Present: Cammissicners Carico, Gottlieb, Lachenbruch, Siegel, Struthers Yanez and Chairman Kuranoff Absent: None Staff: City Manager George Scarborough, City Engineer Michael Enright, Staff Planner Nancy Lytle, Secretary Leslie Mullins B. CONSENT CALENDAR: Item Rgnoved - B.1. Lachenbruch & Kuranoff MOTION SECONDED AND CARRIED: Moved by Lachenbruch, seconded by Carico and passed unanimously to approve the remainder of the Consent Calendar, specifically: 2. Acceptance of 'Tentative Map for filing: a) Lands of Kava, File #7M 4-82, Stonebrock Drive, 2 Lots 3. Setting Public Hearings for September 26, 1984 a) Annual Review Pinewood Private School, File #CUP 8014-76 b) Amencln t to Chapter 3, Title 9, Site Development Ordinance Revisions Iachenbruch requested on page three, second paragraph be amended after their, as follows:"opinion such provisions are not relevant to problems related to a particular lot line adjustment application." On page four change under Item #3, time to expenses. Kuranoff requested on page three, fifth paragraph, 6th line, Ms. Lytle stated... M7IION SECONDED AND CARRIED: Moved by Carico, seconded by Lachenbruch and passed unanimously to approve the minutes of August 22, 1984 as amended. Chairman Kuranoff reported the Variance & Permit Canmdssion continued the variance request for the Lands of Barbour, for pool equipment to pe placed within sideyard setback, noting the staff report was prepared on an appli- cation to allow equipment two feet from property line; noting the applicant requested at the meeting a new location, in order for staff to review and Prepare new staff report the meeting was continued to September 26, 1984. REPORT FROM CITY COUNCIL MEETING OF SEPTEMBER 5, 1984: (.Commissioner Siegel reported the City Council has suggested the Commission AV Chairman meet with City Manager to discuss Code Enforcement concerns and if in the opinion of the Manager he will make a recomendation to have a study session; approved the procedures for Int Line Adjustment with the change that after Commission review the lot line will be placed on the Consent Calendar on the next CoL oil agenda; approved Lot Line Adjustment for Parnas, Story Hill Lane; regarding Matadero Creek items on the Agenda, Mr. Siegel informed commission the Council denied the request for Lot #8 to increase their MDA for a swimming Fool; approved on a three to two vote to increase height limitation on Lot #17 by 5'; and heard request for Int #20 to allow pool, stable and walkway, noting the Architectural Review committee asked Council to waive all requirements and to go by the Mumicipal Code Zoning laws, noting Council denied the request for pool and directed the City Manager to work out the wheelchair access to the house. Mr. Siegel reported the request regarding site development comdttee members receiving reimbursement for their expense was referred to Councilwoman Dronkert for review. Mr. Scarborough informed the Co$mnission the applicant of Lot #8 will be able to construct a swimming pool, having adjusted some of the proposed development area. Commissioner Siegel questioned the process of computing MDA, asking if there is a document that staff uses? and is it available for architects? Ms. Lytle informed commission there is a zoning/site development packet that is available at Town Hall which includes calculation forms and the development area ordinance. E. PUBLIC HEARINGS: 1. Lands of Griffiths, File #CUP 4-84, 14125 Berry Hill Lane, Request for approval of Conditional Use Permit for secondary dwelling Ms. Lytle referred to her staff report of September 1, 1984, noting this is a request for consideration of application for Conditional Use Permit for a secondary dwelling unit per Ordinance #283 and Section 9-5.1107 (a). Staff recammended the Commission adopt a motion making the required findings, and a motion granting the Conditional Use Permit as described in the above referenced application, subject to Conditions of Approval in the September 1, 1984 staff report. Commission and staff discussed Condition #9, relating to staffs ability to review conditional use permits annually, the types of use permits that need to be checked and necessity. Commissioner Lachenbruch questioned if the NIDA had been calculated on the subject property? Ms. Lytle informed cammission it had not been checked. Mr. Scarborough indicated a NIDA review is 4 hours or more of staff time. The Public Hearing was then opened. Mr. Griffiths, 14125 Berry Hill Lane, informed commission the property is being modified slightly from original approval, in only that the second unit area was previously going to be a recreation roan, noting his mother is ill and will be living in the second unit. Mr. Griffiths indicated all utilities are already up to the second unit area. Planning Commission Minutes - September 12, 1984 Page Three E. PUBLIC HEARINGS: 1. MOTION SECONDED AND CARRIED: Moved by Lachenbruch, seconded by Carico and passed by the following roll call vote to approve the Lands of Griffiths, File #CUP 4-84, 14125 Berry Hill Lane for secondary dwelling, subject to Conditions of Approval of September 1, 1984 staff report. ROLL CALL: AYES: Commissioners Carico, Gottlieb, Lachenbruch, Siegel, Struthers and Chairman Kuranoff NOES: Commissioner Yanez ABSTAIN: Nome MOTION SBCCN= AND CARRIED: Moved by Siegel, seconded by Lachenbruch and passed unanimously to agendize for a future meeting discussion of Conditional Use Permit enforcement. 