HomeMy WebLinkAbout03-93 • • • • RESOLUTION NO: 3-93 RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS ACKNOWLEDGING THE OFFER OF DEDICATION OF RIGHT OF WAY ON LANDS OF MARKOFF WHEREAS, Paul L. Markoff and Sandra F. Markoff ("Markoffs") have offered to dedicate a Right of Way to the Town on Lands of Markoff; and WHEREAS, the City Council of the Town has read and considered that Irrevocable Offer of Dedication of Right of Way; NOW, THEREFORE, the City Council of the Town of Los Altos Hills does RESOLVE as follows: Section 1. The City Council of the Town of Los Altos Hills hereby acknowledges the Offer of Dedication of Right of Way on Lands of Markoff. The Town chooses not to accept this offer at this time, but reserves the right to accept the Offer of Dedication by resolution of the City Council at any time in the future. Section 2 . The City Clerk is hereby authorized to record the "Irrevocable Offer of Dedication" executed by Markoffs, a copy of which is attached hereto as Exhibit A. Markoff and Sandra F. Markoff ( °Markoffs " ) in favor of the Town of Los Altos Hills, a municipal corporation of the State of California ("Town"), effective as of the date of final execution. RECITALS A. Markoffs own property in the Town of Los Altos Hills, known as a portionof the Blanco Rancho described by deed as shown on Exhibit A attached hereto and recorded in the Official Records of Santa Clara County at Book 370 of Deeds,page 50 . B. Markoffs desire to dedicate a portion of this property to the Town for a right of way. c. Town does not wish to accept this Offer of Dedication at this time,but wishes to reserve the right to accept the Offer of Dedication in the future. _ ------.NOW,THEREFORE, Markoffs declare as follows: 1.. Right of Way. Markoffs hereby irrevocably offer to dedicate to the Town the property described on Exhibit B attached hereto ( the "Property" )for right of way purposes, including, but not limited to , pedestrian,bicycle and equestrian purposes. 2. No Implied Acceptance.
