Present: Chairman Vitu, Commissioners Clow, Cottrell, Kerns & Wong Staff: Carl Cahill, Planning Director; Debbie Pedro, Assistant Planner; Angelica Herrera, Assistant Planner; Lam Smith, Planning Secretary 2. PRESENTATIONS FROM THE FLOOR -none �. 3. PUBLIC HEARINGS 3.1 LANDS OF KORMAN, 26157 Altadena Drive (203 -02 -LLA); A request for a Site Development Permit for a lot line adjustment. Staff recommended that this item be continued to the December 12, 2002 meeting as the application for the proposed lot line adjustment does not meet the State's Subdivision Map Act definition of a lot line adjustment (Section 66412(d), per the City Attorney's review. Staff will work with the applicant to propose a lot merger and a lot line adjustment. PASSED BY CONSENSUS: To continue the Lands of Korman, 26157 Altadena Drive, to December 12, 2002. 3.2 LANDS OF WILLIAMSON, 12012 Adobe Creek Lodge Road (193-02-ZP- SD); A request for a Site Development Permit for a landscape screening plan. Commissioner Kerns stepped down from the hearing due to the proximity of his residence to the project site. Staff (Angelica Herrera) introduced this item stating a condition of approval for the new residence required the landscape screening, lighting and erosion control plan be reviewed %W by the Planning Commission. She further referred to the Environmental Design Committee recommendations, and the driveway retaining walls (not utilizing natural Planning Commission Minutes Approved 12/12/02 November 14, 2002 Page 2 materials). Condition #3 recommends the visual effect of the retaining walls be mitigated with a combination of materials, color, and extensive planting prior to final inspection of the main residence. OPENED PUBLIC HEARING Mont Williamson, 12012 Adobe Creek Lodge Road, applicant, referred to the color of the stucco and the natural rock to be used. The stucco finish is to be a smooth trowel with an old and aging appearance. He provided a letter regarding trees that were removed as documented by his arborist including the quantity of the trees planted around the property with a balance planted around the house. CLOSED PUBLIC HEARING The Planning Director noted that staff has not reviewed the stain color on the retaining walls. He suggested a continuance to allow the Commission and staff to review the color and texture of the retaining walls. MOTION SECONDED AND PASSED: Motion by Commissioner Cottrell and seconded by Commissioner Clow to continue the request for a Site Development Permit for a landscape screening plan, Lands of Williamson, 12012 Adobe Creek Lodge Road, until E December 12, 2002, to allow time for staff and the Commission to review the stain/color of fir' the retaining walls. AYES: Chairman Vitu, Commissioners Wong, Clow & Cottrell NOES: None ABSTAIN: Commissioner Kerns (stepped down) 3.3 LANDS OF VASUDEVAN, 13428 Carillo Lane (148-02-ZP-SD); An appeal of the Site Development Permit for a landscape screening plan from the September 24, 2002 Site Development Hearing (appealed by Councilmember Bob Fenwick on behalf of neighbor Mr. Cuff). Staff (Angelica Herrera) introduced this item noting the receipt of a letter from Mr. and Mrs. Cuff indicating they have reached a (private) agreement with the applicants regarding the landscape plan, requesting the appeal be cancelled. OPENED PUBLIC HEARING Mrs. Vasudevan, 13428 Carillo Lane, verified that she and her neighbors, Mr. and Mrs. Cuff, have reached an agreement regarding the landscape screening plan. Mrs. Seto, 13410 La Cresta Drive, voiced concern regarding any irrigation system and/or ` grading of the Vasudevans which might be encroaching onto her property. Planning Commission Minutes Approved 12/12/02 November 14, 2002 Page 3 4 Ching -Lu Lin, 13445 Mandoli Drive, discussed plantings noting they were still in the process of verifying the property line. Mrs. Vasudivan stated that the property line dispute is not an issued of this application CLOSED PUBLIC HEARING Brief discussion ensued MOTION SECONDED AND PASSED: Motion by Commissioner Clow and seconded by Commissioner Kerns to approve the Site Development Permit for a landscape screening plan, Lands of Vasudevan, 13428 Carillo Lane, as conditioned, adding the following: (1) The applicant shall remove any irrigation system and grading from the property of the neighbors, Mr. and Mrs. Seto. (2) The applicant shall work with the neighbors, Mr. and Mrs. Cuff, to adjust the positions of trees and shrubs along the western property line according to the private landscape plan agreement between the Cuffs and Vasudevans. AYES: Chairman Vita, Commissioners Cottrell, Wong, Clow & Kerns NOES: None This approval is subject to a 23 day appeal period. 4. OLD BUSINESS 4.1 Report from subcommittees -none 5. NEW BUSINESS 5.1 Discussion -Basement Ordinance -revised wording This item was introduced by staff (Debbie Pedro) stating on June 7, 2001, the City Council reviewed and approved a new basement ordinance. Since the ordinance became effective on July 21, 2001, the planning staff has repeatedly encountered misinterpretations of the basement definition when reviewing projects. The purpose of the amendment is to provide clarification of the basement definition and specify development standards with regard to proposed basements. She reviewed the current definition and the proposed definition with the aid of overhead illustrations. OPENED PUBLIC HEARING CLOSED PUBLIC HEARING PASSED BY CONSENSUS: To direct staff to prepare amendments to the basement ordinance as noted in the staff report. REPORT FROM THE CITY COUNCIL MEETING 6.1 Planning Commission Representative for November 7`s, Commissioner Wong, reported on the following items: amendment to the Pathway Element of the General Plan; Lands of Huang; and Lands of Evershine. 6.2 Planning Commission Representative for November 21" -Commissioner Vito 6.3 Planning Commission representative for December 5'" -Commissioner Clow APPROVAL OF MINUTES 7.1 Approval of October 24, 2002 minutes MOTION SECONDED AND PASSED UNANIMOUSLY: To approved the October 24, 2002 minutes. 8. REPORT FOR FAST TRACK SITE DEVELOPMENT MEETING OF NOVEMBER 5 & 12.2002 8.1 LANDS OF SHANTZ & SIMON, 13561 Hill Way (161-02-ZP-SD); A request for a Site Development Permit for a secondary dwelling unit. Approved with conditions. 8.2 LANDS OF OLCOTT, 12950 Brendel Drive (195-02-ZP-SD-GD); A request for a Site Development Permit for a secondary dwelling unit and garage. Approved with conditions. 8.3 LANDS OF LUND, 13826 Templeton Place (181-02-ZP-SD-GD); A request for a Site Development Permit for a new residence. Approved with conditions. 9. REPORT FOR SITE DEVELOPMENT MEETING OCTOBER 29 & NOVEMBER 5, 2002 9.1 LANDS OF SRINIVASAN, 27835 Lupine Road (49-02-ZP-SD); A request for a Site Development Permit for a landscape screening plan. Approved with conditions. 9.2 LANDS OF MEYERS, 26763 Palo Hilts Drive (150-02-ZP-SD); A request for a Site Development Permit for a an addition. Approved with conditions. ADJOURNMENT Prior to adjournment, a memorandum to the Commissioners from staff (Angelica Herrera) regarding a fence permit for the Lands of Poor Claves at 28210 Natoma Road was reviewed.
