MINUTES OF A RFC,ULAR MEETING
Wednesday, July 28, 1982

Chairman Lachenbruch called the meeting to order at 7:05 p.m. in the Town
Hall Council Chambers.
A. ROLL CALL:
Present: Commissioners Lachenbruch, Rydell. and Struthers
Absent: None
Also Present: Assistant Planner Pat Webb; Secretary Leslie Penfold
B. PUBLIC HEARINGS:
1. Lands of Hasenpflug, File #VAR 5-82, 26238 Fremont Road, Request for a
variance for maximum two foot (21) encroachment into the side yard set-
back and to allow future maximum development area of 15,000 sq.ft, for
a .934 acre parcel
� Ms. Webb referred to her staff report of July 23, 1982, indicating at the time
of recordation of the three lot subdivision (Klock Property) a twelve foot (12')
access easement over an existing driveway on the west side of the property was
proposed, along with a ten foot (10') easement on the north side of the property
f for future public right of way widening. Ms. Webb indicated there appears to
be no record of either of these easements being officially recorded. Ms. Webb
indicated the Hasenpflug's are requesting a variance that will allow their
property the same status it currently has in terms of setbacks and MDA, after
they deed the twelve foot (121) easement to Mrs. Klock. Staff recommended
approval of the variance request with recommendations and conditions of approval
as outlined in staff report of July 23, 1982.
The Public Hearing was then opened
Mr. John Sines, Attorney representing Hasenpflug, provided commission with a
diagram of the existing parcels and the easement in question, Mr. Sines indi-
cated he would not be in favor of the City Attorney's proposed condition as
stated in his memo to staff dated January 25, 1982.
The Public Hearing was then closed, commission began review of conditions for
granting variance.
Commission questioned if the criteria for granting variance could be met,
noting two driveways side by side is inconsistent with general plan and policy
of the Town. Commission asked Mr. Sines if the two driveways could be combined?
Mr. Sines indicated Mr. $ Mrs. Puorro said "NO", and Mr. F Mrs. Chang did not
respond to letter sent.

Commissioners asked Mr. Sines if they would consider a ten foot easement,
%W indicating a variance would not be necessary. Mr. Sines indicated he has
not reviewed this with Mrs. Klock's attorney. With regard to the develop-
ment area variance request, commission felt they could not make a final
decision until the matter of the easement had been settled.
MOTION SECONDED AND CARRIED: Moved by Rydell, seconded by Lachenbruch,
and passed by the following roll call vote to continue the Lands of Hasen-
pflug to next scheduled meeting, for applicant to supply commission with
further information regarding ten foot easement rather than twelve foot.
Staff is to send a memo to City Attorney for his opinion regarding the
easement being invalidated through lack of use.
