RESOLUTION OF THE
CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS
ACCEPTING OFFER OF DEDICATION FOR STREET RIGHT OF WAY
ALONG BURKE ROAD
AT 13621 BURKE ROAD,LANDS OF TWOMBLY
WHEREAS,Jeff A. Twombly has offered to dedicate Right of Way to the Town
on Lands of Twombly adjacent to Burke Road and
WHEREAS, the City Council of the Town has read and considered that
Dedication of Right of Way;
NOW,THEREFORE, the City Council of the Town of Los Altos Hills does
RESOLVE as follows:
Section 1. The City Council of the Town of Los Altos Hills wishes to accept this
Offer of Dedication at this time.
Section 2. The Town of Los Altos Hills shall enter into and the Mayor is hereby

authorized and directed to execute the Dedication of Street Right of Way, a copy of
which is attached hereto.

DEDICATION OF STREET RIGHT OF WAY ALONG BURKE ROAD
This Dedication of Street Right of Way ("Dedication") is granted by Jeff A.
Twombly in favor of the Town of Los Altos Hills, a municipal corporation of the
State of California ("Town"), effective as of the date of execution by the Town.
RECITALS
A. Jeff A. Twombly owns property located at 13621 Burke Road in the
Town of Los Altos Hills, California, being that certain parcel of land described in that
certain Grant Deed filed for, record in the Office of the Recorder of the County of
Santa Clara, State of California, on November 30, 1993, in Book N164 of Official
Records, page 1469, and as described in Exhibit "A".
B. Jeff A. Twombly desires to dedicate a. portion of this property to the
Town for Street Right of Way and Town wishes to accept such a dedication.
NOW, THEREFORE, IT IS AGREED by the parties as follows:
1. Right of Way. Jeff A. Twombly hereby dedicates to the Town the
property as described as Parcel No. 2 in Exhibit "B" and shown as Parcel No. 2 in
Exhibit "C" attached hereto for Street Right of Way purposes, including, but not
limited to, construction and maintenance of vehicular, pedestrian, bicycle and
equestrian facilities.
2. Acceptance. The Town has accepted this Dedication of Street Right of
Way by Resolution No. 74-94 and has authorized the Mayor to execute this
document on its behalf. Y~
3. Binding Effect. The Provisions contained in this Dedication shall
run with the land and shall be binding upon and inure to the benefit of the
respective successors and assigns of the parties to this Dedication.

Dedication on the dates set forth below.

CONSENT AND SUBORDINATION
Bank of Santa Clara , as Beneficiary under the
Deed of Trust made by Jeff A. Twombly dated June 8, 1994 recorded
June 22, 1994 , in Book 491 , at page 1033 , of Official Records
of Santa Clara County, hereby consents to the execution of- and also
subordinates all the right, title, interest and lien which they now have to that of
the Dedications of Street Right of Way along Fremont Road and
alone Burke Road, dated August 28. 1994 as if and as though said
dedications had been made, executed, and recorded prior to execution and
recordation of said Deed of Trust.

That parcel of land situated in the City of the Town of Los Altos Hills,
County of Santa Clara, State of California, as described in the Grant
Deed filed for record in the Office of the Recorder of said County, on
November 30, 1993, in Book N164 of Official Recoprds, page 1469,
and more particularly described as follows:
Beginning at a point in the centerline of Fremont Avenue, said point
being distant thereon North 7° 55' East 28.50 feet from Station F-7 of
said avenue, as surveyed upon the map entitled "Map of the M. & M.
Taaffe Subdivision of Lot 4 of the Taaffe Partition in Rancho La
Purissima Concepcion", as recorded in Book "E" of Maps, page 118,
filed on July 15, 1897, in Book "I" of Maps, pages 72 and 73;
Thence North 7° 55' East along said centerline 100.86 feet to an iron
pipe 3/4 inches in diameter from which a 2" x 3" white stake marked
W. P. A. 2 bears South 30° 52' East 1323.3 feet distant;
Thence South 77° 48' East 238.92 feet to a 3" x 4" stake marked Al;
Thence South 30° 53' West 103.50 feet, more or less, to the point of
intersection with a line drawn South 77° 48' East from the point of
beginning of this description;
Thence North 77° 48' West in a direct line to the point of beginning.
Excepting therefrom all that portion thereof lying within the bounds
of Fremont Avenue.
