A. ROLL CALL: Present: Commissioners Carico, Stewart and Struthers Absent: None Staff: City Engineer/Planner John A. Carlson; Acting Staff Planner Nancy Maddox Lytle, Secretary Leslie Mullins r.�eTY1 1. lands of Tsunoda, File #VAR 1-84, 11622 Rebecca Lane, Variance request to exceed maximum allowable development area (MDA) by 2,453 sq.ft. as per Section 9-5.215 and 9-5.502 of the Municipal Code for a swimming pool. 4 Ms. Lytle referred to her staff report of March 9, 1984, noting this is a variance request to exceed the maximum allowable development area by 2,453 sq.ft. to allow for construction of a swimming pool and decking. Ms. Lytle indicated the applicant previously received a site development permit on November 29, 1979, to construct a residence, swimming pool and tennis court, pointing out the residence and tennis court building permits were obtained and finaled in 1980-81. The applicant did not request a permit for the swimming pool until January, 1984. Ms. Lytle indicated at the time site development was issued for all three items the site plans were in conformance with the ordinances, however, with current regulations precludes the pool construction. Staff recaarended denial of the subject variance request, be- cause written application does not produce evidence, not has staff found evidence in their review of the project, supporting the six criteria listed in Title 9, Chapter 5, Article II, Section 9-5.1107 (b). Mr. Tsunoda, 11622 Rebecca lane, informed commission he selected a lot in order to have a residence, tennis court and swimndng pool; asking commission to grant approval of this variance request noting the site development was all previously approved by the Town. Mr. Tsunoda reviewed his six statements as per Municipal Code Section 9-5.1107 (b), (received, March 13, 1984). Mr. Tsunoda indicated he would remove as Much impervious surface as necessary to enable him to construct swimming pool. Mr. Mnthy, 11632 Rebecca Lane, questioned Mr. Tsunoda as to the location of the pool. Mr. Tsunoda showed Murthy a site plan, and indicated they would fence the pool area for the safety of the children. The Public Hearing was then closed. Variance & Permit Cacmission Minutes March 14, 1984 Page Two Commissioner Carico asked Mr. Tsunoda if he could send the plans back to his architect to see if sere of the development could be reduced, noting if it was not reduced she could not vote in favor of this 2,400 sq. ft. variance request. Ca aissioner Stewart suggested the concrete area he reduced, and perhaps sane of the decking on the home, and with the use of lawn area around the pool, this could eliminate the need for such a large variance request, noting then he would be able to vote in favor of the request. CaTudssloner Struthers suggested Mr. Tsunoda use lawn around the pool area to reduce the amount of impervious surfacing, noting she felt the commission could approve the request giving a specific nuober that would be allowed for development area on the subject lot and then have the applicant go on to Site Developnent for approval of the grading and drainage of the pool. MOTION SA"tlfIDID AND CARRIED: Moved by Stewart, seconded by Carico and passed u++ly to deny without prejudice the variance application for the Lands of Tsunoda, File $VAR 1-84, as the six criteria for granting of a variance as per amicipal Code Section 9-5.1107 (b) could not be met positively, as the existing developrent area is already exceeded and this request would bring the total developent area 2,453 sq.ft. over the allowed. Mr. Tsunoda was info=d he can re -apply up to one year without additional fees being inposed or make an appeal to the City Council on this action. C. OLD BUSINESS: D.
