HomeMy WebLinkAbout123-89 RESOLUTION NO. 123-89 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE TOWN OF LOS ALTOS HILLS ADOPTING INTERIM REGULATIONS FOR EARTHQUAKE DAMAGE RECONSTRUCTION. WHEREAS, on October 17, 1989, the Town of Los Altos Hills experienced a severe earthquake; and WHEREAS, numerous structures within the Town are believed to have suffered varying degrees of damage necessitating repair and reconstruction; and WHEREAS , in order to encourage immediate repair and reconstruction of structures to the benefit of the public health, safety, and welfare and to ensure that such work is performed at a minimum of costs otherwise incurred through payment of fees to the Town, the Council has determined to adopt interim regulations pertaining to this type of work and certain accompanying fees for a period of ninety (90) days from the date of the earthquake: NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF THE TOWN OF LOS ALTOS HILLS DOES HEREBY RESOLVE AS FOLLOWS : SECTION 1. Commencing effective October 18, 1989, the following shall apply for approvals and permits required for work on properties affected by the earthquake of October 17, 1989. I. APPLICATION PROCESS A. Repair of significant damage to property as a result of the October 17, 1989 earthquake. 1. Demolition. If required by the Town immediately for health or safety, applicant can proceed without permits so long as a contractor licensed for that type of work is used. Permits must be applied for as soon thereafter as possible. Otherwise, applicant shall apply for permit first, - 1 - HS • following existing Town procedures. 2. Grading. If needed for site protection (such as to prevent erosion) , applicant can proceed without permits employing a contractor licensed for that type of work. Permit shall be applied for as soon thereafter as possible. Otherwise, applicant shall apply for permits , following existing Town procedures. 3. Rebuilding. (a) Non-Conforming Structure. (i) If structure exceeds current MDA or MFA limits and an increase in non-conformity is proposed, applicant to apply for a variance; (ii) If rebuilding what existed before, appliant shall apply for permits. A letter from soils/geotechnical consultant is highly recommended (letter may be required for foundations) ; (iii) If changing the structure, applicant shall apply for a variance. (iv) For other non-conforming structures, applicant shall apply for a variance. (b) If a variance had previously been granted for the structure : (i) If applicant proposes to rebuild within the current structure envelope and variance remains in effect; applicant shall apply for permits; (ii) If applicant proposes to build outside the current envelope and variance is no longer in effect, applicant shall apply for new variance and permits thereafter. (c) All other structures : (i ) If applicant proposes to rebuild what existed before , applicant shall apply for permits ; (ii) If applicant proposes any other project, applicant must confer with Town staff as a - 2 - 111 110 variance may be necessary. B. Repair of Minor Damage as a result of the earthquake (i.e. , no Site Development or Zoning Review necessary under existing requirements) . 1. If applicant is making no changes to what existed before and repairs are needed immediately for health or safety, applicant can proceed without permits, employing a contractor licensed for that type of work. Applicant shall apply for permits as soon thereafter as possible. 2. For changes to existing structure, applicant shall apply for permits first, following existing Town procedures. II . REVIEW AND APPROVAL PROCESS . A. Zoning and Site Development. 1. Staff review and approval is required for reconstruction of structures substantially the same in size, building mass and location. 2. For structures other than as described in 1 , above, staff approval is required if no variances are needed. Staff may refer sensitive sites to appropriate site development authority. B. Building. 1. Plans will be reviewed, permits issued, and inspections scheduled on a priority basis in descending order of precedence as follows: (a) Rebuilding what was there before. (b) Repairs. (c) Rebuilding with changes. (d) Non-earthquake related applications. III . FEES. A. All fees shall be waived if applicant is rebuilding what existed before or is repairing minor damage. B. For work other than as described in A above, - 3 - 111 • fees will be assessed only for review and approval of proposed changes to what was there before. C. All fees will be for direct costs only and will not include overhead or administrative charges. SECTION 2. The provisions of Resolution No. 107-89 to the extent they conflict with the provisions of Section 1 are hereby superceded during the effective period of this Resolution. The provisions of this section, unless renewed by Resolution duly adopted by the City Council shall expire on January 16, 1990 and therafter shall be of no force and effect. All provisions of Resolution No. 107-89, as existing prior to adoption of this amendment shall then be in full force and effect.
