HomeMy WebLinkAbout29-91 • 110 RESOLUTION NO. 29-91 RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS SETTING TIME LIMITS AND ALLOWING EXTENSIONS THERETO FOR ENVIRONMENTAL IMPACT REPORTS AND NEGATIVE DECLARATIONS WHEREAS, by Public Resources Code Section 21151. 5 the Town is required to set time limits (including reasonable extensions) , for the completion and certification of environmental impact reports and negative declarations; and WHEREAS, the Town wishes to establish such time limits and reasonable extensions; NOW, THEREFORE, the City Council of the Town of Los Altos Hills does RESOLVE as follows: Section 1. EIR Time Limits. An environmental impact report ("EIR") prepared for a project pursuant to the California Environmental Quality Act must be completed and certified within one (1) year from the date that the application requesting approval of the project is accepted as complete by the Town. Section 2 . Extension to EIR Time Limits. If the City Council determines that compelling circumstances justify additional time, the City Council may extend the one (1) year time limit set forth in Section 1 by one or more extensions, if the project applicant consents to such extensions of time. In no case shall the extensions of time exceed one hundred eighty (180) days after the one (1) year time limit set forth in Section 1. Section 3 . Approval or Disapproval of Projects. Notwithstanding Government Code Section 65950, when an extension of time for certification of an EIR has been given as provided for in Section 2 , the project that is the subject of the EIR must be approved or disapproved within ninety (90) days after certification of the EIR. Section 4 . Negative Declaration Time Limits. A negative declaration prepared for a project pursuant to the California Environmental Quality Act must be completed within one hundred five (105) days from the date that the application requesting approval of the project is accepted as complete by the Town. Section 5. Extensions of Negative Declaration Time Limits. If the City Council determines that compelling circumstances justify additional time, the City Council may extend the 105 day time limit set forth in Section 4 by one or more extensions, if • • • S. the project applicant consents to such extensions of time. In no case shall the extensions of time exceed six (6) months from the date that the application requesting approval of the project is accepted as complete by the Town. Section 6. Definition of Project. For the purpose of this Resolution, "project" is defined as in the California Environmental Quality Act at Public Resources Code Section 21065.
