HomeMy WebLinkAbout09/12/1984VARIANCE AND PERMIT COWISSION 4 'TOWN OF LOS ALTOS HILLS 26379 Fremont Road Los Altos Hills, California MINUTES OF A REGULAR MEETING Wednesday, September 12, 1984 Reel 111, Side I, Tract I, 815 -End Chairman Kurano£f called the meeting to order at 7:00 p.m. in the Tom Hall Council Chambers. A. ROLL CALL: Present: Chairman Kuranoff and Commissioners Caries and Struthers Absent: None Staff: Staff Planner Nancy Lytle; City Engineer Michael Enright, Secretary Leslie nillins B. PUBLIC HEARINGS: 1. Lands of Barbour, File #VAR 4-84, 28110 Story Hill Lane, request for variance to allow pool equipment in side setback Ms. Lytle referred to her staff report of September 1, 1984, noting the applicant has requested a variance to exceed side yard setback, as defined in Ordinance #268, Section 9-5.504 (b)(2) with an encroachment of twenty eight feet for the purpose of locating pool equignent within two feet of the westerly property line. Ms. Lylte infor; ed camission the application does not provide sufficient evidence supporting the necessary findings for granting a variance per section 9-5.1107(b), noting the applicant's request is based largely on a couparison between the City of Palo Alto zoning regulations, which are less restrictive. Ms. Lytle recanmanded the Variance & Permit C=nission adopt a motion to deny the variance request for the Lands of Barbour. Ms. Lytle indicated there was a submittal made by Mrs. Judy Bogard and received by the Ton on September 6, noting staff has not had sufficient time to review and report on the materials supplied, which change the location of the subject pool equipnent and would require a variance fromtwo setbacks. The Public Hearing was then opened. Mr. John Barbour, 28110 Story Hill lane, informed caumission and staff they are now asking for a different variance request than originally submitted, noting all neighbors are in favor of the new location of the pool equipment. Mr. Barbour referred to Mrs. Bogards letter of September 6, noting all requirements stated in the letter are acceptable. Mr. Barbour listed several various other locations the pool equipment could be located, giving conmission reasons why these locations would not be adequate. Mrs. Judy Bogard, 3003 Country Club Drive, Palo Alto, indicated she would agree to variance request if they meet the requireu nts listed in her September 6, 1984 letter, noting she would like the equipment Variance & Permit Minutes September 12, 1984 Page Two B. PUBLIC HEARINGS: (continued) moved within two weeks and requested adequate screening to reduce the noise level. The Public Hearing was then closed. Commissioner Struthers indicated she would like to see the equipment as far away from any property line as possible, as pool equipment can be very loud. Commissioner Carico indicated she could meet the requirements 4, 5, and 6 of 9-5.1107, but could not make adequate findings for 1, 2 and 3. Ms. Lytle indicated if the commission is not going to make a motion on the proposed variance request as in staff report, commission should make a motion to continue this request so that staff may give sufficient review and discuss with applicant the new proposal. Chairman Kuranoff agreed that staff should review the new proposal and return with staff report with approval or denial. Mrs. Bogard asked if commission is not going to make a decision on the proposal this evening, could the equipment be shut off until a decision is made, noting it has been over 90 days with the pool equipment 1 foot away from the property line. Cmmissioners indicated they do not have the right to request the Harbours to shut off their equipment, noting this would be an administrative procedure. MOPION SECaMED AMID CARRIED: Moved by Struthers, seconded by Carico and passed unanimously to continue the Lands of Barbour, File #VAR 4-84 to September 26, 1984 meeting. Commissioner Carico requested the same commissioners be in attendance. Mr. Barbour informed cammission he would re -submit new application and plans tomorrow (September 13), noting they will be out of Town on the 26th and will have someone here to represent them. Commissioner Struthers requested the new application show on the plans all pool decking, and trees, suggesting that the equipment be located closer4the diving board and further from the Love's property line. Mrs. Bogard requested the pool equipaent run during the hours of midnight to 5:00 a.m. while the Barbours are away. C. OLD BUSINESS: D. NEW BUSINESS: E.
