachenbruch
r and passed unanimously to approve the balance of the Consent Calendar, namely:
1. Approval of Minutes - December 9, 1981
2. Setting Public Hearing for January 27, 1982:
a. Lands of BelZucci, File. #CUP 3-81
3. Recommendation of Approval to City Council on the following Conditional
Use Permits for Annual Review:
a. Lands of OwZwood Farms, FiZe #CUP 8007-75, 24970 O'Keefe Lane
b. Lands of Pinewood School, File #CUP 8014-76, 26800 Fremont Road
Commissioner Lachenbruch removed item 3.c., indicating that items B.6.,
B.7. had already been completed and should be removed from the conditions
of approval. Also noting that item 8.8. should be re -written as follows:
8.8. The applicant shall maintain existing trees and shrubs for landscaping
to mitigate the physical impact from offsite. Such landscaping shall
not interefere with buildings or the program at the site.
MOTION SECONDED AND CARRIED: Moved by Dochnahl, Seconded by Lachenbruch
and passed unanimously to recommend approval to the City Council for the
Lands of Westwind Farms, File #CUP 8022-77, 27210 Altamont Road for their
annual review as amended.

C. REPORT FROM CITY COUNCIL MEETINGS OF:
December 16, 1981: Commissioner Carieo reported that the City Council
approved the Lands of Bellucci request fer.ingress/egress easement as
recommended by the Planning Commission; and that they held off approving
the Site Development Ordinance and reorganization of codes until Mr. Spangle
presented a cost estimate.
January 6, 1982; Commissioner Stewart reported that the City Council
returned the recreational vehicle storage ordinance to the Planning Commission
for definitions of storage and screening; and that they approved the
zoning ordinance and fee schedule.
D. PUBLIC HEARINCE:
1. Lands of Gigli, File #CUP 2-81, 27231 Elena Road, Request for recommendation
of Conditional Use Permit for a secondary dwelling.
Ms. Webb referred to her staff report of January 7, 1982, indicating this
is a request to allow a secondary dwelling, which would be a 2 -story structure
housing a 3 -car garage and workshop on the lot floor, and a secondary
dwelling on the 2nd floor. Staff recommended approval with the conditions
as outlined in the staff report of January 7, 1982.
Commissioners were concerned of the view from off site, indicating that
landscaping of the secondary dwelling be watched carefully.
The Public Hearing was then opened.
Mr. Jon Lynch, Nowaek & Associates, noted that the applicant objected to
Condition #4 which requires a 10' pedestrian/equestrian easement along
the rear property Zine, noting this request seemed inadequate at this time
and impractical.
Mrs. Stevenson, Chairman Pathway Committee, suggested that if an easement
was granted on the adjacent lands, (Watters), then this easement could be
abandoned.
Mr. Jon Lynch, asked if this easement could be granted only when the adjacent
land owners dedicated easements for through travel.
The Public Hearing was then cZosed; commissioners began review of the conditions
of approval.
MOTION SECONDED AND CARRIED: Moved by Lachenbruch, seconded by Stewart and
passed that Condition #4 be revised as follows: The owner shall offer for
dedication a ten foot (101) pedestrian/equestrian easement along the rear
property line (across Lots 2, 3 and 4) upon condition that the. Town will
accept such dedication only when any through path connections are made on
adjacent properties.
Commissioner RydelZ entered the Public Rearing at this time.
,` MOTION SECONDED AND FAILED: Moved by DochnahZ, seconded by Stewart and
failed by the following roll call vote, that Condition #3 of the Ordinance
Conditions be removed, this would allow a paying guest in the secondary
dwelling.

