Council Chambers, 26379 Fremont Road 1. CALL TO ORDER, ROLL CALL, AND PLEDGE OF ALLEGIANCE Mayor Siegel called the Adjourned Regular Meeting of the City Council to order at 5:00 p.m. in the Council Chambers at Town Hall. Present: Mayor Siegel and Councilmembers Casey, Dauber, Hubbard and Johnson Absent: None Staff: City Manager/City Engineer Jeff Peterson, City Attorney Sandy Sloan, Planning Director Curtis Williams, Public Press: Works Manager Ed Tayor and City Clerk Pat Dowd None 2. PRESENTATIONS FROM THE FLOOR 3. PUBLIC HEARINGS 3.1 Request for approval of lot merger and conditional exceptions for Lots 1 through 14, Lands of Micko, Kingsley Avenue and Altadena Drive Eric Cleage, 26140 Rancho Manuella Lane, requested that the Council not approve this project but rather taken action to include the 160' building circle as a zoning requirement and impose a building moratorium for one year while this was done. MOTION SECONDED AND CARRIED: Moved by Casey, seconded by Hubbard and passed by the following roll call vote to approve the lot merger for Lots 1 through 14 for Lands of Micko at Kingsley and Altadena subject to the recommended conditions and findings. November 15, 1995 Adjourned Regular Meeting AYES: Mayor Siegel and Councilmembers Casey, Dauber and Hubbard NOES: Councilmember Johnson 3.2 Request for approval of a negative declaration and tentative map for a proposed four lot subdivision of 9.45 acres, Lands of LeFevre, south side of Altamont Road and east of Julietta Lane Mr. Cleary, 26410 Altamont Road, stated that he now concurred with the recommendation from the Pathways Committee that the path go from Eshner Court to Silent Hills Lane. Mr. Cleary also supported the Planning Commission's recommendation that there be a 50' setback so lie and his wife could have a buffer capacity for landscaping. Lynne Miller, 27320 Julietta Lane, stated her opposition to the path being put along their property on Julietta. She was quite concerned about the impact on their property as far as view and privacy were concerned. They would be unable to block - off this path without losing their view. She felt this was quite an emotional issue and definitely was one of safety. Mr. LeFevre, applicant, concurred with the proposed pathway location. On the subject of the setbacks, however, he felt that 50' was excessive. This was not a requirement ordinarily imposed and he showed pictures of the Cleary's lot to substantiate his comments. Regarding the driveway, Mr. LeFevre believed the issue of the lights could be addressed by landscaping and it was unnecessary to shift the driveway. PASSED BY CONSENSUS: To state in condition #19 that the applicant shall be responsible for continuity of access and utility service at the Cleary property throughout all phases of construction and until completion and acceptance of all construction improvements. MOTION SECONDED AND FAILED: Moved by Casev, seconded by Johnson and failed by the following roll call vote to approve the 40easterly side setback for Lot 2. AYES: Councilmembers Casey and Johnson NOES: Mayor Siegel and Councilmembers Dauber and Hubbard MOTION SECONDED AND PASSED: Moved by Siegel, seconded by Casey and passed by the following roll call vote to approve a 50' easterly side setback for Lot 2. AYES: Mayor Siegel and Councilmembers Dauber, Hubbard and Johnson NOES: Councilmember Casey VAW November 15, 1995 Adjourned Regular Meeting MOTION SECONDED AND CARRIED: Moved by Siegel, seconded by Johnson and passed unanimously to put the path from Eshner Court to Silent Hills connecting to Julietta Lane but not following Julietta. MOTION SECONDED AND CARRIED: Moved by Dauber, seconded by Hubbard and passed unanimously to approve the request for approval of a negative declaration and tentative map for a proposed four lot subdivision of 9.45 acres, Lands of LeFevre, south side of Altamont Road and east of Julietta Lane, subject to the approved conditions of approval. MOTION SECONDED AND CARRIED: Moved by Johnson, seconded by Casev and passed unanimously to add a Closed Session to the agenda as an urgency item. 4. CLOSED SESSION: ANTICIPATED LITIGATION: PURSUANT TO GOVERNMENT CODE SECTION 54956.9(b) -- One Case (Lands of Vidovich Stonebrook Drive) Council adjourned to a Closed Session regarding litigation at 5:50 p.m. and reconvened at 6:00 p.m. Council returned to open session to report, if necessary, aov action taken. 5.
