MINUTES OF A REGULAR MEETING
Wednesday, December 8, 1982

Chairman Rydell called the meeting to order at 7:30 p.m. in the
Town Hall Council Chambers.
A. ROLL CALL AND PLEDGE OF ALLEGIANCE:
Present: Chairman Rydell and Commissioners Carico, Dcchnahl,
Kuranoff, Stewart and Struthers
Absent: Commissioner Lachenbruch
Also Present: City Engineer/Planner John A. Carlson; Assistant
Planner Pat Webb; Secretary Leslie Penfold
B. CONSENT CALENDAR:
MOTION SECONDED AND CARRIED: Moved by Carico, seconded by
Dochnahl and passed unanimously to approve the Consent Calendar,
namely:
1. Minutes of November 10, 1982 - Variance & Permit and
Planning Commission
2. Setting Public Hearings for December 22, 1962:
a. Lands of McCandless, File #SA 3-82
b. Lands of Roth, File #SA 2-82
C. REPORT FROM CITY COUNCIL MEETINGS:
1. November 15, 1982 - Commissioner Stewart reported the City
Council accepted an offer on Lot #18 with changes made on
the MDA; and set parameters for making changes within the
CC&R's for Matadero Creek.
2. December 1, 1982 - Commissioner Carico reported the City
Council: 1) accepted offer for Lot #20,with changes to the
MUA; 2) modified the amendment for the Subarea Plan -
Chaparral Way; 3) approved the appeal for Fosters; and 4)
denied the appeal for Hwang.
D. PUBLIC HEARINGS:
1. Lands of Fremont Hills Country Club, File #CUP 8010-76,
40, 12889 Viscaino Place, Annual Review (continued from
November 10, 1982)
Chairman Rydell excused himself from this hearing do to a
possible conflict of interest.

Ms. Webb gave a brief review of the background for the Country
Club. Ms. Webb informed commission research had been done for
the parking and number of membership, as outlined in her staff
report of November 5, 1982. Further noting, Ms. Webb, indicated
there had been no written or verbal objections to this applica-
tion and recommended approval of the annual review with two (2)
new conditions as outlined in the November 5, 1982 staff report.
Lis. Webb noted she had been in contact with the owner of Fremont
Hills earlier in the day and he indicated he was agreeable with
the 2 new conditions.
The Public Hearing was opened and closed with no one speaking
for or against this item.
Commission discussed with staff the parking facilities and the
hazard of members parking on street. It was decided staff
would indicate to Fremont Hills in writing, that parking is to
occur in designated areas.
MOTION SECONDED AND CARRIED: Moved by Struthers, seconded by
Carico and passed unanimously to recommend approval to the City
Council of the annual review for Fremont Hills Country Club,
File #CUP 8010-76, with conditions as outlined in staff report
dated November 5, 1982.
2. Lands of Schwarz, File #TM 9-81, Moon Lane and Saddle Mountain
Drive, Nowack & Associates - Engineer, Request for recommendation
of approval of Negative Declaration and Tentative Map, 4 lots,
(continued from 11/10/82)
Mr. Carlson informed the commission this is a continued Public
Hearing for the Negative Declaration for the Lands of Schwarz,
noting since the last meeting, he, the owner and his engineer
met to discuss and review plans as a result of the discussions
at the November 10, 1982 meeting. mr. Carlson recommended that
the Planning Commission adopt a motion recommending to the City
Council that the Negative Declaration for the Lands of Schwarz
be filed with the Santa Clara County Clerk.
The Public Hearing was then opened.
Mr. Karl Schwarz, 2931 Alexis Drive, gave a brief background and
slide presentation of the subject property.
Mr. Dukes, 27783 Lupine Road, expressed concerns over drainage,
sewage and the installation of the drainage pipe. Mr. Dukes
also asked commission who would be liable for hillside damage?
Mr. Carlson and Paul Nowack assured Mr. Dukes and commission
the installation of the drainage pipe is a standard practice
and the 11' cut is very common.

