Chairman Kaufman called the meeting to order at 7:30 p.m. in the Town Hall
Council Chambers.

B. CONSENT CALENDAR�
1. MOTION SECONDED AND CARRIED: Moved by Stutz and seconded by Jones
and passed unanimously to approve, with changes, the minutes as
written for Planning Commission Meeting of March 8, 1989.
2. MOTION SECONDED AND CARRIED: Moved by Noel and seconded by Jones
and passed unaminously to place Resolution re. zoning ordinance on
April 12, 1989 agenda.
C. REPORT FROM CITY -- N IL ETIN F MAR H 15, 1989,
D. REPORT FROM SITE DEV LOPMENT COMMITTEE MEETING OF MARC 21, 1989:
The Site Development Committee meeting of March 21, 1989 approved a
barn structure for Tachibana at 12321 Stonebrook Court; approved a
landscape plan for Sanders at 11640 Jessica Lane; approved a landscape
plan for Bettencourt at 12101 Stonebrook Drive; approved an addition
for Kwok at 26837 Purissima Road; and continued a residence and pool
for Becker on Moon Lane.

1. LANDS OF MELE, FILE OCU2 1-89, OVAR 2-89, and Site Development
Permit, 14225 Berry Hill Lane, Request for a Conditional Use
Permit, Variance, and Site Development Permit for a second dwell-

ing, that would cause the maximum floor area for the lot to be ex-
ceeded.
Ms. Zeff referred to her staff report dated March 16, 1989 stating
that the applicants are requesting a variance in maximum floor area
%W for the lot to allow the construction of a detached second dwelling,
which would be 710 square feet. Since only 71 square feet more of
floor area would be allowed to be built on the lot under the Maximum
Floor Area regulation, a variance of 639 square feet would be neces-
sary. The applicants are also requesting a Conditional Use Permit and
a Site Development Permit for the second dwelling, and patios and
walkways. Staff recommends the following: 1) Deny the requested vari-
ance. 2) Deny the requested Conditional Use Permit and Site Develop-
ment Permits.
The Public Hearing was then opened.
Lorin Nelson, Gerard Development, requested approval of the variance
based on lot size and slope.
The Public Hearing was then closed.
MOTION SECONDED AND CARRIED: Moved by Carico and seconded by Patmore
and passed to deny the variance, FILE #CUP 1-89, VAR 2-89, 14225 Berry
Hill Lane.
AYES: Commissioners Kaufman, Carico, Emling, Noel, and Patmore.
NOES: Commissioners Jones and Stutz.
kaw 2. LANDS OF BJORKLUND, FILE #CUP 2-89, VAR 3-89, APN 175-53-035,
26498 Ascension Drive, Request for Variance in setback, Condi-
tional Use Permit, and Site Development Permit for additions to an
existing house including an attached second dwelling.
Ms. Zeff referred to her staff report dated March 14, 1989 stating
that the applicants plan to construct a major addition to their exist-
ing house on Ascension Drive. The additions proposed include a bay
window projection from an existing bathroom, which would intrude on
the 30 -foot setback by 2 feet, a master bedroom suite that would have
a roofline matching the existing roofline, which projects into the 30 -
foot setback by 2'9" and would contain cooking facilities, and other
additions, including a driveway extension and a new 1 -car garage.
Staff recommends the following: 1) Based on the findings presented in
the staff report dated 3/14/89, approve the requested Variance in set-
back. 2) Approve the Conditional Use Permit for a second dwelling.
3) Approve the requested Site Development Permit, subject to the con-
ditions stated on Ms. Zeff's 3/14/89 staff report.
The Public Hearing was then opened.
Gary Biorklund, 26498 Ascension Drive, requested approval of Condi-
tional Use Permit and Variance.

Dot Schreiner, Pathway committee, requested type IIB in road right-of-
way.
The Public Hearing was then closed.
%W MOTION SECONDED AND CARRIED: Moved by Patmore and seconded by Noel
and passed unanimously to approve the Lands of Biorklund, FILE #CUP 2-
89, VAR 3-89, 26498 Ascension Drive, based on required findings as per
Municipal Code Section 10-1.1107(a) and 10-1.1107(b) and as presented
in Staff Report dated March 14, 1989.
MOTION SECONDED AND CARRIED: Moved by Noel and seconded by Carico and
passed unanimously to approve Site Development Permit subject to pro-
posed conditions as outlined on Staff Report dated March 14, 1989,
with added conditions to clean path along Ascension Drive and no
planting within 10 feet of road.
3. LANDS OF KOPAL, FILE #VAR 4-89, APN 336-22-020, 12530 Barley Hill
Road, Request for a Variance and Site Development Permit for a new
pool, decking, and storage building, exceeding allowed Maximum
Floor Area for the lot.
Ms. Zeff referred to her staff report dated March 17, 1989, stating
that the applicant is requesting a Variance in Maximum Floor Area for
the lot, to allow the construction of a storage/garage building. Max-
imum Floor Area would not be exceeded. Staff recommends that the
Planning Commission take either of the following actions: 1) Based on
the findings presented by the applicant, approve the requested vari-
ance in Maximum Floor Area and approve the requested Site Development
�W Permit subject to the conditions attached to the 3/17/89 staff report
OR 2) Deny the requested variance and approve a Site Development
Permit for all proposed Development Areas, but excluding the proposed
storage building OR 3) Direct the applicant to redesign the proposed
storage building not to exceed the 257 square feet remaining allowed
Floor Area.
The Commissioners stated meetings with Mr. Kopal (Patmore, Noel, Jones
and Carico).
Patmore and Noel believe that something should be built to aid in the
noise.
MOTION SECONDED AND CARRIED: Moved by Kaufman and seconded by Noel
and passed to deny, without prejudice, the requested variance.
AYES: Commissioners Kaufman, Emling, Jones, Noel, Patmore, and Stutz
NOES: Commissioner Carico
MOTION SECONDED AND CARRIED: Moved by Noel and seconded by Jones and
passed unanimously to approve the Site Development Permit for all but
the storage shed subject to the conditions of approval as stated in
Staff Report dated March 17, 1989.

