1. ROLL CALL AND PLEDGE OF ALLEGIANCE
Chairman Noel called the Planning Commission meeting to order at 7:30 p.m. in
the Council Chambers at Town Hall.
Present: Chairman Noel and Commissioners Cheng, Comiso, Ettinger, Jones,
Pahl, Stutz

2. PRESENTATIONS FROM THE FLOOR
Carol Seeds, 13831 La Paloma Road, expressed concern regarding the Lands of Chang,
13800 La Paloma Road request for a tennis court that was approved by the Site
Development Committee on March 10, 1992. She requested the Commission
reconsider this approval as a tennis court will have an enormous impact on the
feeling of openness along La Paloma Road that the residents and Town have been
working to preserve.
In response to a question from Chairman Noel, Linda Niles noted that a drainage
swale on the property limits siting of the court to the front portion of the lot, and
the court could be moved only five to ten feet back. There are existing large
redwoods and the applicant proposes orchard trees to mitigate the court.
3. PUBLIC HEARINGS
Planning Commission Disclosures: Commissioner Jones noted he received
information from Councilmember Johnson regarding the Lands of Flack:
Everybody in the neighborhood is opposed to the cell -site. Commissioners Pahl,
Cheng, Comiso, Ellinger noted they were customers of Cellular One.

3.1 LANDS OF TAKAMOTO, 13680 Robleda Road: A request for a Variance to
the 30 foot side yard setback requirement of the Zoning Code to allow a
temporary (one year) trailer for living purposes during the construction of
a new residence
This item was withdrawn by the applicant.
3.2 LANDS OF BAUGH, 27230 Elena Road: A request for a Site Development
permit for an Addition/Remodel
Linda Niles introduced this item noting the applicant proposes to add 851 square
feet of living area and 60 square feet of additional pavement. Staff recommended
approval with conditions.
The Public Hearing was opened.
Brad Baugh, applicant, noted the roofing material will be tile and colors will match
existing. Referring to Condition #4, he noted one Oak tree 6 - 8 inches in diameter
and one Pine tree approximately 6 inches in diameter are proposed to be removed.
Terry McDaniel, 10417 Lone Oak Lane, Chairman Environmental Design and
Protection Committee, noted the Oak tree is a heritage Oak, about 40 inches in
circumference. It will require a permit for removal.
In response to a question from Commissioner Comiso, Mr. Baugh noted there are a
number of very large Oak trees on the property. He supported the Oak and Heritage
Tree ordinance, but did not feel the tree in question fell within its requirements. He
noted willingness to plant a specimen Oak.
The Public Hearing was closed.
Commissioner Ellinger noted the Oak and Heritage Tree Ordinance is in effect
because the trees are viewed as an asset to the whole community. He suggested a
tree be placed in the Town in a location where it can do the most good and
designated the Baugh tree.
Commissioner Stutz noted that if there are more than one or two heritage Oaks on a
property, the rules shouldn't apply to all the trees. She suggested the applicant
request a variance to be absolved of planting a tree.
Commissioner Comiso noted the ordinance allows tree removal if a permit is
obtained. She noted she had looked at alternate locations for the addition
unsuccessfully.

Ms. McDaniel agreed the property was magnificent, with many wonderful trees.
She noted, however, that generally in the Committee's reviews of properties, they
see trees that are already dead as they haven't been protected during construction, or
find trees are removed before the application comes in for Town review.
Mr. Baugh noted he had no problem with paying to plant a tree in the Town.
MOTION SECONDED AND PASSED: Motion by Pahl, seconded by Comiso and
passed to approve the Site Development permit for an addition/remodel with Staff
Recommended Conditions 1 - 3 and 6 - 8, and the following conditions 4 and 5:
4. Two trees are shown to be removed from the site and said removal is permitted.
Extreme care shall be taken not to damage or destroy any other trees. If any
other trees in excess of six inches in diameter are damaged beyond repair or
destroyed they shall be replaced with an equal size tree up to a maximum 24"
box size tree. Prior to beginning any grading operation, all significant trees are to
be fenced at the dripline. The fencing shall be of a material and structure to
clearly delineate the dripline and approved by staff. This fencing must be
inspected by Town staff prior to commencement of grading. The fence must
remain throughout the course of construction. No storage of equipment,
c vehicles, or debris shalt be allowed within the driplines of these trees.
` The applicant, at his sole cost, shall provide one specimen 24" box size Oak tree
and the location of this tree shall be determined by a joint agreement of the
Environmental Design and Protection Committee, the City Manager, and the
applicant.
5. If a survey of the property has not been submitted with the application, it shall
be completed prior to issuance of a building permit. The location of the
foundation for the northwest addition only is to be certified in writing after the
foundation is poured by a registered Civil Engineer or licensed Land Surveyor as
being in the approved location and elevation established by the permit.

