PRESENTATIONS FROM THE FLOOR f John Komo, representing the Lands of Thompson, requested the Planning 4/ Commission continue Item 3.4 to the next Planning Commission meeting. The Commission agreed by consensus to continue this item to the Planning Commission meeting of July 10th, 1991. Don Spencer, Mary van Tamelen, Ed Barnes, Shari Emling, Joan Earnest, Nancy Couperis, Carol Gottlieb, Kim Schiffron, Ed Emling applauded Commissioner Carico for all her contributions to the Town, for her dedication and guidance in maintaining the grace and beauty of the area. Commissioner Noel also thanked Commissioner Carico, and informed the audience the City Council would be making a presentation to Commissioner Carico at their meeting of July 3, 1991. Chairman Jones thanked Commissioner Carico for all her work for the Town. Commissioner Carico wished all to know her experience as a representative of the Town has been nothing but joy, and thanked her husband and family for their love and support. Commissioner Carico also thanked Artemas Ginzton, who had helped her become involved with the Town, for her presence at the meeting. N PLANNING COMMISSION MINUTES APPROVED June 26, 1991 Page 2 3. PUBLIC HEARINGS Commissioner Pahl disclosed that he had no opportunity to view the site for the Lands of Curatola on Frampton Court as the plans were not available. 3.1 LANDS OF BECKER, 14290 Saddle Mountain Road: A request for a Site Development permit for a New Residence Margaret Netto introduced this item, noting it had been continued from the Planning Commission meeting of June 12, 1991. She outlined the quantitative information, noting that the development as proposed was close the the maximum allowed on the site, and clarified that the pool was not a part of the current application. Bill Ekern outlined concerns regarding access from Saddle Mountain Drive and Moon Lane. He noted the Staff Recommended Conditions of Approval address the impacts of construction on these streets and Stirrup Way. He referred to the grading work necessary to establish the house on the site and to repair existing landslides, and requested the Commission's consideration of whether the level of development proposed is appropriate for the lot. He noted Staff's recommendation for connection to sanitary sewer. The Public Hearing was opened. Commissioner Pahl noted there were concerns regarding access off both Saddle Mountain Drive and Moon Lane. Bill Ekern responded that Saddle Mountain Drive is a public road while Moon Lane has varying right-of-ways and structural sections as a private road. Henry Mourad, 14300 Saddle Mountain Drive, noted concern with cut and fill, with the length of time involved in the process of grading and restructuring the hillside, and with the slope of the subject property. He presented an overlay on the overhead projector of the proposed development and his adjacent property. He explained that when his property was developed, he was required to pave Moon Lane for fire access only, and install a gate to discourage any access. He suggested using Moon Lane for fire access only and requiring vehicle access for the new residence to be off Saddle Mountain Drive. Dot Schreiner, 14301 Saddle Mountain Drive, expressed concern with access. She noted Saddle Mountain Drive has a sharp bend and accidents have occurred as there is no visibility. Car headlights shine into the Mourad's home. She also noted there are large properties on Moon Lane that will likely be developed in the future. She requested restriction of access to the site from Moon Lane and restriction in size of the residence to considerably smaller than proposed. PLANNING COMMISSION MINUTES APPROVED June 26, 1991 Page 3 Ramona Chown, 13822 Page Mill Road, noted concern regarding maintenance of Moon Lane as a private road. She noted Moon Lane is narrow and steep, especially dangerous for large trucks, and that there are already five residences with access off Moon Lane. Lewis Becker, 12845 La Vida Real, applicant, noted their intention to have access from Saddle Mountain Drive and Stirrup Way as Moon Lane is not suitable for additional traffic. He noted objections to repairing damage to the streets as their is existing damage and any concrete spillage should be the responsibility of the individual drivers. He noted his geotechnical consultant originally did not recommend addressing the existing landslide. However, the Town Geotechnical Consultant required repair of the landslide. He noted 863 cubic yards of cut and 