�r Commission and staff discussed the septic fields and percolation
testing along with geologic concerns.
MOTION SECONDED AND CARRIED: Moved by Carico, seconded by
Struthers and passed by the following roll call vote to
recommend approval to the City Council for the Negative
Declaration with mitigating measures, (dated November 8, 1982)
for the Lands of Schwarz and that it be filed with the
Santa Clara County Clerk.
Tentative Map
Mr. Carlson referred to his staff report dated December 2, 1982,
indicating items of concern have been addressed to his satisfac-
tion, (storm drain, slide, septic field and roadway locations).
Staff recommended that the Planning Commission recommend approval
to the City Council for the Tentative Map with the conditions
of approval as outlined in staff report.
The Public Hearing was then opened.
Mr. Karl Schwarz, asked commission to approve the tentative map.
Mr. Bredo, 13820 Page Mill Road, expressed his concern over the
aesthetics of house location and roadway.
Mrs. Chown, 13822 Page Mill Road, expressed concern over road
name and requested a barricade be installed at Moon Lane to
prohibit motorcycle and off-road vehicles.
Mr. Silins, 27693 Lupine Road, indicated to commission that
Lot #4 the new residence will block his view and requested
that a definate location be designated.
Mr. Dukes, 27783 Lupine Road, requested commission to give
a statement indicating the liability of the hill slipping.
Commission and staff discussed in detail the types of barricades
which could be installed.
Mr. Carlson indicated the applicant posts a bond and records
a Subdivision Agreement with the City to insure improvements.
Commission suggested that Mr. Dukes write a letter to the Town
addressing his concerns and that this letter would be forwarded
to the City Attorney for review.
Mr. Carlson indicated Condition B.B. states the Historical
Society will make a recommendation on the street name for the
subdivision.

of the conditions of approval.

CONDITION 1.L.
MOTION SECONDED AND CARRIED: Moved by Carico, seconded by
Stewart and passed unanimously to add Condition I.L. as follows:
The owner shall abandon access rights, except vehicular access
to Moon Lane prior to recordation of the Final Map.
CONDITION 2.D.
Passed by consensus to amend Condition 2.D. as follows:
At the owner's expense, the Town's Soil and Geologic Consultant
shall inspect all earthwork, including trenches for storm
drain during construction thereof.
CONDITION S.B.
Passed by consensus to correct Condition S.B.; should be
southeast not southwest.
CONDITION 6.F.
Passed by consensus to amend Condition 6.F. to include the
Planning Commission.
CONDITION 6.G.
Passed by consensus to amend Condition 6.G, as follows:
A substantial barricade (lock gate type) shall be installed
similar to that on Edgerton Road at the most optimal location
on Moon Lane, to prohibit thru traffic.
Prior to City Council approval of Condition 6.G., the City
Attorney will be requested to give his opinion.
CONDITION 7.B.
MOTION SECONDED AND CARRIED: Moved by Struthers, seconded by
Kuranoff and passed by the following roll call vote to add
Condition 7.B. as follows: If private sewer system is not
feasible on a single lot, sewage must be pumped to the existing
sewage system in Saddle Mountain via pipe to Page Mill Road.

Abstain: Commissioner Stewart
CONDITION B.C.
Passed by consensus to add Condition B.C. as follows:
The residence, driveways and parking areas shall be designed
to drain runoff from these areas to the swale west of the
property.
CONDITION 8.D.
MOTION SECONDED AND CARRIED: Moved by Kuranoff, seconded by
Stewart and passed unanimously to add Condition B.D. as follows:
` On Lot #4, the highest point of the structure shall not exceed
410 elevation. The septic leach field may encroach in the
Conservation and Site Development Easements to accomodate
the location of the house.

