HomeMy WebLinkAbout11/10/1982VARIANCE AND PERMIT COMMISSION Town of Los Altos Hills 26379 Fremont Road Los Altos Hills, California MINUTES OF A REGULAR MEETING Wednesday, November 10, 1982 Reel 102, Side II, Tract II, 000-500 Chairman Kuranoff called the meeting to order at 6:35 p.m. in the Town Hall Council Chambers. A. ROLL CALL: Present: Commissioners Kuranoff, Stewart and Struthers Also Present: Assistant Planner Pat Webb; Secretary Leslie Penfold B. PUBLIC HEARINGS: 1. Lands of MJM Investments, File #VAR 8-82, Lot #4, Tract 6518, Story Hill Lane, Variance requests for lot coverage, height limitation, and swimming pool into setback. Ms. Webb referred to staff repot of November 8, 1982, indicating this variance request is for a three part variance: 1) proposed building coverage to exceed by 88 tle 448 MDA allowed by Code Sec- tion 9-5.502; 2) proposed building height to exceed 11i' as allowed by Code Section 9-5.503; and 3) maximum 8' encroachment into side - yard setback for a swimming pool. Staff recommends denial of the requests noting there are no unusual or exceptional circumstances. The public hearing was then opened. Mr. Seals,Architect , asked commission to grant approval of the requests, and reviewed the six criteria for granting of a variance. Ms. Susan Barbour, owner, would like to build house within the trees, but is being restricted because of the new ordinance (268), and asked commission to grant approval of the request. Mr. Bruce Weiner, Coldwell Banker, asked commission to grant approval of the variance indicating it would be a hardship to remove trees and build higher of the knoll. The public hearing was then closed. Commission and staff reviewed the proposed variance request and plans; and reviewed conditions for granting of a variance. Commission indicated to applicant they liked the architecture of this proposal, however, the ordinances were written to minimize larger houses on smaller, steeper lots and asked if there was anyway to reduce the size of the residence to conform to the ordinances. V Variance & Permit Commission Minutes November 10., 1982 Page Two Mill Investments, File #VAR 8-82, (continued) MOTION SECONDED AND CARRIED: Moved by Stewart, seconded by Struthers and passed unanimously to recommend approval of the variance request for the Mill Investments, File #VAR 8-82, to allow a maximum eight foot (8') encroachment into the side - yard setback for a swimming pool. Commission found basis for recommending granting of the variance in conformance with Municipal Code Section 9-5.1107. MOTION SECONDED AND CARRIED: Moved by Struthers, seconded by Kuranoff and passed unanimously to recommend denial without prejudice the variance request for Mill Investments, File #VAR 8-82, to allow proposed building height 1;' over Municipal Code Section 9-5.503, based on condition #2 of the Municipal Code Section 9-5.1107. MOTION SECONDED AND CARRIED: Moved by Stewart, seconded by Struthers and passed unanimously to recommend denial without prejucide the variance request for Mill Investments, File #VAR 8-82, to allow proposed building coverage to exceed 88 the 448 MDA allowed by Municipal Code Section 9-5.502, based on Item #6 of the Municipal Code Section 9-5.1107.