863 yards of fill are proposed, and that grading would take about a week to complete. He noted that while they obtained County Health Department approval for the septic drainfield, there is still uncertainty as to whether it is better to install a septic or sanitary sewer system. He questioned dedication of the conservation easement as with the proposed level of development there will be little additional building on the site, noting such dedication is a voluntary act. He doubted that it would be physically possible to install a turnaround as required by the Los Altos Fire Department and suggested working out an agreement to use pool water in case of emergency. Commissioner Noel asked Mr. Becker whether consideration was given to building a smaller residence. Mr. Becker responded that the lot was two acres and questioned the purpose of the slope density formula if work can't be done within the parameters it allows. He also noted the entire lower portion of the house is proposed to be sunk into the ground. In response to a question from Commissioner Noel, Bill Ekern noted there is access to sewer on Saddle Mountain Drive and on Page Mill Road. Use of Page Mill Road would entail gravity while Saddle Mountain Drive would require pumping. Mr. Becker noted the Saddle Mountain Drive sewer is only about 50 feet from the subject property, while Page Mill Road is about 1/4 of a mile, and if the residence is connected to sewer, they intend to connect to Saddle Mountain Drive. In response to a question from Commissioner Carico, Mr. Becker noted their intention to omit approximately 900 to 1000 square feet of pavement currently proposed in addition to the 280 square feet of development area remaining to allow for construction of a pool. Mr. Mourad noted his concerns regarding Saddle Mountain Drive relate to the creation of a fork in the road. He suggested a logical solution was use of a remote control for an electric gate. Mr. Mourad also noted that connection to sewer at %W Saddle Mountain Drive would allow pumping of liquid only and would necessitate creation of a leachfield. Bill Ekern requested the Commission consider the limits of the work that should take place in development of the site. He noted that as the Town was not a participant in the creation of the subject lot it is appropriate to assert control over its development. Commissioner Comiso asked if it was necessary to go down Moon Lane to connect to sewer. Mr. Ekern responded that it may be possible to obtain an easement coming up the drainage swale, which would be difficult to maintain. He noted that while it may be possible to configure a pump up to Saddle Mountain, pumps constitute a burden on future property owners. He also noted the Commission should consider the appropriateness of grading leachfields in areas of 30% slope. Commissioner Noel questioned whether there was any prospect of upgrading Moon Lane to a public road. Bill Ekern responded that the residents were very protective of the private status of Moon Lane. He clarified there is no desire on the part of the Town to make it a public road at this time. Commissioner Ellinger asked if the lot was buildable under the Town's current guidelines. Mr. Ekern noted that areas with slopes of 30% would be in conservation easements and that there is no access to public or private roads except through an easement arrangement which is not desirable under current Town standards. Commissioner Ellinger felt the applicant should consider scaling the house in keeping with the steepness of the area and suggested submittal of a plan for sewage disposal along with a redesign of the residence. Commissioner Noel agreed with Commissioner Ellinger, also noting the applicant's interest in elimination of the turn around recommended by the Fire Department, and felt not enough information was before the Commission to approve the requested Site Development permit. Commissioner Pahl noted he could not support a requiring the applicant to build 1/4 of a mile to connect to sewer. He also noted difficulty approving the proposed development without having the entire project for consideration. Commissioner Comiso noted the proposed development included a large house but little outdoor living area. She noted interest in seeing the whole project. She noted she would like a preliminary design to come before the Planning Commission for review. Commissioner Carico concurred with this request. Commissioner Carico felt the project as proposed overdeveloped this