MOTION SECONDED AND CARRIED: Moved by Lachenbruch, seconded by Stewart
and passed that a new condition be added to read as follows: Kitchen
facilities will be permitted in the secondary dwelling in accordance with
Section 9-5.703 of the Municipal Code.
MOTION SECONDED AND CARRIED: Moved by Carica, seconded by Lachenbruch and
passed unanimously to recommend approval of the Lands of Gigli, File #CUP 2-81,
as amended.
2. Lands of Tokheim & Creen, File #TM 5-81, Pernhill Drive, Request for recom-
mendation of Approval for Negative DecZaration and Tentative Map.
Ms. Webb referred to her staff report of January 8, 1982, recommending that
the Planning Commission adopt a motion recommending to the City Council that
a Negative Declaration be filed with Santa Clara County Clerk.
The Public Hearing was opened and closed with no one speaking for or against
the Negative Declaration.
MOTION SECONDED AND CARRIED: Moved by Stewart, seeonded by Doehnahl to
recommend approval to the City Council that the Negative Declaration for the
Lands of Tokheim & Creen be filed with the Santa Clara County Clerk.
Ms. Webb referred to her staff report of January 8, 1982, indicating that the
file and maps were reviewed previously by John Carlson (City Engineer) prior to
his leaving, Ms. Webb noted the storm drainage has been reviewed by the
engineer and that a letter has been approved by the adjacent land owner
for acceptance of storm drainage facilities. A9s. Webb indicated that the
parks and recreatian in -lieu fee needed to be added to the conditions of
approval in the mnount of 059.3o,
COMisaionsr LaChenbruch was concerned with Condition 2.A. indicating that it
did not include the Town GeoZoaist's review of the Geotechnical Reports.
The Public Hearing was then opened.
A&. Sandia, Engineer, indicated that the applicant agrees with all conditions
except condition 10.a. and requested that it be amended to read as follows:
Surface rain water from newly created impervious surfaces shall be captured
in underground drainfields or directed and carried to -natural swaZes going
throWk proposed easement as indicated in Condition 10.C., in order not to in-

Me. Hebb infomaed commission that Mr. Carlson felt it necessary to include
Condition IO.a. in this subdivision and that the design should be approved by the

Coamiesioner Lachenbruch noted that the underground drainfielde should be
included in the Geotechnical Report.
Me. Sandia informed the commission that he did not feel Condition 10.a. was
necessary since his firm proposes to improve the atom drainage through to
the Prmmpton property.
Fran Stevenson, Chairman Pathway Committee noted that a Path in -lieu fee
should be included in the conditions of approval.
MOTION SECONDED AND CARRIED: Moved by Stewart, seconded by Carico and passed
unanimously that plane for work over the Frampton property to Rale Creek as
proposed in a letter by Edwin Green dated September 9, 1981 and accepted by
Mrs. W.D. Frmmpton on October 9, 1981, are to be approved by the City Engineer
prior to commencement of work; final approval shall be reviewed by the City
Engineer.
PASSED BY CONSENSUS: It was passed by consensus that Condition 2.A. be revised
as follows: A final geotechnical report shall be prepared and approved by
the town geologist and engineer prior to Final Map approval.
PASSED BY CONSENSUS: It we passed by consensus to amend Condition 10.a.
as follows: On Lots 2 and 3 surface rain water shall be captured in undar-
ground deaainfields in order not to increase surface runoff excessively.
PASSED BY CONSENSUS: It was passed by consensus to add Condition 11. (c)
and 11 (d) as follows:
11.(e) Path in-Zieu Fee: 3 lots 9 $300.00 per lot $800.00
11.(d) Parke and Recreation in-Zieu fee:
Assessed Valuation = $78,847 x 0.00963 759.30
The total conditional fees shall be $1,359.30
MOTION SECONDED AND CARRIED: Moved by Stewart, seconded by Carico and passed
unanimously to recommend approval to the City Council on the Lands of Tokheim
and Green, File #TM 5-81, as amended.
E. OLD BUSINESS:
Commissioner asked staff what the status was of the commissions -•proposal to
Council for Spangle A Associates to review and reorganize the site develop-
ment ordinance.
Staff informed commission that Mr. Spangle had not submitted his proposal
to the Town at this time.

F. NEW BUSINESS:
Commissioners asked staff to investigate the landscape requirevente_
for the new residence being constructed at Berry Bill.
Staff wilt Zook into this and report back at the next commission
meeting.
C. ADJOURNMENT:
There being no further new or oZd business, the meeting was adjourned
at 10:00 p.m.
