ROLL CALL AND PLEDGE OF ALLEGIANCE Chairman Noel called the Planning Commission meeting to order at 7:30 p.m. in the Council Chambers at Town Hall. Present: Chairman Noel and Commissioners Comiso, Pahl, Ellinger, Jones, Stutz Absent: Cheng Staff: Linda Niles, Town Planner; Joyce Reiter, Interim Planning Secretary 2. PRESENTATIONS FROM THE FLOOR ` There were no presentations from the floor. 3. CONSENT CALENDAR Public Hearing Items 3.1 LANDS OF GARRETTSON, 14495 Miranda Road: A request for a Site Development Permit for a minor Addition 3.2 LANDS OF MIGLIOZZI, 25119 Tepa Way: A request for a Site Development Permit for a minor Addition MOTION SECONDED AND PASSED: Motion by Stutz, seconded by Comiso and passed to approve the public hearing items as submitted. AYES: Chairman Noel and Commissioners Comiso, Pahl, Ellinger, Jones, Stutz NOES: None ABSENT: Cheng 4. PUBLIC HEARINGS 4.1 LANDS OF TAN, 26872 Almaden Court: A request for a Conditional Development permit for an Addition Planning Commission Minutes APPROVED April 8, 1992 Page 2 This item has been continued to the meeting of May 6th for verification of maximum height and review of the surveys submitted. Commissioner Pahl expressed concern regarding clarification of measurements of the maximum 35' from highest peak to lowest grade; measurement appears to be over the maximum height allowed. Commissioner Pahl noted that the measurements were 36' - 36' 6" from peak to grade as he measured them on the plans. Dave Perng, Architect noted that the land surveyor's measurements showed that the height would be under 35'. Commissioner Ellinger scaled the heights on the drawings at 36' 3" and 35' 3". Measurements on the document were not consistent with those on the plans. Commissioner Ellinger questioned whether or not the foundation was at natural grade. Mr. Perng noted that the foundation was a raised floor foundation with crawl space. The Public Hearing was opened. Glen Reed, resident at 26295 Taaffe would like to know where property boundaries are. He thought that the former land surveyor did not complete the survey. Commissioner Pahl suggested measurement be done again by a land surveyor and presented to the Commission. The Public Hearing was closed. Commissioner Pahl would like report of height measurements sent back to have correct drawings and verification of the height from natural grade to top of peak done. MOTION SECONDED AND PASSED: Motion by Pahl, seconded by Comiso and passed by consensus to continue this item to the Planning Commission meeting of May 13, 1992. AYES: Chairman Noel and Commissioners Comiso, Pahl, Ellinger, Jones, Stutz NOES: None ABSENT: Cheng 4.2 LANDS OF BYERS, 12997 Cortez Lane: A request for a Site Development f. Permit for an Addition and Remodel of a Deck �r Commissioner Pahl stepped down from hearing this item. Planning Commission Minutes APPROVED April 8, 1992 Page 3 Mr. and Mrs. Byers were present. No testimony. MOTION SECONDED AND PASSED: Motion by Ellinger, seconded by Jones and passed by consensus to approve this item with conditions of staff. AYES: Chairman Noel and Commissioners Comiso, Ellinger, Jones, Stutz NOES: None ABSENT: Cheng ABSTAIN: Pahl 4.3. LANDS OF COLE, 12795 Viscaino Road: A request for a Site Development Permit for a minor Addition and Remodel The Public Hearing was open. Peyton Cole, applicant was present. Commissioner Ellinger expressed concern that the eucalyptus trees may be a fire hazard and could cause pathway damage. He suggested that the applicant consider trimming them or removing them. Commissioner Comiso noted that the MDA and MFA numbers on the Staff Report and the applicant's plan do not match. Linda Niles explained that the numbers are recalculated by staff using a plenimeter and then are corrected in the Staff Report. Using the plenimeter accomplishes a higher degree of accuracy. Commissioner Jones noted that the numbers on the microfilm and the plan should match the Staff Report. Commissioner Comiso noted that prior to microfilm, the plans must be changed to accurate measurements. The Commission agreed to allow Mr. Cole to correct the numbers in redline on the plans. Mr. Cole agreed to Commissioners' requirements and to all recommended conditions of approval. Commissioners Comiso and Jones requested that the front sheet be corrected and attached before the plans are microfilmed and after approval and clarification of MDA and MFA, slope percentage and LUF numbers. The Public Hearing was Closed. MOTION SECONDED AND PASSED: Motion by Comiso, seconded by Stutz and passed to approve this item with the above requirements and attached conditions. OLD BUSINESS No old business. 7. APPROVAL OF MEETING MINUTES FROM PLANNING COMMISSION MEETING OF MARCH 25, 1992 MOTION SECONDED AND PASSED: Motion by Stutz, seconded by Comiso and passed to approve the minutes with the following corrections: page 7, Lands of Yung, following "The Public Hearing was closed.", first sentence should read: "Commissioner Stutz noted that she liked the house design but it was a two story house on a ridge line. Secondly the proposal of painting the new portion a light color while leaving the original house dark brown would be unattractive." 8. REPORT FROM THE CITY COUNCIL MEETING OF APRIL 15, 1992 F.1 Commissioner Pahl suggested an item for discussion at the City Council joint meeting: The method of compensation of the Planning Commissioners. 9.
