Baranowski and Sondra L. Baranowski ("Baranowskis") have offered to grant an easement for storm drain purposes to the Town; and WHEREAS,the City Council of the Town has read and considered that grant of easement for storm drain purposes; NOW,THEREFORE, the City Council of the Town of Los Altos Hills does RESOLVE as follows: Section 1. The Town of Los Altos Hills hereby accepts the grant of the storm drain easement at 13151 Estralita Place on behalf of the public. Section 2. The Town of Los Altos Hills shall enter into and the Mayor is hereby authorized and directed to execute the Grant of Easement for Storm Drain Purposes, a copy of which is attached hereto. Section 3. The City Clerk is hereby directed to record this Resolution,in the office of the County Recorder. Baranowski and Sondra L. Baranowski ("Baranowskis") in favor of the Town of Los Altos Hills, a municipal corporation of the State of California ("Town"), effective as of the date of execution by the Town. RECITALS A. Baranowskis ownp p Y ro ert located at 13151 Estralita Place in the Town of Los Altos Hills, California, more particularly described as Lot 13, Block "Q", as said Lot and Block are shown on that certain map entitled "Tract No. 2842, Fremont Hills Unit No. 6", filed for record in the Office of the Recorder of the County of Santa Clara, on August 10, 1961, in Book 136 of Maps, pages 22 and 23. B. Baranowskis desire to grant an easement in this property to the Town for storm drain purposes, and Town wishes to accept the easement. NOW, THEREFORE, IT IS AGREED by the parties as follows: 1. Storm Drain. Baranowskis, hereby grant to the Town an easement as described in Exhibit "A" attached hereto and shown in Exhibit "B" for storm drain purposes, including the right to construct, install, maintain and repair storm drain facilities within the easement. 2. Acceptance. The Town has accepted this Easement by Resolution No. 66-93 and has authorized the Mayor to execute this document on its behalf. 3. Binding Effect. The Provisions contained in this Easement shall run with the land and shall be binding upon and inure to the benefit of the respective successors and assigns of the parties to this Easement.