3.3 LANDS OF LASSEN, 14840 Manuella Road: A request for a Site
Development permit for an Addition/ Remodel
Linda Niles introduced this item with a brief quantitative analysis and noted the
design of the residence will be substantially changed with the addition. The
residence will become similar in design to the residence across the driveway, with
`, stucco siding and brick veneer. Generally, views from the neighboring properties

are not directed toward the addition; however, Staff recommended additional
wording to ensure provision of screening at the top of the slope on Manuella Road
and to the South.
The Public Hearing was opened
Mark Lassen, applicant, clarified in response to a question from Commissioner
Ellinger that the roofing material will be fire resistant shakes. He noted he
concurred with the Staff Recommended Conditions of Approval. Mr. Lassen also
noted that he had spoken with his neighbors and all were in accord with the project.
Commissioner Pahl referred to Staff Recommended Condition #6, noting that in
this case, the proposed addition was not close to the setback line.
The Commission agreed by consensus to delete this condition requiring verification
of the foundation location.
The Public Hearing was closed.
MOTION SECONDED AND PASSED: Motion by Ellinger, seconded by Jones and
passed to approve the Site Development permit for an addition/ remodel with Staff
Recommended Conditions 1 - 3 , 5, and 7 - 10, and the following Condition 4:
4. Prior to final inspection and release of occupancy permits a landscape planting
plan must be submitted to and approved by the Site Development Committee.
Drought tolerant and native plantings are recommended. Consideration shall
be given to provision of significant screening at the top of the slope on
Manuella Road and further to the South.

3.4 LANDS OF SEELEY, 27501 Black Mountain Road: A request for a Site
Development permit for an Addition/Remodel and Pool House
The Public Hearing was opened.
Jeanne Seeley, applicant, noted she concurred with the Staff Recommended
Conditions of Approval.
Gerhard Sanders, applicant's architect, 11640 Jessica Lane, in response to a question
from Commissioner Comiso regarding obstruction of the drainage swale, clarified

that branches of a fallen tree were cut and placed in a high spot so as not to impede
drainage. They will be removed at the time work is undertaken on the project.
The Public Hearing was closed.
MOTION SECONDED AND PASSED: Motion by Comiso, seconded by Ellinger, and
passed to approve the Site Development permit for an addition/remodel with Staff
Recommended Conditions I - 8 and the following Conditions 5 and 9.
5. If a survey of the property has not been submitted with the application, it shall
be completed prior to issuance of a building permit. The location of the
foundation is to be certified in writing after the foundation is poured by a
registered Civil Engineer or licensed Land Surveyor as being in the approved
location and elevation established by the permit.
9. Drainage swale shall be kept clear during construction, and shall continue to be
maintained.

Commissioner Stutz referred to Staff Recommended Condition #9, noting that
horses use both side of the road quite often. She suggested the portion requiring
scarification of the driveway be included in the conditions as it is a safety factor and
lowers the liability of the property owner. There are many instances of horses
slipping on driveways.
MOTION SECONDED AND PASSED: Motion by Comiso, seconded by Ellinger, and
passed by consensus to require the following Conditions 10:
10. Driveway surface shall be roughened within 10 feet of the roadway to the
satisfaction of the City Engineer.
Ms. Seeley noted it is not possible to walk along the subject property side of Black
Mountain Road.
Commissioner Stutz noted that there have been a number of lawsuits relating to
this on properties even steeper than the subject property.
3.5 LANDS OF IO, 13831 La Paloma Road: A request for a Site Development
permit for a Second Unit, Addition, and Landscape/Hardscape

