HomeMy WebLinkAbout06/13/1984TOM OF LOS ALTOS HILLS 26379 Fremont Road DOS Altos Hills, California MINUTES OF A REGULAR MEETING Wednesday, June 13, 1984 Reel 109, Side I, Tract II, 000-135 Chairman Stewart called the meeting to order at 7:10 p.m. in the Cosmcil Chambers at Town Hall. A. ROLL CALL: Present: Co mnissioxers Carico, Stewart and Struthers Absent: None Staff: Nancy Lytle Staff Planner and Leslie Mullins Secretary 1. Lands of Tacy, File #VAR 3-84, 27269 Byrne Park Lane, Variance request to infringe upon front yard setback as defined in Ordinance %1W #268, Section 9-5.504, by approximately 13 feet. Ms. Lytle referred to her staff report of June 8, 1934, noting the requested encroactmnnt into the front yard setback is 11 1/2' according to the appli- cant. in staff's opinion, the written application produces sufficient evidence supporting criteria 3,4,5, and 6 of the required variance findings but does not sufficiently support criteria 1 and 2. Ms. Lytle informed the cotmmission the applicant has submitted and received approval for the proposed additions, driveway alignment and garage improvement, however, the approved application conforms with Tynan ordinances by providing for only a two car garage and an uncovered parking space. While this solution does not meet all of the applicants requests, it is possible without a variance being granted. Staff recur rends that the Variance & permit Cmwission deny the variance request, as variance criteria 1 and 2 can not be met. The public Hearing was then opened. Dr. Tacy, 1101 Suffolk Court, Dos Altos, informed commission they had purchased the property last December and have been trying to fonmulate a plan for remodeling, noting as the property is extremely steep it has been very difficult, noting they are plannin g to remodel the entire garage and move the entrance to another side. Dr. Tacy informed comnission they desire to develop something functional and operational for our family and would muds rather have a garage than a parking area, noting this Mould be aesthectically pleasing as well. Mr. Walter Chapan, 22722 B Medina, Cupertino, Building Designer, informed commission after working on the variance application further they have determined they would be able to construct the garage in such a place that it would require only 1/2 the encroachment as previously mentioned, noting the structure will not be visible from roadway. Variance & Permit Ccnudssion Minutes June 13, 1984 Page Two Camdssioner Struthers questioned if the applicant was also requesting a variance k to exceed the development area, noting as part of the Site Development Approval �r the applicant was required to remove 22 sq.ft. of their driveway to conform. IN Mr. Chapman indicated we are now proposing the setback encroachment to about 5' and the development area will be reduced by approximately 100 sq.ft. The Public Hearing was then closed. Commissioner Stewart indicated as staff has found variance criteria to meet 3,4,5, and 6 we can not make findings for 1 and 2, noting his site visit to the property he inspected surrounding properties, finding them to all be steep and hilly. Cx missioner Stewart expressed he personnally cannot find that there are exceptional or extraordinary circumstances for the granting of this variance request. Ommissioner Struthers expressed she could not find sufficient evidence to vote in favor of this request, even though the driveway area is steep with overall 12%. MOTION SEMT)ED AND CARRIED: Moved by Struthers, seconded by Carico and passed unanimously to deny without prejudice the variance application for the Lands of Tacy, File WAR 3-84.