MOTION SECONDED AND CARRIED: moved by Noel and seconded by Carico and
passed unanimously to reduce Variance fees for a resubmittal, substan-
tially the same as this, only smaller, of a storage shed, to actual
costs incurred by the town. (A deposit is to be taken to cover
%W costs.)
4. LANDS OF CHEN, APN 175-44-053, 13114 La Crests. Drive, Appeal of an
Administrative Site Development Permit for a fence.
Ms. Zeff referred to her staff report dated March 13, 1989 stating
that on January 20, 1989, the Chens applied for Zoning and Site Devel-
opment Permits for a fence. The application was checked by the Plan-
ning Technician for conformance with the Zoning Ordinance, and a
permit was issued. On March 1, 1989 a letter was received from Dirk
Bartelink, a neighbor of the Chens, appealing the issuance of the
permit for the fence on the grounds that they do not like the ap-
pearance of the fence. Staff recommends that the appeal be denied, as
the fence complies with the Town Ortdinances in every respect, and, in
addition, is practically hidden from the street behind existing bushes
and trees.
The Public Hearing was then opened.
Dirk Bartelink, 13170 La Crests. Drive, appealed the "attributes" of
the fence.
Mr. Chen, 13114 La Crests. Drive, requested that the Planning Commis-
sion uphold staff decision of fence approval.
Philip Eidmann, 12175 Hilltop, spoke regarding city getting involved
in revoking legal permits.
The Public Hearing was then closed.
MOTION SECONDED AND CARRIED: Moved by Emling and seconded by Stutz
and passed unanimously to deny the appeal.
5. LANDS OF REUTER, FILE #PM 14-89, APN 175-21-62,63,53,97, 26640
Snell Court, Request for Reversion to Acreage.
Ms. Zeff referred to her staff report dated March 16, 1989, stating
that the Reversion to Acreage requires a recordation of a Parcel Map.
Need to consider a Parcel Map for purposes of Reversion to Acreage for
3 parcels all adjacent and all owned by James Reuter, located on Snell
Court. Reversion to Acreage of these lots will be only beneficial, in
eliminating old small non -conforming lots. Staff recommends that the
Planning Commission make the following findings: 1) There are no
dedications or offers of dedication to be vacated or abandoned by the
reversion to acreage. 2) The lots are all owned by the same owner re-
questing reversion to acreage.
The Public Hearing opened and closed with no one speaking for or
against this item.

MOTION SECONDED AND CARRIED: Moved by Noel and seconded by Patmore
and passed unanimously to approve Lands of Reuter, FILE #PM 14-89,
26640 Snell Court, for reversion to acreage subject to staff recom-
mendations outlined on Staff Report dated March 16, 1989.
6. LANDS OF CARSE; APN 182-47-008; 27125 Taaffe Road; Request for
permission to build a deck in a Conservation Easement.
The Carse's are in the process of completing a house on their lot. A
Conservation Easement covers the area along the banks of a creek on
the Carse's lot. The Carse's would like to build a deck in the Con-
servation Easement on this lot. The proposed deck appears to have
been expressly designed to extend out over the creek. Staff recom-
mends that permission not be granted to build a deck in the Conserva-
tion Easement on this lot, since there is plenty of room for decks in
areas outside of the Conservation Easement.
The Public Hearing was opened and closed with no one speaking for or
against this item.
MOTION SECONDED AND CARRIED: Moved by Carico and seconded by Emling
and passed to deny request for the Lands of Carse, 27121 Taaffe Road,
to encroach into Conservation Easement with deck.

NOES: Commissioner Stutz

1. Commissioners schedules for Site Development and City Council for
months of April, May and June to be done.
2. General Discussion on Town Survey, Pathways, etc.
3. Commissioner Stutz parking on paths.
4. Commissioner Emling Public works problem at Altamont/Moody Road
intersection.
5. Discussion over what we are doing about landscaping during the
drought.
6. Commissioner Noel thanking Sally Lyn Zeff, Planning Director, and
wishing her well in her endeavors.
H. OLD BUSINESS:
1. Joint meeting between City Council and Planning Commission
scheduled for April 13, 1989 has been cancelled.