Linda Niles introduced this item outlining the quantitative information. Staff
recommended Condition #12, requiring that the recreational vehicle not be allowed
to park on pavement within the setback and that it be required to be located across
the driveway. Ms. Niles noted that required landscaping from a previous Site
Development approval appeared to have died, and staff recommended requirement
of additional plantings and a maintenance agreement to ensure the protection of
this long term mitigation. Staff requested direction from the Commission regarding
paint color. The applicant chose the current paint color of the gates from the
Town's Color Board; while this color appears beige on the color board, it appears
pink in the field, and the house, painted prior to the Io's ownership, appears a
darker shade of pink. It would be a hardship for the Io's to repaint the house.
The Public Hearing was opened.
Carol Seeds noted she lived next door to the subject property. She recalled that
when the site was originally approved for development there was a condition that
no more development was allowed on the site and requested this item be continued
to allow the Town records to be thoroughly researched. She noted landscaping
along the subject property where it abuts her property is minimal, and a RV parked
along this area would be highly visible. She also noted concern with car headlights
shining toward her home and requested landscaping be required to be eight to ten
feet in height and "shrubby"
In response to a question from Commissioner Comiso, Ms. Niles noted that the
majority of grading is for the retaining walls and the redesign of pavement area.
Also, the gazebo is proposed to be set into the hill.
In response to a question from Commissioner Noel regarding historical permits for
the subject property, Ms. Niles noted that in 1986, the conditions of approval for the
Site Development permit required a Special Land Use permit to be obtained from
the Council. This permit was obtained and allowed the construction of structure
over fifteen feet in height. It did not address disallowing further development.
Chairman Noel noted the applicant or representative were not in the audience.
MOTION SECONDED AND FAILED: Motion by Pahl, seconded by Ellinger and
passed to forward this request to the City Council without comment.

Doris Schechter, 12734 Alta Verde Lane, noted that several years ago, the lot line of
�W the subject property and the neighboring property were adjusted to create two L-

shaped lots; originally both lots were long and narrow, running parallel. When the
lot came in for development, there was concern about the height as the owner
wanted a two story mansion. There was agreement that as it was a small and
strangely shaped lot, there would be not further expansion. She also noted concern
with the redwood trees across the back.

3.6 LANDS OF FLACK, 13070 Alta Lane South, 4280-91-ZP-SD-CUP: A request
to establish a Conditional Use Permit for a cellular telephone "Cell Site"
facility operating as a public utility and a Site Development Permit for a
Pool House and Decking
Linda Niles introduced this item noting it had been continued from the last
4 Planning Commission meeting. The applicant's representative brought an actual
�+ antenna for the Commission and audience to view, and submitted safety
information as well as photographs of the site. Ms. Niles noted that issues of health
and safety, drainage, and access must be addressed, and that the City Attorney's
comments were included in the Staff Report.
The Public Hearing was opened.
Mike Mangiantini, Bay Area Cellular One, representing the applicant, noted that
this cell site facility will improve the service levels in Los Altos Hills and along
Interstate 280. He noted they are pleased with this proposal as they wanted to design
something that is environmentally acceptable. No large equipment is necessary and
the site visibility is minimal. In response to a question from Commissioner Jones
regarding the number of cell sites that could be placed in the Town, Mr. Mangiantini
noted that there is a limit due to issues of interference and the number of radio
frequencies available, as well as user demand. For a more precise number of cell
sites that could technically be placed in the Town, he would need to consult his
engineering staff. He could see the need for one more site in Los Altos Hills.
Commissioner Pahl questioned whether there were any restrictions regarding
locating the facility in the vicinity of a GTE site. Mr. Mangiantini responded that it
would be possible to use the Purissima Hills Count Water District water tank site,

