HomeMy WebLinkAbout64-90 RESOLUTION NO. 64-90 RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS ACCEPTING GRANT OF TRAIL EASEMENT WHEREAS, the Town of Los Altos Hills agreed to the relocation of an existing trail easement on the property described as follows: Lot 1, Tract No. 6297 Saddle Mountain Estates in the map filed July 10, 1978 in Book 422 of Maps at Pages 17 to 22, inclusive, Santa Clara County Records. WHEREAS, the Town of Los Altos Hills vacated the existing trail easement pursuant to Summary Resolution No. 65-90 , dated December 5 , 1990. WHEREAS, the Town of Los Altos Hills now desires to accept the relocated trail easement as shown on Exhibit A to the Grant of Easement to be executed by and between the Town of Los Altos Hills and Amin M. Hanafy and Sohier. A. Hanafy, owners of the above-described property. NOW, THEREFORE, the City Council of the Town of Los Altos Hills does RESOLVE as follows: Section 1. The City Council of the Town of Los Altos Hills• hereby accepts the above-described trail easement on behalf of the public and delineated on Exhibit A to the Grant of Easement. Section 2. The City Council hereby authorizes and directs the Mayor to execute the Grant of Easement on behalf of the Town. Passed and adopted this 5th day of December , 1990. . Hanafy and Sohier A. Hanafy (collectively, "GRANTORS" ) in favor of the Town of Los Altos Hills, a municipal corporation of the State of California ( "TOWN" ) , effective as of the latest date of execution by any party hereto. RECITALS A. GRANTORS own the real property in the Town of Los Altos Hills, California, which is shown as "Lot 1" on Exhibit A attached hereto and is know as "Lot 1, Tract No. 6297 Saddle Mountain Estates" on the map filed on July 10, 1978, in Book 422 of Maps at pages 17 to 22, inclusive, Santa Clara County Records ( "LOT" ) . B. The TOWN has an existing trail easement on this LOT as shown on Exhibit A hereto and designated therein as "Existing Trail Easement to be Vacated" ( "Existing Easement" ) , and TOWN and GRANTORS now want to relocate the Existing Easement as hereafter provided. NOW, THEREFORE, IT IS AGREED by the parties as follows: 1. Grant of Easement. GRANTORS hereby grant to TOWN for public use a trail easement as shown on Exhibit A (designated therein as "Proposed 10 ' Trail Easement to be Dedicated" ) and as more particularly described in Exhibit B, both attached hereto ( "EASEMENT" ) . 2 . Character. The EASEMENT shall be a non-exclusive easement in gross over and across the LOT for the benefit of the public . 20265710 111590 1. L572P, GE3 • 3 . Location. The EASEMENT shall have a uniform width of ten ( 10) feet as shown on Exhibit A and as described in Exhibit B, both attached hereto. 4 . Term. The EASEMENT shall commence as of the date of recordation of this GRANT and shall exist in perpetuity. 5 . Description. The EASEMENT shall be used by the public for trail purposes, including, but not limited to, equestrian, pedestrian and bicycle purposes . 6 . Restrictions on Grantors ' Use. GRANTORS may use the EASEMENT in any manner and for any purpose which does not unreasonably interfere with the public 's right to use the EASEMENT. 7 . Vacation. This GRANT is effective only upon the condition that the Existing Easement be vacated and that a Resolution of Summary Vacation substantiallyin the form of Exhibit C hereto be adopted by the TOWN and recorded concurrently with the recordation of this GRANT. 8 . Binding Effect. The provisions contained in this GRANT shall run with the land and shall be binding upon and inure to the benefit of the respective successors and assigns of the parties to this GRANT.
