Council Chambers, 26379 Fremont Road 1. CALL TO ORDER, ROLL CALL, AND PLEDGE OF ALLEGIANCE Mayor Siegel called the Adjourned Regular Meeting of the City Council to order at 7:00 p.m. in the Council Chambers at Town Hall. Present: Mayor Siegel and Councilmembers Casey, Dauber, Hubbard and Johnson Absent: None Staff: City Manager/City Engineer Jeff Peterson, City Attorney Sandy Sloan, Planning Director Curtis Williams and City Clerk Pat Dowd. John Hester, David Powers Consulting Firm (environmental impact report prepared for the Quarry Hills Project) Press: Clyde Noel, Los Altos Town Crier and Don Brignolo, San Jose Mercury 2. PRESENTATIONS FROM THE FLOOR 3. PUBLIC HEARINGS 3.1 Request for certification of the Final Environmental Impact Report, amendments to the Town's General Plan and Zoning Ordinance and approval of a Tentative Map for 23 lots on 78 acres, Quarry I -lilts Subdivision (Lands of Vidovich), 11920 Stonebrook Drive Mayor Siegel noted that he believed several people were present concerning two particular issues of the Quarry Hills Project, namely the sewer issue and the issue of whether or not to declare Stonebrook an emergency access road only. In view of this he opened the public hearing and welcomed their comments. October 30, 1995 Adjourned Regular Meeting Gary Deaner, 11665 Dawson Drive, commented that the Juan Prado Mesa Preserve �, was an asset to the entire community and he was quite concerned about the impact on the oaks and other trees of laying a sewer line. Harry Emerzian, 11670 Dawson Drive, referred to the area as it was when they moved in many years ago and stated that he wanted to see the open space remain as it now was. Dr. Howard Martin, 11666 Dawson Drive, noted that he had donated a path to the Town for access to the preserve but this specifically did not allow vehicular traffic. Hale Creek has been dry since 1986 and there has been no pumping out of water since Mr. Vidovich has been filling the lake. Dr. Martin was quite concerned about the infrastructure of the proposed sewer line and presented a diagram on the potential results of a gravity flow sewer line. He noted that the damage done to the environment from sewer lines was mainly from the detergents. He did not believe the cost of a lift pump was great and would be of benefit to the entire community. Dr. Martin supported the Planning Commission's recommendation. The following residents spoke in favor of using Stonebrook only as an emergency access: Carol Johnson, 10955 Magdalena; Belinda and Ken Shoemaker, 10925 Stonebrook; and Ed Carlstone, 10921 Stonebrook. They addressed the safety and stability issues as well as the legal road status of Stonebrook (public?/ private?). They ` also noted that the environmental impact report was done based on Stonebrook as an emergency access road only and if this was changed they believed this report should be redone. Walter Gregorwich, 12370 Priscilla, and Mary Silver, 24840 Prospect, supported opening Stonebrook to Magdalena. They were experiencing increased traffic due to the increased building of homes in their neighborhood and thought it only right that the impact of increased traffic be shared. Les Earnest, Chairman - Pathways Committee, stated that if Stonebrook was made an emergency access he would request a separate easement for pathways. John Vidovich, applicant, noted that the Town generally had gravity flow sewer lines and he did not think this sewer system would have a negative impact on the community. He also thought the long term cost of a lift station should be considered. Mr. Vidovich stated that the existing path could be used for the sewer and not a paved road. On the subject of Stonebrook, Mr. Vidovich strongly supported using Stonebrook only as an emergency access. To do otherwise, he felt encouraged traffic and would have a serious detrimental affect on this project. Referring to the condition requiring the elimination of lots 20 and 21, Mr. Vidovich did not believe this was equitable. He met all of the Town's requirements and believed these two lots should remain. October 30, 1995 Adjourned Regular Meeting PASSED BY CONSENSUS: To amend the conditions of approval to reflect a sewer in the preserve with stipulations that the encroachment permit will come back to Council for approval and no permit will be issued until annexation is completed. MOTION SECONDED AND CARRIED: Moved by Siegel, seconded by Dauber and passed by the following roll call vote to amend the conditions to reflect Stonebrook open to Magdalena. AYES: Mayor Siegel and Councilmembers Casey and Dauber NOES: Mayor Pro Tem Hubbard and Councilmember Johnson MOTION SECONDED AND FAILED: Moved by Johnson, seconded by Casey and failed by the following roll call vote to delete the elimination of lots 20 and 21 and the reference to Parcel B as open space. AYES: Councilmembers Casey and Johnson NOES: Mayor Siegel and Councilmembers Dauber and Hubbard MOTION FAILED DUE TO LACK OF A SECOND: Moved by Casey to add lot 21 to lot 22 and to not eliminate lot 20. PASSED BY CONSENSUS: To direct staff to prepare an analysis of the best locations for lots 20 and 21 and to consult with the applicant on this analysis and to review the path locations with both the applicant and the Chairman of the Pathways Committee. MOTION SECONDED AND FAILED: Moved by Johnson, seconded by Casey and failed by the following roll call vote to amend the first sentence of Condition #1 to read: "The applicant/owner must, not later than 90 days after approval of the Tentative Map by the City Council, provide written consent to include the property in the Town's Urban Service Area and to annexation of the property to the Town of Los Altos Hills." AYES: Councilmembers Casey and Johnson NOES: Mayor Siegel and Councilmembers Dauber and Hubbard MOTION SECONDED AND CARRIED: Moved by Dauber, seconded by Siegel and passed unanimously to amend the first sentence of Condition #1 to read: "The applicant/owner must, not later than 60 days after approval of the Tentative Map by the City Council, provide written consent to include the property in the Town's Urban Service Area and to annexation of the property to the Town of Los Altos Hills." Council also agreed that the following sentence should be added to condition #1: "If a lawsuit is filed, this condition is suspended." October 30, 1995 Adjourned Regular Meeting Casey raised concerns about the earlier vote to open Stonebrook. She believed this vote may have been premature as there had not been notification of the residents who would be impacted by this decision. She asked Council to consider continuing this matter to a future Council Meeting and to notify all of the residents in the neighborhood. MOTION SECONDED AND CARRIED: Moved by Casey, seconded by Johnson and passed unanimously to reconsider the motion to open Stonebrook. PASSED BY CONSENSUS: To continue the public hearing on the Quarry Hills Project to an Adjourned Regular Meeting of the City Council on Tuesday, November 7, 1995 at a location to be determined and to schedule an Adjourned Regular Meeting on the Stonebrook Issue for 5:00 p.m. on November 15, 1995. 4.