CONDITION 8.E.
Passed by consensus to add Condition 8.E. as follows:
The Building Setback Line as set forth in Section 9-5.504
of the Los Altos Hills Municipal Code, for southern lot
lines of Lots # 3 and 4 shall be fifty feet (50').
CONDITION 9.(a)
MOTION SECONDED AND(ARRIED: Moved by Stewart, seconded by
Kuranoff and passed unanimously to waive Condition 9.(a)
Storm Drainage Fund - $800.00.
The new total fees shall be $367.78.
MOTION SECONDED AND CARRIED: Moved by Struthers, seconded by
Kuranoff and passed unanimously to recommend approval to the
City Council for the Tentative Map, Lands of Schwarz, File
#TM 9-81 with Conditions of Approval as amended.
E. OLD BUSINESS:
1. City Council referral for report on Amendment -
Chaparral Way
Mr. Carlson referred to his staff report of December 2, 1982,
f noting this item is a referral from the City Council. Indicating
the City Council at their meeting of December 1, 1982, modified
the amendment to the Subarea Plan Element for Chaparral Way
that was recommended by the Planning Commission at your October
13, 1982 meeting. The amendment adds the following verbage:
"the Planning Commission may exempt" and deletes "shall be
exempt". Mr. Carlson referred to the City Attorney's memo
of August 11, 1982, which indicates the Planning Commission
must report to the City Council on the modification to the
amendment.
The Public Hearing was then opened.
Mr. Sandis, Engineer, asked for clarification on the Site Develop-
ment application for the Hortons', noting if the City Council
approves the amendment is the Site Development Application
still valid?
Mr. Carlson suggested commission request an opinion from the
City Attorney.
Councilman Allison, recommended to the commission that if they
decide to accept the amendment made by the Council, that the
commission also report to the City Council that the Site Develop-
ment permit previously given to the Horton's would remain in
effect.

E. OLD BUSINESS: (continued)
1. Subarea Element - Chaparral Way
The Public Hearing was then closed.
Commission discussed the amendment to the Subarea Plan. Com-
missioner Stewart indicated he was not in favor of the amendment.
MOTION SECONDED AND FAILED: Moved by Carico, seconded by
Dochnahl and failed by the following roll call vote to accept
the amendment made to the Subarea Plan Element by the City Council
at their December 1, 1982 meeting.
ROLL CALL:
Ayes: Commissioner Dochnahl
Noes: Commissioner Carico, Kuranoff, Rydell, Stewart and Struthers.
Abstain: None
Commissioners discussed making a statement regarding the Site
Development previously approved for the Lands of Horton.
MOTION SECONDED AND CARRIED: Moved by Kuranoff, seconded by
Struthers and passed by the following roll call vote, that the
Planning Commission wording "shall exempt" is preferrable,
however, "may" is the preference of the City Council; whether
"shall" or "may" is used, the Site Development Approval previously
given to the Horton's is still valid.

Abstain: Commissioner Dochnahl
F. uEw BUSINESS:
1.Easement Abandonment Lands of Farber, 26303 Esperanza Drive.
Mr. Carlson noted the request is for an abandonment of a five
foot PUE easement which runs along the western boundary of the
subject property, indicating the commission is to report to the
City Council on this item.
MOTION SECONDED AND CARRIED: Moved by Kuranoff, seconded by
Struthers and passed unanimously to recommend approval of the
easement abandonment? Lands of Farber, 26303 Esperanza Drive
to the City Council.
MOTION SECONDED AND CARRIED: Moved by Carico, seconded by
Kuranoff and passed unanimously to extend the meeting until
12:15 a.m.

E. NEW BUSINESS: (continued)
`, 2. Daughters of Charity
Staff informed commission an application had been received
to amend the Conditional Use Permit for the Daughters of
Charity and a field trip has been scheduled with the applicant
at the site for Saturday, December 18, 1982 at 9:00 a.m.
MOTION SECONDED AND CARRIED: Moved by Carico, seconded by
Kuranoff and passed to adjourn this item to a field trip,
Saturday, December 18, 1982 at 9:00 a.m.
(Committee members who wish to attend are invited.)
3. Subarea Plan Element - Chaparral Way
MOTION SECONDED AND CARRIED: Moved by Carico, seconded by
Kuranoff and passed by the following roll call vote, to
recommend to the City Council that the Subarea Plan Element
for Chaparral Way be removed from the General Plan for Los
Altos Hills.
ROLL CALL:
Ayes: Commissioners Carico, Kuranoff, Rydell and Struthers
Noes: Commissioners Dochnahl and Stewart
Abstain: None
G. ADJOURNMENT:
There being no further new or old business, the meeting
was adjourned at 12:30 a.m.
