The City Council of the Town of Los Altos Hills does not wish to accept this Offer of Dedication at this time,but wishes to reserve the right to accept the Offer of Dedication in the future. Section 2. The Town of Los Altos Hills shall enter into and the Mayor is hereby authorized and directed to execute the Irrevocable Offer of Dedication of Right of Way, a copy of which is attached hereto. Section 3. The City Clerk is hereby directed to record this Resolution,in the office of the County Recorder. PASSED AND ADOPTED this 14th day of September , 1993. RECITALS A. Ramsays own property in the Town of Los Altos Hills, described as Lot 6 of Tract 49 recorded in the Official Records of Santa Clara County at Book I of Maps, pages 46 and 47 on April 12, 1937. B. Ramsays desire to dedicate a portion of this property to the Town for a right of way. C. Town does not wish to accept this Offer of Dedication at this time, but wishes to reserve the right to accept the Offer of Dedication in the future. _ NOW, THEREFORE, Ramsays declare as follows: 1. Right of Way. Ramsays hereby irrevocably offer to dedicate to the Town the property described on Exhibit A attached hereto (the "Property") and shown on Exhibit B attached hereto for right of way purposes, including, but not limited to, pedestrian, bicycle and equestrian purposes. 2. No Implied Acceptance. Ramsays understand that this Offer of li Dedication can only be accepted by Resolution of the City Council of the Town pursuant to California Streets and Highways Code Section 1806, and that recordation of this Offer to Dedicate shall not and will not constitute acceptance of this Offer to Dedicate. • X07 I PAGE2%7 3. Irrevocability; Binding Effect . This Offer to Dedicate shall be irrevocable, and shall run with the land and be binding upon the heirs, representatives, successors and assigns of Ramsays. The provisions of this Offer to Dedicate shall inure to the benefit of all successors and assigns of the Town.