fragile piece of land. She requested the applicant come back with a definite plan for the development of the site. Chairman Jones noted concern that a vote to deny the Site Development permit is an indication that the slope density formula doesn't work. Commissioner Carico noted that when the formula was being devised, it was agreed that some lots wouldn't be addressed properly. The Town does have tools to be more restrictive than what is allowed by the slope density formula. MOTION SECONDED AND PASSED: Motion by Noel, seconded by Pahl to deny the Site Development permit for a new residence. AYES: Chairman Jones and Commissioners Carico, Comiso, Ellinger, Noel, Pahl NOES: None ABSENT: Commissioner Stutz 3.2 LANDS OF GILBERT, 14122 Amherst Court: A request for a Site Development permit for an Addition/Remodel Margaret Netto introduced this item, noting the conformance of the proposed addition/remodel to the Zoning and Site Development Ordinance. The Public Hearing was opened Bob Flury, project architect, noted his willingness to answer any questions the Commission may have. The Public Hearing was closed. MOTION SECONDED AND PASSED: Motion by Pahl, seconded by Noel to recommend approval of the Site Development permit with Staff Recommended Conditions 1 - 7. AYES: Chairman Jones and Commissioners Carico, Comiso, Ellinger, Noel, Pahl NOES: None ABSENT: Commissioner Stutz 3.3 LANDS OF THEEUWES, 27350 Altamont Road: A request for a Site Development permit for a Major Addition and Swimming Pool Margaret Netto introduced this item, noting the conformance of the proposed development to the Zoning and Site Development Ordinances. The Public Hearing was opened. PLANNING COMMISSION MINUTES APPROVED June 26, 1991 Page 6 4 Ray Rooker, project architect, referred to Staff Recommended Condition #5 to clarify that two older fruit trees in the rear of the property, a four -inch diameter Oak touching the existing roof of the residence, and a Deodara growing under the foundation of the residence are proposed to be removed. He also referred to Staff Recommended Condition #6, noting the site plan from the original construction drawings was drawn by a licensed civil engineer and he would like to provide this to the Town as verification that the proposed development is not approaching the setback line. Commissioner Pahl asked if Staff had any concern with elimination of Condition #6. Bill Ekern noted that it is acceptable if the applicant can verify the existing house was built where it is shown on the plan. Dot Schreiner, 14301 Saddle Mountain Drive, Pathways Chair, requested roughening of the driveway at the pathway crossing. The Public Hearing was closed. Commissioner Carico noted she felt Condition #6 shouldn't be deleted from the Conditions of Approval. 04, Bill Ekern noted that in the past, the location of the house shown on the plans was not necessarily where it was built. Requiring verification is the only way to prevent issuance of a de facto variance. Commissioner Ettinger suggested the Town building inspector determine if the structure is close to the setback. Bill Ekern responded the burden of proof should be on the applicant, not on the Town. Commissioner Carico noted there have been situations in the past where an error of two feet has created a big problem. Mr. Rooker noted their willingness to have a surveyor verify the setback on site or verify that the original site plan is substantially correct. MOTION SECONDED AND PASSED: Motion by Pahl, seconded by Noel to recommend approval of the Site Development permit with Staff Recommended Conditions 1 - 4, and 7, and with the following conditions: 5. Approximately four trees are to be removed from the site, and will be identified to Staff prior to removal, and any trees removed or damaged beyond repair or destroyed shall be replaced with an equal size tree or up to a maximum 24" box tree. Fencing at the dripline of existing trees is required during construction. �Mv No equipment or debris shall be stored beneath the dripline. AYES: Chairman Jones and Commissioners Carico, Comiso, Ellinger, Noel, Pahl NOES: None ABSENT: Commissioner Stutz 3.4 LANDS OF THOMPSON, 13730 Wildflower Lane: A request for a Site Development permit for a New Residence This item was continued to the Planning Commission meeting of July 10th, 1991. 