HomeMy WebLinkAbout106-89 • • RESOLUTION NO. 106-89 A RESOLUTION APPROVING TENTATIVE PARCEL MAP OF THE LANDS OF LO CONTE RESOLVED, by the City Council of the Town of Los Altos Hills, County of Santa Clara, State of California, that WHEREAS, the City Council having examined the proposed Tentative Map entitled "Tentative Map • Lands of Lo Conte," • herein referred to as the Tentative Map"; and WHEREAS, the Tentative Map having been reviewed by any other public agencies entitled to do so, and the recommendations of any such public agencies having been considered by the City Council prior to its taking action on the Tentative map; and WHEREAS, the City Council having conducted a hearing concerning the Tentative Map and having considered the evidence presented at the hearing; and WHEREAS, the City Council having determine that the Tentative Map is in conformity with the requirements of Chapter 4 entitled "Subdivision" of Title 9 of the Los Altos Hills Municipal Code; and the Subdivision Map Act of the State of California commencing at Section 66410 of the Government Code; and WHEREAS, the City Council having read and considered the proposed conditions of approval concerning the Tentative Map which have been recommended by the Planning Commission, • NOW, THEREFORE, IT IS HEREBY FOUND, ORDERED AND DETERMINED as follows: 1. The City Council of the Town of Los Altos Hills hereby approves the above-described Tentative Map subject to performance of and compliance with each of the Conditions of Approval which are set forth in Exhibit "A" attached hereto, entitled"Conditions of Approval Tentative Map", and which conditions are incorporated herein by reference and made a part of this Resolution as though set forth fully herein. CITY C 072189 -2- • • • EXE!IBIT "A" PLANNING COMMISSION RECOMMENDED CONDITIONS OF APPROVAL* LANDS OF LOCONTE TENTATIVE MAP FILE #TM1-89 STORY HILL LANE LAND AND EASEMENT DEDICATIONS: 1 . The applicant shall dedicate as Conservation Easement all that land easterly of and including the proposed Storm Drain Easement, as shown on proposed Lot 2 of the Tentative Map date 3-6-89 , and as marked on Exhibit A. The Final Map shall reflect this dedication. 2 . The applicant shall record an easement for Pacific Bell tel- ephone lines and maintenance to the satisfaction of Pacific Bell. The Final Map shall reflect this easement. 3 . The applicant shall dedicate additional Conservation/Open Space Easement on proposed Lot 1 of an amount equivalent to that being removed from the existing Conservation Easement on proposed Lot 2. The Final Map shall reflect this dedica- tion. [Final location to be to the satisfaction of Staff. ] * {* = added by Planning Commission) 4 . The applicant shall dedicate storm drainage, sanitary sewer and slope easements as shown on the Tentative Map. All easements shall be a minimum of 25 ' in width for ease of ac- cess . The Final Map shall reflect these dedications. 5 . The applicant shall dedicate as a general pathway easement as shown on the tentative map along the northern and western borders of lot #2, continuing into lot #1 to connect with the existing pedestrian/equestrian easement. PUBLIC UTILITIES : 6. Each lot shall be connected to a the Palo Alto sanitary sewer system prior to recordation of the Final Map, or a bond to the satisfaction of the Director of Public Works posted to ensure connection prior to issuance of Building Permits. 7 . All utilities, including cable television, are to be un- dergrounded, per Municipal Code 9-1. 1105 . 1 . , • • PLANNAG COMMISSION RECOMMENDED CONDITIONS OF APPROVAL OF TENTATIVE MAP #TM 1-89 - Lands of LoConte From Planning Commission Meeting of July 12, 1989 (and amended by Staff based on City Council meeting of August 2, 1989) City Council Meeting of September 6, 1989 8 . All lots shall be connected to the Purissima Hills Water District public water system prior to recordation of the Final Map. 9 . All wells on the property shall be sealed in accordance with Santa Clara Valley Water District standards, and to the satisfaction of the Santa Clara Valley Water District. IMPROVEMENTS : 10 . The native path is to be relocated per the proposed Tenta- tive Map and constructed as a portion of the improvements of this subdivision. The work is to be shown on the improve- ment plans for the subdivision. The work is to be done prior to recordation of the Final Map, or a bond to the satisfaction of the Director of Public Works posted to ensure the completion of the required work prior to issuance of Site Development Permits . 