2. Lands of Steers, File #SA 4-84, Central Drive, APN: 182-29-048, Request for approval of Site Approval Chairman Kuranoff informed commission both the staff report from Ms. Lytle dated September 1, 1984 and memo from City Attorney dated September 7, 1984 suggest the subject item be continued, until further information is supplied from applicant. Mrs. Steers, 11641 Buena Vista Drive, indicated to commission she has turned in information requested, noting she applied for her Site Approval in February and has not been able to speak to Commission on her application. Mrs. Steers informed commission she has a 15 page document indicating she is the owner of the property and the legality of the lot for commissioners review this evening. Commissioner Siegel informed Mrs. Steers it would not be productive to look at these do urents without the City Attorney opinion, noting the commission is not in a position to make a decision on them this evening. Ms. Lytle indicated there is also a list of technical information that has been requested that has not yet been received from the applicant. MOTION SECONDED AND CARRIED: Moved by Struthers, seconded by Carico and passed unanimously to continue the Lands of Steers, File #SA 4-84 until additional information is supplied and reviewed by staff and City Attorney. Commissioner Lachenbruch abstained from Voting on the subject item. F. OLD BUSINESS: 1) CmTnissioner Lachenbruch indicated he was concerned over the situation which arised during the Lot Line Adjustment for Parnas, regarding the setback from private easemeznts, quoting Municipal Code Section 9-5.504. Mr. Scarborough informed commission, on the next agenda staff is preparing to discuss several zoning concerns and will include this item in with this review. NEW BUSINESS: 1) Commissioner Struthers brought up a concern over signs located at taw h+atadero Creek (i.e. DelCastello and Filler), asking if these signs are approved? Staff informed coandssion the signs were used during construction for the builders information and would be removed as soon as possible. 2) Chairman Kuranoff referred to invitation on Planning Commission Foran asking if any of the commission could attend, October 4, 1984 in Milpitas. Cannissioner Struthers indicated she might be able to attend. 3) Chairman Kuranoff asked staff if there is a way to look at large parcel subdivisions wined by families, who do not intend to sell off the lots after subdivision, but to arrange for their estates, so that the costs world not be so expensive and street improvements be delayed until such a time the properties are developed? Mr. Scarborough suggested this item he discussed when Chairman Kuranoff meets to discuss Code Enforcement. Co rdssioners and staff discussed briefly the possibility of using covenants or waiver of certain improvements. 4) Nes. Joan holler, Central Drive, asked if the process for notification to property owners on private roadways (i.e. Steers) could go to all property owners on the private roadway, noting not all neighbors are notified with the 300' procedure, noting since on a private road citizens are responsible for the roadway they should all be informed. Commissioner iachenbruch suggested a notice be posted at the entrance to the roadway if a private road or cul-de-sac. 5) Report to City Council meeting of September 19: Mr. Scarborough informed commission, that the commission will from now on be responsible to report their actions to the Council on variances and conditional use permits. Mr. Scarborough indicated the itens will no longer be placed on the Consent Calendar, but under Reports from Planning Commission, noting the Council will receive the same packet information the Commission received for their review. 6) Ms. Lytle asked commissioners if they had any reservations if staff were to place variance items on the Planning Commission Agenda, noting it is sometimes difficult to arrange for three commissioners to attend 1/2 hour earlier. Concurrance by commission. It was also discussed briefly to have site development members the same with alternates, this will be discussed at the September 26 meeting. H. DISCUSSION: This recommendation is made in order to streamline the variance permit process and save considerable staff time preparing agendas, Packets and arranging and coordinating early meetings with the Planning Commission.
