HomeMy WebLinkAbout69-90 • L 6 0 8 PA GEO3 f 8 ei RESOLUTION NO. 69-90 RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS ACCEPTING THE DEDICATION OF RIGHT OF WAY AND EASEMENT ON ALTA LANE NORTH FROM OWEN COMPANY WHEREAS, Owen Company has offered to dedicate a right of way and easement to the Town of Los Altos Hills on Lands of Owen Company for Alta Lane North; and WHEREAS, the City Council of the Town of Los Altos Hills has read and considered that dedication of right of way and easement. - NOW, THEREFORE, the City Council of the Town of Los Altos Hills does RESOLVE as follows: Section 1. The City Council of the Town of Los Altos Hills hereby accepts the dedication of right of way and easement on Lands of Owen Company for Alta Lane North on behalf of the public. Section 2 . The Town of Los Altos Hills shall enter into and the Mayor is hereby authorized and directed to execute the Dedication of Right of Way and Easement, a copy of which is attached hereto. Town of Los Altos Hills 26379 Fremont Road Los Altos Hills, CA 94022 TIN Attention: City Clerk DEDICATION OF RIGHT OF WAY AND EASEMENT - THIS DEDICATION OF RIGHT OF WAY ("Dedication") is granted by Owen Company, a California corporation (the "Company") in favor of the Town of Los Altos Hills, a municipal corporation of the State of California ("Town") , effective as of the date of recordation of the Dedication. RECITALS A. Company owns property adjoining Alta Lane North in the Town of Los Altos Hills, California, which is described on Exhibit A attached hereto ("Property") . B. Company and Town desire that Company dedicate this Property as a right of way in a private road. NOW, THEREFORE, IT`' IS AGREED by the parties as follows: 1. Right of Way. Company hereby dedicates a right of way in the property described on Exhibit A attached hereto and shown on Exhibit B attached hereto (the "Property") as a private road. 2 . Dedication of Easement. Company hereby dedicates to Town an easement in the Property for public pedestrian, bicycle and equestrian purposes ("Easement") . 3 . Character. The Easement shall be a non-exclusive easement in gross over and across the Property for the benefit of the public. 4 . Term. This Easement shall commence as of the date of recordation of this Dedication and shall exist in perpetuity. 5. Restrictions on Company's Use. Company may use the Easement in any manner and for any purpose which does not fib) L 08 P_ GE :i 4 7 . � t � unreasonably interfere with the public's limited right to use the Easement. 6. Binding Effect. The provisions contained in this Dedication shall run with the land and shall be binding upon and inure to the benefit of the respective successors and assigns of the parties to this Dedication.
