RESOLUTION NO. 30-89
A RESOLUTION APPROVING TENTATIVE MAP OF
LANDS OF JULIE ESHNER, ET AL
RESOLVED, by the City Council of the Town of Los Altos Hills, County of
Santa Clara, State of California, that
WHEREAS, the City Council having examined the proposed Tentative
Map entitled
"Lands of Julie Eshner, et al
All of Lot 14 and the 1994 acre parcel of
land as shown on that certain Tract 4897
Book 288 of Maps at Page 42, Santa Clara
County Records,"
herein referred to as the "Tentative Map"; and
WHEREAS, the Tentative Map having been reviewed by any other
public agencies entitled to do so, and the recommendations of any such public
agencies having been considered by the City Council prior to its taking action
on the Tentative map; and
WHEREAS, the City Council having conducted a hearing concerning the
Tentative Map and having considered the evidence presented at the hearing;
and
WHEREAS, the City Council having determine that the Tentative Map is
in conformity with the requirements of Chapter 4 entitled "Subdivision" of
Title 9 of the Los Altos Hills Municipal Code; and the Subdivision Map Act of
the State of California commencing at Section 66410 of the Government Code;
and
WHEREAS, the City Council having read and considered the proposed
conditions of approval concerning the Tentative Map which have been

recommended by the Planning Commission,
NOW, THEREFORE, IT IS HEREBY FOUND, ORDERED AND DETERMINED as
follows:
1. The City Council of the Town of Los Altos Hills hereby approves the
above-described Tentative Map subject to performance of and compliance
with each of the Conditions of Approval which are set forth in Exhibit "A"
attached hereto, entitled"Conditions of Approval Tentative Map", and which
conditions are incorporated herein by reference and made a part of this
Resolution as though set forth fully herein.
REGULARLY passed and adopted this 15th day of February, 1989.

LAND AND EASEMENT DEDICATIONS:
1 . The applicant shall dedicate an additional 10 feet of right-
of-way for the existing public street where it adjoins the
property. The Final Map shall reflect this right-of-way
dedication.
2 . The proposed new private road within the subdivision shall
have a 50-foot right-of-way. The Final Map shall reflect
this right-of-way. Further , a note shall be added to the
map and the owner' s certificate indicating that upon further
subdivision of the property, or issuance of a Building
Permit on Lot #2, the road shall be dedicated to the Town of
Los Altos Hills with a right-of-way meeting Town Standards .
3 . The applicant shall record an easement for Pacific Bell tel-
ephone lines and maintenance to the satisfaction of Pacific
Bell . The Final Map shall reflect this easement .
4. A Conservation Easement shall be recorded for that area of
Parcel #1 shown on Exhibit "A" of the Tentative Map as being
of 30 to 40 percent slope . The Final Map shall reflect this
easement .

6. The applicant shall dedicate to the Town of Los Altos Hills
a 25-foot wide storm drainage and sanitary sewer easement
along the alignment of the sewer easements proposed on the
Tentative Map. The Final Map shall reflect this dedication.
PUBLIC UTILITIES:
7. All utilities, including cable television, are to be un-
dergrounded , per Municipal Code 9-1 .1105.
8. Provision for sewer connection to the Los Altos Sewer for
all lots shall be made prior to recordation of the Final
Map, or a bond to the satisfaction of the Director of Public

easement from the end of Eshner Court along the northern boundary of Parcel 1,.
along the 40' contour, to the western boundary of Parcel 1, to connect with the
existing pathway easement on the Lands of: Qu.ilici. The Final Map shall reflect this
easement. This dedication;shall be accepted by the Town only when Parcl 3 is sold.

Works posted to ensure connection prior to issuance of
Building Permits. Construction of sanitary sewers is con-
sidered an improvement of this subdivision.
9. Additional capacity will have to be purchased within the Los
Altos Basin for connection. The applicant shall verify that
there exists capacity within the system for the additional
connections . This is to be done prior to recordation of
Final Map.
10. All lots shall be connected to Purissima Hills Water Dis-
trict to the Purissima Hills Water District public water
system prior to recordation of the Final Map or a bond to
the satisfaction of the Director of Public Works posted to
ensure connection prior to issuance of Building Permits.
11 . All Fire Department conditions shall be met prior to accep-
tance of improvements by the Town. Location of fire
hydrants shall be approved by the fire department and be
shown on the improvement plans.
12. All wells on the property shall be sealed, or registered and
permitted , in accordance with Santa Clara Valley Water Dis-
trict and standards, and Santa Clara County Environmental
Health Department standards, to the satisfaction of the
Santa Clara Valley Water District and the Santa Clara County
Environmental Health Department .
IMPROVEMENTS:
13 . The proposed new private street shall be improved to Town of
Los Altos Hills standards for a private street. The work is
to be shown on the improvement plans for the subdivision.
The work is to be done prior to recordation of the Final
Map, or a bond to the satisfaction of the Director of Public
Works posted to ensure the completion of the required work
prior to issuance of Site Development Permits.
14. A Type IIB pathway to be upgraded shall be constructed
within the pathway easement described in Condition 5 above .
The work is to be shown on the improvement plans for the
subdivision. The work is to be done prior to recordation of
the Final Map, or a bond to the satisfaction of the Director
of Public Works posted to ensure the completion of the re-
quired work prior to issuance of Site Development Permits.

15 . Any storm drainage structures or improvements identified by
the storm drain study are to be installed as improvements of
this subdivision. Improvements are to be installed prior to
recordation of the Final Map, or a bond to the satisfaction
of the Director of Public Works posted to ensure the comple-
tion of the required work prior to issuance of Site Develop-
ment Permits.
GEOLOGY AND SOILS:
16. A Human Habitation Setback shall be recorded on the Final
Map for an area 30 feet on either side of the Berrocal Fault
in the alignment shown on the Tentative Map. A Deed
Restriction shall be recorded with the Final Map and a note
placed on the face of the Final Map noting the Human Habita-
tion Setback from the fault , and the no building for human
habitation restriction within that setback.
17. Geotechnical Update and Field Reconnaissance - The ap-
plicant' s geotechnical consultant shall review the current
field conditions and referenced soil and geologic investiga-
tion. Any significant changes in field conditions or
geotechnical constraints to development shall be noted. The
consultant shall specifically comment on the impact of past
grading on Parcel 1 to residential development of this lot.
Geotechnical design recommendations shall be updated, as
necessary, for the proposed development.
PLANNING AND ZONING
18. All structures made non-conforming by this subdivision shall
be removed prior to recordation of the Final Map or a bond
to the satisfaction of the Director of Public Works posted
to ensure the completion of the required work prior to is-
suance of Site Development Permits, unless a variance is ob-
tained .
19. An inventory of all trees on this subdivision which are 20"
in circumference at 4' high shall be made by a qualified
tree surgeon and the need for trimming, cabling, and other
protective steps shall be reported to the Director of Public
Works . The subdivider shall perform the work prior to
recordation of the Final Map or post a bond to the satisfac-

tion of the Director of Public Works to ensure the comple-
tion of the required work prior to issuance of Site Develop-
ment Permits.
