MINUTES OF REGULAR MEETING

Chairman Emling called the meeting to order at 7:30 p.m. in the Town
Hall Council Chambers.
A. ROLL CALL AND PLEDGE OF ALLEGIANCE:
Present: Commissioners Carico, Noel, Patmore, Stutz, Jones and
Chairman Emling
Absent: None
Staff: Bill Ekern, Director of Public Works; Diane Williams,
Planning Secretary
B. CONSENT CALENDAR:
The consent calendar was consisting of minutes of May 17th and was
unamiously approved.
Planning Commission Minutes - April 26, 1989
C. REPORT FROM CITY COUNCIL MEETING OF May 17, 1989:
Commissioner Jones presented relevant information from the City
Council meeting.
D. REPORT FROM SITE DEVELOPMENT COMMITTEE MEETINGS
Commissioner Carico reported on the meeting of May 16, 1989,
Commissioner Patmore reported on the meeting of May 22, 1989. This
meeting was actually a subdivision committee meeting for the Lands
of LOConte, Story Hill Lane. The major issues appear to be
drainage and the abandonment of existing conservation easements.

G. PUBLIC HEARINGS:
Bill Ekern presented the Staff report recommending approval of the
requested Conditional Use Permit and Site Development Permit.
1. LANDS OF MELE, FILE #CUP 1-89, 14225 Berry Hill Lane,
Request for approval of Conditional Use Permit and Site Devel-
opment Permit for Secondary Dwelling Unit.
The Public Hearing was opened
Mr. Ralph Mele, 14225 Berry Hill Lane, stated agreement with
the conditions and thanked Staff for their assistance.
The Public Hearing was then closed.
MOVED AND SECONDED: (Patmore/Noel) and passed unanimously to
approve the requested Conditional Use Permit and Site Develop-
ment Permit as conditioned by Staff.
2. LANDS OF VINCENT, FILE #CUP 6-89, 27240 Natoma Road,
Request for a Conditional Use Permit and Site Development
Permit for a Secondary Dwelling Unit.
Bill Ekern presented the Staff report recommending approval of
the requested Conditional Use Permit and Site Development
Permit.
The Public Hearing was opened.
Mrs. Vincent, 27240 Natoma Road, agreed to proposed condition.
The Public Hearing was then closed.
MOTION MOVED AND SECONDED BY: (Patmore/Noel) and passed unani-
mously to approve the requested Conditional Use Permit and Site
Development Permit for a Secondary Dwelling Unit.
Commissioner Carico noted for the record that she believed that
Use Permits for Secondary Dwellings should be reviewed every
three (3) years by the Planning Commission.
3. LANDS OF BADERTSCHER, FILED #VAR 11-89, 27284 Byrne Park Lane,
Request for a Variance and Site Development Permit for Carport
addition encroachment into building setbacks.

Bill Ekern presented the Staff report recommending denial of
the requested Variance.
The Public Hearing was then opened.
Mrs. Badertscher discussed the rationale for the proposed loca-
tion of the carport and the lack of impact on the surrounding
neighbors.
The Planning Commission discussed options: to move the carport
closer to the pool or next to the garage in front of the house.
At the request of the Commission Mrs. Badertscher agreed to
continue for re -design and to meet with staff.
The Public Hearing was then closed
Commissioner Patmore noted that there were new guidelines on
identifying yourself as a public official on written communica-
tions.
�✓ I. OLD BUSINESS:
Chairman Emling's proposed policy of disclosure of applicant con-
tact was discussed.
MOVED AND SECONDED (Noel/Jones) to send proposed resolution
regarding full disclosure to Council for joint meeting and to
all Committees for comment.
MOTION FAILED WITH THE FOLLOWING VOTE:
AYES: Comiso, Jones, Noel
NOES: Carico,Patmore, Stutz and Chairman Emling
MOVED AND SECONDED (Patmore/Carico) to adopt as Planning Commis-
sion policy the following:

POLICY STATEMENT BY PLANNING COMMISSION
ALL MEMBERS OF THE PLANNING COMMISSION OF THE TOWN OF LOS ALTOS
HILLS SHALL DISCLOSE FULLY WITH THE APPLICANT OR AGENT OF THE AP-
PLICANT FOR THE FOLLOWING FORMS OF CONTACT.
1. ANY PHONE CONSERVATIONS.
2. WRITTEN COMMUNICATIONS.
3. SITE VISITATIONS.
4, MEETINGS OR SOCIAL CONTACTS.
5. ANY AND ALL FINANCIAL TRANSACTIONS INVOLVING
APPLICATION OR OTHER IMPACTED PARCELS.
SUCH DECLARATION SHALL BE CALLED FOR BY THE CHAIRPERSON OF THE PLAN-
NING COMMISSION AT THE BEGINNING OF EACH PUBLIC HEARING OR OTHER
RELEVANT DISCUSSION.
THIS POLICY SHALL BE PROPOSED FOR READOPTION BY THE PLANNING COMMIS-
SION EACH YEAR AT THE ELECTION OF THE NEW CHAIR OF THE COMMISSION.

MOVED AND SECONDED (Patmore/Carico) to send Draft resolution to
Town Council for information and future discussion and joint meet-
ing with Town council.