3.5 LANDS OF CURATOLO, 25639 Frampton Court: A request for a Site Development permit for a New Residence and Swimming Pool Margaret Netto introduced this item, noting that no trees are proposed to be removed. She also noted Staff Recommended Condition #7 requires work done within the dripline of any Oak tree to be done under the supervision of a certified arborist. Commissioner Pahl questioned whether there was any policy for plans not submitted for Planning Commission review by the Friday preceding the Planning Commission meeting. Ms. Netto noted the drawings were requested to be submitted by the preceding Friday. Chairman Jones noted that if a plan is late and he found it impossible to go to the site and review the plans, he would recuse himself. If the Commission fell below a quorum because other commissioners had to do the same, then the item would be continued. The Public Hearing was opened Gary Mignano, project architect, noting his willingness to address any issues of concern to the Commission. He noted he received no written information from the Town regarding the scheduled public hearing. The Public Hearing was closed. Commissioner Ellinger noted he had not visited the site, but was not alarmed by any part of the application. He noted he would abstain from voting. AYES: Chairman Jones and Commissioners Carico, Comiso, Noel NOES: None ABSENT: Commissioner Stutz ABSTAIN: Commissioners Ellinger, Pahl 3.6 LANDS OF LAUB, 27210 Fremont Road, 344 -90 -TM: A request for adoption of a Negative Environmental Declaration and approval of a Tentative Map for a four -lot subdivision Bill Ekern introduced this item, noting concerns with the impact of the proposed access on existing heritage Oak trees on the subject property. He also noted constraints on the developability of lot 1 due to its location within the 100 -year flood zone, and on lot 3 due to slopes in excess of 30% and creek bank setbacks as defined by the applicant's geotechnical consultant. MOTION SECONDED AND PASSED: Motion by Pahl, seconded by Noel and passed to divide the item into two categories, to discuss the negative declaration first and subsequently the tentative map. AYES: Chairman Jones and Commissioners Carico, Comiso, Ellinger, Noel, Pahl NOES: None ABSENT: Commissioner Stutz The Public Hearing was opened. Don Laub, 27210 Fremont Road, applicant, explained his interest in sensitive development of the site. He noted he had spoken with the neighboring property owners and asked his team of developers not to approach the subdivision with the concept of maximizing profits. He noted willingness to constrain development in line with the recommendations of Staff. Arnold Crisler, 27161 W. Fremont Road, noted he approved of the plans he had seen of the proposed development. L q1 PLANNING COMMISSION MINUTES APPROVED June 26, 1991 Page 9 Joe Seiger, 27017 Old Trace Lane, noted he felt the subdivision proposed was sensitive. He noted he would like to see the accessway as proposed by the applicant remain as it is the best location for safety reasons, and urged the Commission not to move it closer to Arastradero Road. Jack Simon, 27075 Old Trace Lane, noted he had no objections to the plans for the subdivision. He noted he also supported keeping the access in the location proposed by the applicant. Larry Lihosit, project planner, noted they had prepared numerous studies to address concerns of Staff, the Subdivision Committee, the Department of Fish and Game, the City of Palo Alto, the Santa Clara Valley Water District, and Purissima Hills Water District, and felt approval of a negative declaration was appropriate. He clarified that the total area of the property is 5.6 acres. He presented a series of slides. Referring to the Staff Report, he noted that in regard to lot #1, the FEMA flood map is incorrect, as work was done in the past rechanneling and realigning Barron Creek and the flood zone will be contained within the creek. Regarding lot #3, he explained that only 19% of the lot has a natural slope greater than 30%. Artificial benches were created for a Kiwi grove and there is no base map to accurately reflect what existed. He presented an illustrative cross slope. He noted the applicants willingness to restrict the lot through deed to 4,000 square feet of floor area and acceptance of recommendation for a Conditional Development Permit (CDP) provided it allows at least 4,000 square feet of floor area. The extent of the flood area and finished floor elevation will be shown on the final map. SCVWD studies indicate that the flood level can be maintained within the banks of the creek after improvements. He noted an alternative access study was submitted, analyzing