MacDonald has offered to dedicate a Right of Way to the Town on Lands of MacDonald and WHEREAS,the City Council of the Town has read and considered that Dedication of Right of Way; NOW,THEREFORE,the City Council of the Town of Los Altos Hills does RESOLVE as follows: Section 1. The City Council of the Town of Los Altos Hills does not wish to accept this Offer of Dedication at this time,but wishes to reserve the right to accept the Offer of Dedication in the future. Section 2. The Town of Los Altos Hills shall enter into and the Mayor is hereby authorized and directed to execute the Irrevocable Offer of Dedication of Right of Way, a copy of which is attached hereto. Section 3. The City Clerk is hereby directed to record this Resolution,in the office of the County Recorder. MacDonald in favor of the Town of Los Altos Hills, a municipal corporation of the State of California ("Town"), effective as of the date of execution by the Town. RECITALS A. Stephen A. MacDonald owns property located at 11800 Francemont Road in the Town of Los Altos Hills, California, being that certain parcel of land as described by deed recorded June 28, 1991, in the Official Records of Santa Clara County at Book L769, page 392. B. Stephen A. MacDonald desires to dedicate a portion of this property to the Town for street right of way and Town wishes to acknowledge but reject such a dedication at this time, but wishes to reserve the right to accept the Offer of Dedication in the future. NOW, THEREFORE, IT IS AGREED by the parties as follows: 1. Right of Way. Stephen A. MacDonald hereby dedicates to the Town a portion of the property as described in Exhibit A and shown in Exhibit B attached hereto for street right of way purposes, including, but not limited to, construction and maintenance of vehicular, pedestrian, bicycle and equestrian facilities. 2. Acceptance. The Town has acknowledged but rejected this Irrevocable Offer of Dedication of Street Right of Way by Resolution No. 65-93 and has authorized the Mayor to execute this document on its behalf. 3. Binding Effect.
