NOW, THEREFORE, the City Council of the Town of Los Altos Hills does RESOLVE as follows: Section 1. The City Council of the Town of Los Altos Hills hereby accepts the dedication of the easement on lands of Eberz for Sherlock Road on behalf of the public. Section 2. The Town of Los Altos Hills shall enter into and the Mayor is hereby authorized and directed to execute the Dedication of Easement, a copy of which is attached hereto. Eberz and Maxine C. Eberz (collectively, "Grantors") in favor of the Town of Los Altos Hills, a municipal corporation of the State of California ("Town") , effective as of date of recordation of the Dedication. RECITALS A. Grantors own, among other property, a private road in the Town of Los Altos Hills, California, which is described as Parcels A and B in Exhibit A attached hereto ("Road") . B. Town and Grantors now wish to expand the right of way in the Road and have an easement dedicated to Town for pedestrian, bicycle and equestrian purposes. NOW, THEREFORE, IT IS AGREED by the parties as follows: 1. Right of Way. Grantors hereby increase the right of way in the private road to sixty (60) feet. The right of way shall extend thirty (30) feet on either side of the center line. of the Road as shown on the map attached hereto as Exhibit B. 2 . Dedication of Easement. Grantors hereby dedicate to Town, and Town hereby accepts, an easement as described in Exhibit A attached hereto ("Easement") for public pedestrian, bicycle and equestrian purposes. 3 . Character. The Easement shall be a non-exclusive easement in gross over and across the Road for the benefit of the public. • I 5 7 5 PA G. I 2 4. Location. The Easement in the Road shall extend thirty (30) feet on either side of the center line of the Road as shown on the map attached hereto as Exhibit B. 5. Term. The Easement shall commence as of the date of recordation of this Dedication and shall exist in perpetuity. 6. Restrictions on Grantor's Use. Grantors may use the Easement in any manner and for any purpose which does not unreasonably interfere with the public's right to use the Easement. 7. Binding Effect. The provisions contained in this Dedication shall run with the land and shall be binding upon and inure to the benefit of the respective successors and assigns of the parties to this Dedication.