three different locations of access and presented an overhead slide. The optimal traffic solution is to locate the new access as far from Arastradero Road as possible. He noted their efforts to preserve existing trees. Commissioner Noel asked if the City of Palo Alto had any intentions regarding development of Arastradero Road. Mr. Lihosit noted the city had no plans for the intersection. In response to a question from Commissioner Noel, Bill Ekern clarified that a negative declaration was appropriate with provisions for addressing concerns of flooding and access. He noted Staff's belief that an access with less environmental impact, that is still in line with the applicant's traffic analysis, is possible. Judy Laub, applicant, noted concerns with traffic and safety, and felt the further the access road could be from Arastradero Road the safer it would be. 4 Commissioner Ellinger questioned whether a a turning bay was a possibility, so cars would be out of traffic as they turn onto the access road. Mr. Lihosit noted the possibility had not yet been considered. PLANNING COMMISSION MINUTES APPROVED June 26, 1991 Page 10 Jeff Peterson noted the traffic study doesn't look at the roadway alignments and fully show the impact of the connection of the curb returns to Fremont Road and the pathways on the existing vegetation. Mr. Lihosit noted they had a preliminary design of an alternate access and conceptual bridge, not yet reviewed by their arborist or the Town, that allows the existing Oaks to be preserved. In response to a question from Commissioner Noel, Ed Bescaci, project engineer, noted the existing bridge has major obstructions. He noted they had surveyed the channel and imposed a free span bridge. They were able to show SCVWD that there would be no flooding impacts and water will be contained in the channel. At the request of SCVWD, the storm drain is proposed to catch water before it goes over the channel, so all flow enters at one point and doesn't go over the channel bank. Kent Mitchell, Mitchell Herzog, noted tree removal was proposed to be mitigated at a ratio of 3:1. Mike Cleery, project geotechnical consultant, referred to lot 1, noting existing fill will be brought back down and engineered fill placed. He noted sack concrete would be installed from the bottom to the top of the creek to prevent sloughing and erosion. Mr. Ekern noted the appropriateness of concreting the creek banks was an issue the Town should consider as part of the negative declaration. Mr. Lihosit noted use of rip rap was in keeping with what currently exists on the Fremont Road side of the property, as well as being sound geotechnical advice. The Public Hearing was closed. MOTION SECONDED AND WITHDRAWN: Motion by Pahl, seconded by Noel and withdrawn to recommend approval of the mitigated Negative Declaration with realignment of the entrance roadway and/or planting of replacement trees to sufficiently offset the impact of heritage tree loss, and with a plan to develop the entire subdivision without adversely impacting Barron Creek is to be performed by qualified hydrologists, arborists, and geotechnical personnel prior to the subdivision. Commissioner Pahl noted another mitigation measure would be a three lot subdivision. The Commission discussed the potential for development of a three lot versus a four lot subdivision as it related to the negative declaration, including consideration of Barron Creek and flooding, access road design, environmental 4W impact, and safety, and restriction of development on the proposed lots. 4W PLANNING COMMISSION MINUTES APPROVED June 26, 1991 Page 11 MOTION FAILED: Motion by Carico, failed due to lack of a second to recommend approval of the mitigated Negative Declaration with realignment of the entrance roadway and/or planting of replacement trees to sufficiently offset the impact of heritage tree loss, and with a plan to develop the entire subdivision without adversely impacting Barron Creek is to be performed by qualified hydrolgists, arborists, and geotechnical personnel prior to the subdivision, and with the requirement of a three (3) lot subdivision. Larry Lihosit referred to the Staff Recommended Conditions of Approval, requesting the following: Conditions #1 and #4: wording changed to permit private storm drainage systems. Condition #5: inclusion of "or replacement" of four Oak trees... Condition #12: "... appurtenant structures " add "will be avoided where possible. In the event that removal is necessary, those trees