Chairman Kuranoff called the meeting to order at 7:00 p.m. in the Town Hall
Council (lumbers.
A. ROLL CALL:
Present: Chairman Kuranoff and Commissioners Carico and Struthers
Absent: None
Staff: City Manager George Scarborough, City Engineer Michael Enright,
Staff Planner Nancy Lytle, Secretary Leslie Mullins
B. PUBLIC HEARINGS:
1. LANDS OF BARBOUR, FILE #VAR 4-84, 28110 Story Hill Lane, Request
for variance to allow pool equipment into setback (continued from
September 12, 1984 meeting)
Ms. Lytle referred to her staff report of September 20, 1984 informing
the caanission this is a continuation of Public Hearing to consider a
variance request to exceed side yard setback as defined in Ordinance #268
Section 9-5.504 (b)(2) with an encroachment of 28' for the purpose of
locating pool equipment within 2' of the westerly property line. Ms.
Lytle indicated to commission the applicant had agreed to provide staff
with plans, descriptions and evidence necessary to consider an ammmendmnt
requested at the Septanber 12 meeting, noting to date the Planning
Department has not received or reviewed any further information, noting
the discussion contained in the September 1, 1984 staff report is applicable.
The Public Hearing was then opened.
Mr.Bernie Brawnier, Brawner Pools, informed camtissi.on the pool equipnent
will be placed on a 5'x9' slab, 15' from rear property line and 28' from
side, noting this location is the frost suitable. Mr. Brawner infored
camission his carpany did not relocate the pool equipment after the final
inspection, noting it was originally 20' from property line.
Mrs. JuJy Bogard, 3003 Country Club, Palo Alto, indicated the pool equipment
was not a part of the original variance request for swimming pool.
Connissioners discussed the alternatives that could be used for placement
of the pool equipment, noting as the applicant slid indicate at the September
12 meeting that he would submit new plans for staff review the next day
which would show all pool decking, trees, and an opinion frau landscape

MOTION SECONDED AND CARRIED: Moved by Carico, seconded by Struthers
and passed by the following roll call vote to deny without prejudice
the variance request for Lands of Barbour, File WAR 4-84, 28110
Story Hill Lane.
ROLL GALL:
AYES: Camdssioners Carico and Struthers
NOES: Chairman Kuranoff
Comissioner Carico noted she could not vote in favor of this variance
request as she could not find evidence to meet 6 criteria for granting
of a variance, specifically 1, 2, and 3, also noting the applicant
did not submit new information for staff review and preparation of
staff report.
Mrs. Judy Bogard asked commission and staff as to the time limits for
removal of the pool equipment, and if an appeal could be made?
Mr. Scarborough indicated he would check with the City Attorney as to
the time limit for relocation. Regarding the appeal, Mr. Scarborough
indicated an appeal could be made within ten days of this decision,
and would be directed to the City Council for review.

1. COnsideratim of motion to incorporate variance and permit public
hearings into full Planning Camission agendas.
MOTION SECONDED AND CARRIED: Moved by Carico, seconded by Kuranoff
and passed by the following roll call vote to recommend that variance
and permit camdssion public hearings be scheduled on the Planning
ommission agenda from now on.

2. Mary Stutz, Chairman Pathway Ommittee, requested that camissioners
and staff be sure to use their microphones as it is very difficult
at times to hear in the audience.
E. ADJOURNMENT:
There being no ftrthernew or old business, the meeting was adjourned
at 7:45 p.m.