but the lack of space is prohibitive. The site is equally attractive, but they have been
unable to work it out with the Water District.
In response to a question from Commissioner Comiso, Mr. Mangiantini noted they
had spoken with Foothill Community College. There were technical and facility
problems. Radio testing was not successful off the gymnasium, and there is
minimal usable space at the college. They also spoke with Sun Country Cable, and
Sun Country didn't know if they had the capacity to support the equipment at their
head end site.
Commissioner Pahl noted the subject property was in the middle of a tight
residential neighborhood with no service roads to access the site. The Sun Country
facility site and the La Cresta water tank site are both bordered on one side by 1-280.
Jim Flack, applicant, noted his reaction when first approached by Cellular One was
to say 'no'. However, he already had plans for the poolhouse and if the cellular site
was going to be placed in the area, he wished to take responsibility for at least the
aesthetic aspect of the facility. If the facility was located at a public utility site, there
might not be the same concern.
In response to a question from Commissioner Noel, Mr. Flack clarified that if the
Commission denied the cell site, he still wishes to proceed with a pool house and
decking.
In response to a question from Commissioner Comiso, Mr. Flack noted that at the
conclusion of the last meeting he had spoken with some of the neighbors.
Mr. Flack also noted his concerns regarding drainage. A line had been installed, but
was dug up when the driveway was surfaced. He has been working himself and
with the contractor to repair the system and work will be proceeding.
In response to a question from Commissioner Jones regarding the health and safety
information, Mr. Flack noted he had found it to be valuable. He understood cell site
facilities had been installed on hospital rooftops, and that power levels are low
enough to not be injurious. He concerns haven't evaporated, but he felt he hadn't
seen anything to substantiate a serious concern.
Mr. Mangiantini noted their engineer was not at the meeting to address technical
questions as they hoped the documentation was informative.
Commissioner Jones noted he had requested the U.S. Bureau of Radiological Health
Standard at the previous meeting, and would like to see it before he can vote
t positively on the application.

kaw Joe Szabo, 13080 Alta Lane South, noted the applicant could sell his house tomorrow
and leave the area. He felt the civil engineering for the project was incomplete. Jeff
Peterson noted that a grading and drainage plan will be required if the project is
approved.
Mr. Szabo expressed concerns that the driveway would not drain correctly and there
was potential for the hillside to be washed out He presented a photograph of the
hillside during the 1983 rainy season. He felt the turn -around should be approved
by the Fire Department. Mr. Szabo expressed concern that the access way was
inadequate and about use by people other than neighbors and their visitors. He
suggested that a title report be reviewed regarding the easement as it is not a public
or private road. He noted property values would be impacted, and that the
neighboring property owners would have to disclose the existence of the facility
when selling their property. He also noted that the proposed pool house is close to
the setbacks, away from the swimming pool, and near his corral.
Mrs. Szabo, 13080 Alta Lane South, noted she had spoken with an M.D. (her ex -
sister -in-law) and obtained telephone numbers for experts in radiological safety but
had not had the opportunity to call. She noted doctors have observed more cancers
in areas where microwaves are used, however the studies are not complete.
4 Commission Ellinger requested Mrs. Szabo bring Staff the telephone numbers.
hv Mr. Flack clarified that he had detailed changes for the pool house that he would
like to pursue if the application for the cell site was denied.
Mrs. Beatts, 13171 Alta Lane South, noted drainage concerns. Commissioner
Comiso noted Staff Recommended Condition 1, requiring submittal of a drainage
plan to the satisfaction of the City Engineer prior to issuance of any building
permits. She clarified that Staff does the technical review of drainage design, not the
Planning Commission.
The Public Hearing was closed.
Commissioner Stutz suggested continuing this item to allow the Flacks to make
changes to the pool house. She also noted she was not satisfied with the
information regarding the driveway. She commended Cellular One for doing a
good job, noting her appreciation that the antenna was exhibited at the meeting.
MOTION SECONDED AND WITHDRAWN: Motion by Stutz, seconded by Jones
and withdrawn to continue this item to the next Planning Commission meeting.
Commissioner Jones noted that any time there is a public utility, there is an element
of danger. However, if people wish to have this service, it is necessary to accept a
`, certain risk that goes with it. It is also necessary to ensure that the facility is as safe as