will be replaced at a ratio or 3:1. Condition # 14: exclusion of Arastradero Road. Condition #22: replacement of "geotechnical features" with "creek bank setback". Condition #2: he requested deletion. Mr. Laub noted his interest in restricting development on the new lots, noting preference for three new 'nice' houses over two new 'monster' houses. Commissioner Ellinger noted requirement of a CDP could make a lot less marketable than an ordinary one acre parcel. Mr. Mitchell noted a CDP would shift the control the applicant would like to retain to the Planning Commission and Town. He suggested addressing the development PLANNING COMMISSION MINUTES APPROVED June 26,1991 Page 12 restriction in the CC&R's for lots #1 and #3, and making it a condition of the tentative map. Commissioner Pahl noted the CC&R's are a contract between the seller and buyer, which the Town has no jurisdiction over. Mr. Mitchell noted the applicant's understanding of the requirements involved in a CDP, and their willingness to agree to a CDP for lot #3. Dot Schreiner, Pathways Chair, requested the Committee be allowed a specific amount of time in which to work with the City of Palo Alto to gain access through the subject property to the Esther Clark Park in Palo Alto. Mr. Seiger noted his opposition to the proposed path, especially as it ran parallel to an existing path on Old Trace Lane. Mr. Lihosit noted Palo Alto residents indicated objection to the proposed path, consequently it was not offered. Fran Stevenson, 26989 Beaver Lane, noted there is often opposition to the installation of paths, however once a path is put in, it is used by the people in the subdivision. Rosemary Meyerott, Town Historian, noted it was customary to name a new street with the history of the area in mind. She gave a brief background on the area, requesting the street name be Gorgonio. The Public Hearing was closed. Chairman Jones noted that if the improvements changed the extent of the flood zone as the applicant expected, he could support a four lot subdivision. He noted smaller lots allow smaller houses. Commissioner Pahl felt he was not in a position to support a four lot subdivision until the conditional approval is obtained from FEMA. The applicant considered a 90 day extension of the subdivision timeline. MOTION SECONDED AND PASSED: Motion by Pahl, seconded by Noel and passed by consensus to table this item to allow for consideration of the Planning Commission Minutes of June 12th, 1991. PLANNING COMMISSION MINUTES APPROVED June 26, 1991 Page 13 6. APPROVAL OF THE MINUTES OF JUNE 12TH, 1991 Commissioner Pahl made the following amendments: Lands of Mooring, page 5, "Commissioner Pahl noted the Commission did not have the right to violate an ordinance in considering this application. He noted the ordinance..."; Lands of Harrington, page 6, "Commissioner Pahl disclosed he had spoken with Mr. Harrington the previous day and would disclose any information not presented in this hearing." He referred to page 7, Condition # 3. "A final parcel map shall be recorded."; Lands of Oshima, page 12, "Commissioner Pahl noted other cities take the average slope of the area of the house as it is unfair to require measuring a building's height from the lowest portion of the house." Commissioner Carico made the following amendment: Lands of Mooring, page 4, "Commissioner Carico noted that if the applicant had been able to remodel the existing structure there would have been no recourse, but under the circumstances, whereby the applicant had demolished the existing residence, she could see no reason..." MOTION SECONDED AND PASSED: Motion by Noel, seconded by Pahl and passed, with Commissioners Comiso and Ellinger abstaining, to approve the minutes of June 12th, 1991 as amended. MOTION SECONDED AND PASSED: Motion by Pahl, seconded by Noel and passed by consensus to return to Item 3.6, the Lands of Laub. 3.6 LANDS OF LAUB, 27210 Fremont Road, 344 -90 -TM: Continued Larry Lihosit clarified that they will submit a letter to the Town regarding change in the flood zone, as the map itself will be updated by FEMA presently. Dr. Laub agreed to a 90 day extension of the subdivision timeline. REPORT FROM THE CITY COUNCIL MEETING OF TUNE 19TH, 1991 Commissioner Carico reported the City Council denied the Lands of Malek tentative map. Council felt a two lot subdivision would be appropriate for the site. 8. REPORT FROM THE SITE DEVELOPMENT COMMITTEE There were no committee meetings on June 18th and 25th, 1991. 9.