11 . All storm drain improvements are to be constructed as a por- tion of the improvements, including, but not limited to, the construction of culverts, headwalls, lined channels and ero- sion mitigation at the outfall end of all such structures. 12. A retention basin or other stilling device is to be con- structed as a portion of these improvements. This basin is to be so designed as to not allow any development of these lots to increase either the rate of or peak run-off. This basin is to be so designed as to protect residents downstream from the impacts of erosion due to any develop- ment on these lots . Finally, this basin is to be so designed as to provide mitigation for the potential pollu- tion of San Francisco Bay due to any development on this property. 13 . All improvements are to be approved by the City of Palo Alto, in addition to the Town of Los Altos Hills. All drainage improvements shall also be approved by the Town Geologist as in conformance with his recommendations. 14 . A sewer connection is to be provided for Lot 2 as a portion of the improvements for this subdivision. Geotechnical Plan Review - The applicant' s geotechnical con- sultant shall review and approve all geotechnical aspects of the development plans (i.e. , site preparation and grading, site drainage improvements and design parameters for founda- tions and roadways) to ensure that his recommendations have been properly incorporated. The results of the plan review shall be summarized by the geotechnical consultant in a letter and submitted to the Town Engineer for review and approval prior to issuance of building permits . 16. Geotechnical Field Inspection - The geotechnical consultant shall inspect, test (as needed) , and approve all geotechni- cal aspects of project construction. The inspections should include, but not necessarily be limited to: site preparation and grading, site surface and subsurface drainage improve- ments , and excavations for foundations and retaining walls prior to the placement of steel and concrete. The consul- tant shall inspect installation of the leachfield system to verify suitable placement of septic lines into bedrock rath- er than the upper soil or colluvial materials. The results of these inspections and the as-built conditions of the project shall be described by the geotechnical con- sultant in a letter and submitted to the Town Engineer for review prior to final project approval. PLANNING AND ZONING 17 . All structures made non-conforming by this subdivision shall be removed prior to recordation of the Final Map or a bond to the satisfaction of the Director of Public Works posted to ensure the completion of the required work prior to is- suance of Site Development Permits . 18 . The Conservation Easements which presently comprise proposed Lot 2 shall be abandoned by the City Council prior to the recordation of the Final Map. 3 PLANNNING COMMISSION RECOMMENDED CONDITIONS OF APPROVAL OF TENTATIVE MAP #TM 1-89 - Lands of LoConte From Planning Commission Meeting of July 12 , 1989 (and amended by Staff based on City Council meeting of August 2, 1989) City Council Meeting of September 6, 1989 19 . Any comments or requirements made by the Department of Fish and Game prior to the recordation of the Final Map are to be considered conditions of approval of this tentative map. Required improvements are to be made prior to recordation of the Final Map or bonded against to the satisfaction of the Director of Public Works . [20 . All trees with diameter of 6" or greater, as measured four (4 ' ) from the ground are to be examined by a licensed ar- borist and a report prepared by that arborist recommending a program of treatment and long-term protection for these trees. ] * [21 . The owner shall enter into a maintenance agreement with the Town that specifies the maintenance responsibilities of the owner of Lot #2 for the continuing maintenance and repair of the storm drain improvements constructed on the property. The agreement shall include the retention basin and the reconstructed creek channel. Included in the agreement shall be a clause that allows the Town, or its agents, to enter the property to maintain the facilities in the event the property owner fails to do so. The agreement shall note that the owner is liable for the expenses incurred by the Town, plus any administrative costs as established by the City Council. ] * FEES : 22 .