possible. Commissioner Jones noted the American National Standards Institute
standards don't represent the general public, but reflect what the industry thinks is
reasonable. He gave a brief explanation of the levels of impact in terms of changes
in body heat to the human body that the standard for a microwave oven allow. He
did not that the standard passed in 1986 was five times more stringent than the
standard in 1982.
Commissioner Ellinger noted he did not question the numerical data provided, but
felt consideration of the appropriateness of the facility on a residential property, near
a pool should be carefully considered. He felt the Commission should raise the
issue of using other site.
Commissioner Pahl noted he felt the site was not appropriate as it requires
maintenance. The access to the property is not a public or private road, but an
easement. He felt if the facility was sited at an existing utility, like the Sun Country
Cable Headend site, the Purissima Hills County Water District site, or Foothill
Community College, there would have been fewer health and safety concerns, and
access wouldn't have been an issue. He questioned the appropriateness of the cell
site on a residential property.
Commissioner Comiso noted that it was necessary to consider whether the proposed
cell site is consistent with current uses in the area. She noted that in purchasing her
home, she had the option of choosing whether the house was proximate to power
lines or public utilities, etc. The neighbors of the subject property purchased their
homes without a cell site in the vicinity. She questioned what happens when the
property is sold. She also noted surprised that the applicant and neighbors had not
discussed the project in more detail amongst themselves because there are so many
safety concerns.
Commissioner Jones explained his 'no' vote on the denial. He felt the site was
appropriate in that any other site less than an acre will have the same problems
with neighbors as to safety. He did not think three vehicle trips a month to the site
for maintenance was sufficient for denial.
MOTION SECONDED AND PASSED: Motion by Pahl, seconded by Cheng and
passed to deny the request without prejudice, including a waiver of fees to allow
resubmittal of a request for a Site Development permit for the Pool House and
Decking, as the proposed utilization of the subject property is incompatible with the
remainder of the residential neighborhood, the site is not adequate in size to
support Public Utility traffic accessing the site, and the proposed use may adversely
affect abutting properties.

Commissioner Ellinger suggested Staff contact the owners of public property in the
Town to see if an appropriate site can be found.
Commissioner Stutz noted the Town had a number of sites that were not buildable.
Ms. Niles noted it may be appropriate for the Planning Commission request that the
City Council direct Staff to contact public utilities in the Town regarding suitable
sites for the cell site facility.
MOTION SECONDED AND PASSED: Motion by Comiso, seconded by Ellinger and
passed by consensus to request the City Council direct Staff to contact public utilities
including Foothill Community College, Purissima Hills Water District, and
California Water Service, regarding the feasibility of a cell site on property currently
operated as a public utility.
The Planning Commission took a brief intermission at 10:25 p.m. Commissioner
Stutz left the meeting.
4. NEW BUSINESS
4.1 Discussion by Town Planner of Planning Commission adopted Town Color
Board guide
Linda Niles presented the Town Color Board. She suggested that either some of the
colors have faded or there has been a re -think of the range of acceptable colors since
the Board was adopted in 1987. She noted that the visibility of the site and the
design of the house should be given some consideration in determining colors.
The Commission discussed the color board. Commissioner Pahl suggested
exclusion of colors that will appear white or pink in the field. Commissioner
Comiso noted the board may make people aware that painting there residence
within the range of colors may look better on their property. Commissioner Cheng
noted the samples on the board are very small. Commissioner Ellinger suggested
that any revision to the color board should include the specifications for the paint
color - these can be mixed by any paint company. Commissioner Pahl suggested
applicants submit an 8" x 10" color swatch.
Ms. Niles noted she would bring back a range of options for the Commission to
consider.
4.2 Discussion of Joint Planning Commission and City Council meeting for
April 1, 1992 at 5:30 p.m.

Commissioner Pahl noted that after the last joint meeting was scheduled from 5:30
p.m. to 7:15 p.m., it was generally felt that the meeting was not as productive with
an artificial ending time. Commissioner Cheng noted the Commission had spoken
about having the meeting on the fifth Wednesday of a month, as there are no
regularly scheduled Council or Commission meetings. Commissioner Jones noted
that at their meeting, the Council had said they wanted the meeting April 1st unless
the Commission did not react favorably.
The Commission agreed that they preferred the joint meeting be held on April 29th,
1992.
5. OLD BUSINESS
5.1 Standard Site Development Conditions
The Commission made modifications to Conditions 1, 5, and 6:
1. The site drainage must be designed to meet the goal of reducing the rate of run
off associated with the proposed development. A grading and drainage plan
shall be submitted to the City Engineer for review and approval prior to
issuance of a building permit.

