HomeMy WebLinkAbout01-91 •s Aih III 110 RESOLUTION NO. 1 A RESOLUTION OF THE TOWN OF LOS ALTOS HILLS EXTENDING THE ESTABLISHMENT OF UNDERGROUND UTILITY DISTRICT NO. 2 WHEREAS, by Resolution No. 71-89, the City Council of the Town of Los Altos Hills declared and designated Underground Utility District No. 2 of the Town of Los Altos Hills and thereby ordered the removal of all poles, overhead wires and associated structures and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service within the district; and WHEREAS, the City Council now wishes to extend the date for the removal of overhead structures and installation of underground service; NOW, THEREFORE, the City Council of the Town of Los Altos Hills does RESOLVE as follows: Section 1. Public interest and convenience require the extension of the date for removing overhead structures and undergrounding service within Underground Utility District No. 2 to on or before May 31, 1991. Section 2 . The City Clerk is hereby instructed to notify all affected utilities and all persons owning real property within Underground Utility District No. 2 of the extension of the date set forth in Resolution No. 71-89 within ten (10) days after the date of such adoption. Such notification shall be made by mailing a copy of this Resolution together with Resolution No. 71-89, to the affected property owners shown on the last equalized assessment roll and to the affected utilities. RESOLUTION NO. 71-89 A RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS ESTABLISHING UNDERGROUND UTILITY DISTRICT NO. 2 IN THE TOWN OF LOS ALTOS HILLS RESOLVED, by the City Council of the Town of Los Altos Hills, County of Santa Clara, State of California, that WHEREAS, by Resolution No.: 62-89 a Public Hearing was called for Wednesday, June 7, 1989, a the hour of 7:15 p.m., in the Council Chambers in the.Town Hall, 26379 Fremont Road, Los AltosHills, California, to ascertain whether the public necessity, health, safety, or welfare requires the removal of poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric communication, or similar or associated services within that certain area of the Town described as follows: All of the City street right-of-way, respectively, of El Monte Avenue within the Town of Los Altos Hills extending from the intersection of Summerhill Avenue to a point 900 feet, more or less, west of the intersection of O'Keefe Avenue, together with the. following described real property in the Town of Los Altos Hills, County of Santa Clara, State of California, to wit: Lots 1, 2, and 3 of Tract 2932, also known as 12784, 12790, and 12792 Normandy Lane as shown and delineated on the Map entitled "Diagram of Underground Utility District No. 2" approved by the Town. of Los Altos Hills; and 1 • • • • WHEREAS, Notice of such Hearing has been given to all affected property owners as shown on the last equalized assessment roll and utilities concerned in the manner and for the time required by law; and, WHEREAS, such Hearing has been duly and regularly held, and all persons interested have been given an opportunity to be heard, NOW, THEREFORE, BE IT RESOLVED by the City Council of the Town of Los Altos Hills that, pursuant to Chapter 4 of Title 7 of the Los Altos Hills Municipal Code, the above-described area is hereby declared an Underground Utility District, and is designated as Underground Utility District No. 2 of the Town of Los Altos Hills. Attached hereto, marked "Exhibit A", and hereby incorporated as a part of this Resolution, is a map delineating the boundaries of said District: IT IS FURTHER RESOLVED that the Council does hereby fix August 31 19 89 , as the date on which affected property owners must be ready to received underground service, and does hereby order the removal of all poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication; or similar or associated service within Underground Utility District No. 2, on or before January 31 19 90 . IT IS FURTHER RESOLVED that the City Clerk is hereby instructed to notify all affected utilities and all persons owning real property within Underground Utility District No. 2 of the adoption of this Resolution within ten (10) days after the date of such adoption. Said City Clerk shall further notify said property owners of the necessity that, if they or any person occupying such property desire to continue to receive electric, communication or other similar or associated service, they or such occupant 2 • • •• • shall, by the date fixed this Resolution, provide all necessary facility changes on their premises so as to receive such service from the lines of the supplying utility or utilities at a new location, subject to applicable rules, regulations and tariffs of the respective utility or utilities on file with the Public Utilities Commission of the State of California. Such notification shall be made by mailing a copy of this Resolution, together with a copy of said ChaptergUtility 4 entitled "Underground Districts" of Title 7 of the Los Altos Hills Municipal Code to affected property owners as such are shown on the last equalized assessment roll and to the affected utilities; IT IS FURTHER RESOLVED that the Council hereby finds that the Underground Utility District herein created is in the general public interest for the following reasons: 1. The undergrounding to be accomplished will avoid or eliminate an unusually heavy concentration of overhead distribution facilities; and, 2. The streets, roads, or rights-of way in the District are extensively used by the general public and carry a heavy volume of pedestrian or. vehicular traffic. IT IS FURTHER RESOLVED and DETERMINED that the following exceptions in said Underground Utility District No. 2 be and they are hereby authorized: (a) Any municipal facilities or equipment installed under the supervision and to the satisfaction of the City Engineer. (b) Poles or electroliers used exclusively for street lighting. (c) Overhead wires (exclusive of supporting structures) crossing any • portion of the above-described District within which overhead wires have been prohibited, or connecting to buildings on the perimeter of said District iwhen such wires originate in an area • 0 from which poles, overhead wires, and associated overhead structures are not prohibited. (d) Poles, overhead wires, and associated overhead structures used for the transmission of electric energy at nominal voltages in excess of 34,500 volts. (e) Overhead wires attached to the exterior surface of a building by means of a bracket or other fixture and extending from one location on the building to another location on the same building or to an adjacent building without crossing any public street. (f) Antennae, associated equipment, and supporting structures used by a utility for furnishing communication services. (g) Equipment appurtenant to underground facilities, such as surface mounted transformers, pedestal mounted terminal boxes and meter cabinets, and concealed ducts. (h) Temporary poles, overhead wires, and associated overhead structures used or to be used in conjunction with construction projects. REGULARLY passed and adopted this 7th day of June, 1989.
