O • RESOLUTION NO. 12-90 A RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS ORDERING THE REORGANIZATION OF CERTAIN CONTIGUOUS INHABITED TERRITORY DESIGNATED AS THE LANDS OF FINN ANNEXATION SUBJECT TO LIABILITY FOR GENERAL INDEBTEDNESS OF THE TOWN, AND DETERMINING THAT ONE WRITTEN PROTEST WAS FILED AND NOT WITHDRAWN IN CONNECTION WITH THE PROPOSED ANNEXATION RESOLVED, by the City Council of the Town of Los Altos Hills, County of Santa Clara, State of California, that WHEREAS, there has been received by the Town of Los Altos Hills, (herein called the "TOWN") "RESOLUTION NO. 89-22 OF THE LOCAL AGENCY FORMATION COMMISSION OF THE COUNTY OF SANTA CLARA MAKING DETERMINATIONS AND APPROVING THE ANNEXATION OF TERRITORY DESIGNATED AS LANDS OF FINN" in which the TOWN was designated as the Conducting Authority for this Annexation; and WHEREAS, the City Council by Adoption of Resolution No. 3-90 set February 7, 1990, as the date on which it would conduct a Public Hearing on the Proposed Annexation of the territory described in LAFCO Resolution No. 89-22; and WHEREAS, the Public Hearing has been conducted and held, NOW, THEREFORE BE IT FURTHER RESOLVED AND ORDERED as follows: 1. The City Council hereby finds as follows: (a) The territory proposed to be reorganized is inhabited. (b) The unincorporated territory proposed for reorganization is within the TOWN's Urban Service Area, as adopted by the Santa Clara County Local Agency Formation Commission, and is contiguous to existing TOWN limits. 1 (c) The reasons for the proposed reorganization are summarized as follows: The TOWN desires. to regulate growth within the territory proposed to be annexed under the provisions of the TOWN's General Plan given its geographic location. The territory proposed to be annexed presently consists of a peninsula of unincorporated territory surrounded on three sides by the TOWN. Several of the properties included within the proposed annexation are capable of further development and which could result in a greater density being permitted under existing Santa Clara County Ordinances than would be allowed under TOWN Ordinances. (d) The terms and conditions of the reorganization, as contained in the Local Agency Formation Commission's Resolution initiating proceedings, are: None. (e) The proposed reorganization is consistent with the TOWN's adopted General Plan. NOW, THEREFORE, BE IT FURTHER RESOLVED AND ORDERED BY THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS as follows: 1. The City Council hereby orders the territory designated as the LANDS OF FINN reorganized and organized to include the following changes or organization: Annexation of the real property described in Exhibit "A" to the Town of Los Altos Hills. 2. One written protest was filed by a registered voter within the inhabited territory commonly known as LANDS OF FINN. 2 O 0 3. The land and improvements within the inhabited territory shall be liable for the general indebtedness of the TOWN existing at the time of Annexation. 4. The City Council describes the exterior boundaries of the territory reorganized as all that real property in the County of Santa Clara, State of California, and generally bounded by Prospect Avenue and La Loma Drive and more particularly described in Exhibit "A" attached hereto and incorporated herein by this reference. A map showing the location of such territory is attached hereto as Exhibit "B" and incorporated herein by this reference. PASSED AND ADOPTED at a regular meeting of the City Council of the TOWN OF LOS ALTOS HILLS held on this 7th day of February, 1990. Finn as described in that certain Grant Deed recorded January 13, 1989 in Book K818 at Page 1411 in the Official Records of Santa Clara County, State of California, said point also being in the centerline of Prospect Avenue; Thence Northeasterly 33.66 feet more or less and Northerly 310 feet more or less along aforesaid corporate limits line and said centerline, also being the general Westerly line and its Northerly prolongation of said Lands of Finn, to an angle point in said corporate limits line and the Southeast corner of the - Lands of Trowbridge as said lands are described in the Individual Grant Deed filed for record July 14, 1987 in Book K223 at Page 149 of Official Records of Santa Clara County, State of California. Thence Westerly along the common line of said Lands of Trowbridge and said corporate limits line 434.65 feet more or less to a point in the Southerly line of San Antonio Avenue; Thence along said common line leaving said Southerly line of San Antonio Northerly 22.72 feet to a point on the centerline of said avenue; Thence continuing along last said common line and centerline Northeasterly 21 .71 feet and Northwesterly 75 feet more or less; Thence leaving said centerline and continuing along said common line, Easterly 435.83 feet more or less to a point in the centerline of Edgecliff Place; Thence Northerly along said corporate limits line and said centerline leaving the line of said Lands of Trowbridge, 80 feet more or less to the.Southerly line of the corporate limits of the Town of Los Altos Hills as described in Resolution No. 874 as adopted by the City Council of the town of Los Altos Hills and designated "Edgecliff 74- 1 Annexation"; • EXHIBIT "A" s O Page 2 Thence along last said line, Southeasterly 99.09 feet, Easterly 59.60 feet, Northeasterly 54.63 feet and Northeasterly 123.22 feet to an angle point in aforesaid original corporate limits of Los Altos Hills and lying on the Westerly line of the Lands of Smith as described in that certain Grant Deed filed for record December 3, 1976 in Book C452 at Page 228 of the Official Records of Santa Clara County; • Thence along the line common to the Lands of Smith and said original corporate limits of the Town of Los Altos Hills, Northerly 142.45 feet more or less to an angle point in said corporate line and lying on the Southerly line of the Lands of Hockett as said Southerly line is described in the Grant Deed filed for record February 12, 1986 in Book J601 , Page 1693 in the Official Records of the County of Santa Clara; Thence along the line common to the Lands of Hockett and the corporate limits of the Town of Los Altos Hills, Westerly 205.38 feet more or less to a point in the centerline of a 40 foot right-of-way (Edgecliff Lane) ; Thence continuing along said common line and centerline, Northerly 90 feet; Thence leaving said centerline and continuing along said common line, Easterly 20 feet to a point in the Easterly line of said right-of- way; Thence Southerly along said Easterly line and last said common line 10 feet; Thence leaving said Easterly line of said right-of-way and continuing along said line common to the Lands of Hockett and the corporate limits of the Town of Los Altos Hills, the following courses, Easterly 10 feet, Northerly 70 feet, Northeasterly 42 feet, Easterly 227.93, Northeasterly 226.42 feet, and Southeasterly 62 feet more or less to an angle point in said corporate limits line and being the Northeasterly corner of the Lands of Dailey as described in the Grant Deed filed for record July 5, 1985 in Book J392 at Page 117 in the Official Records of Santa Clara County; Thence along the general Easterly line of said Lands of Dailey, being common to the original corporate limits of the Town of Los Altos Hills, the following courses; Southwesterly 151 .80 feet, Southeasterly 58.05 feet and 395.46 feet more or less to a point lying in the centerline of Prospect Avenue; Thence Easterly along aforesaid corporate limits line and said centerline 112.14 feet more orlessto a point lying at the Southwest 114 Page 3 corner of Parcel One as said parcel is described in - that certain Grant Deed to George F.