MARCH 4TH, 1992

4 March 4, 1992, Commissioner Jones reported the City Council elected to hold a
public hearing for the Lands of Liu 26751 Almaden Court, request for a Site
Development permit for a New Residence and Swimming Pool. Regarding Lands
of Ben Artzi on Via Feliz, a single story residence was approved, notably it was one
foot shorter than the two story residence that Council denied on the site. Council
introduced an ordinance changing the meeting time for Regular City Council
meetings to 6:00 p.m., with no public hearings held until 7:00 p.m. The City
Council meeting of August 5, 1992 was cancelled, and Council wished to know
whether the Planning Commission would be holding meetings in August of this
year. Council voted 3 - 2 to oppose Senate Bill 797, on the issue of representation
on the Interim Board of a Regional Government, and voted to oppose the increase
from $3.00 per ton to $13.00 per ton in the City of San Jose landfill business tax. The
radius for notification for public hearings was extended from 300 feet to 500 feet,
with posting of the notice on the three Town Boards and one notice on the site.
Commissioner Comiso requested property owners be made aware that the yellow
site cards the Town distributes for projects scheduled for public hearing must be
placed on the site. If the site card is not posted, it may delay the review of the
project.

FEBRUARY 18TH, AND MARCH 10TH 1992
February 18,1992: Linda Niles reported two items were reviewed and approved:
Hsu - Swimming Pool, Hardscape. Conditions included requirements for outdoor
lighting, submittal of grading and drainage plans and a landscape planting plan,
depiction of retaining wall height, location of the trellis out of the setback, a survey
of the lot lines, repair of the pathway. Saviano - Landscaping. Applicant was
required to submit a grading and drainage plan, pathway was required to be repaired.
Commissioner Comiso noted concern with damage to Alta Lane South due to
construction. She requested the applicant be required to repair the road prior to
building permit final.
March 10, 1992: Linda Niles reported three items were reviewed and approved:
Burns - Swimming Pool. This was a re -approval; the site development permit
originally approved expired. Vanderbeek - Swimming Pool, Landscaping. Six 24 -
inch box trees of two different types were required. Two young Oak trees were
required to be retained. Requirements for outdoor lighting. Cheng - Tennis Court,
Ms. Niles referred to Mrs. Seeds concerns regarding preservation of openness along
La Paloma Road, noting another resident expressed the same concerns and the Site
Development Committee considered the project very carefully. They discussed the
applicability of the policy primarily to the construction of residences. There are

existing redwood trees that already break up the views onto the site, fencing for the
court will be black, and plantings for mitigation are required.
CONSENSUS: The Planning Commission agreed by consensus to not review this
request for a Site Development Permit for a tennis court.
APPROVAL OF THE MINUTES OF FEBRUARY 26TH, 1992
Commissioner Pahl wished to amend the minutes to state on page 6, Lands of Liu,
"He noted he did not like three story houses, but the site analysis letter from Staff
specifically says to put the garage under the house."
Commissioner Jones wished to amend the minutes to state on page 8, just after the
motion to continue Lands of Flack, insert period after '...radiological safety
information.' delete the remainder of the paragraph, and insert, "He requested that
the applicant provide a copy of the U.S. Bureau of Radiological Health Standard for
microwave radiation leakage."
MOTION SECONDED AND PASSED: Motion by Pahl, seconded by Jones, and
passed to approve the minutes of February 26th, 1992.
Commissioner Ettinger noted concern with disturbance of riparian habitat at the
base of Matadero Creek and Page Mill Road.
9. ADJOURNMENT
MOTION SECONDED AND PASSED: Motion by Comiso seconded by Ettinger and
passed by consensus to adjourn the meeting at 11:10 p.m.
