CALL TO ORDER, ROLL CALL. AND PLEDGE OF ALLEGIANCE Mayor Johnson called the Regular Meeting of the City Council to order at 6:00 p.m. in the Council Chambers at Town Hall. Present: Mayor Johnson and Councilmembers Dauber, Hubbard, Siegel and Tryon Absent: None Staff: City Attorney Sandy Sloan, Director of Public Works Jeff Peterson, Town Planner Linda Niles and City Clerk Pat Dowd Press: Clyde Noel, Los Altos Town Crier 2. APPOINTMENTS AND PRESENTATIONS 3. PLANNING COMMISSION REPORT Planning Commissioner Dot Schreiner noted that there was no report as the second Planning Commission meeting in December had been cancelled. 4. CONSENT CALENDAR MOTION SECONDED AND CARRIED: Moved by Hubbard, seconded by Tryon and passed unanimously to approve the Consent Calendar, specifically: 4.1 Approved Warrants: $161,944.52 (12/21/93) 5. UNFINISHED BUSINESS �w 1 January 5, 1994 6. NEW BUSINESS 6.1 Request from County for General Plan Conformance and Contiguity/ Annexation Statement for Lands of Oleynik, 10225 W. Loyola Drive, Los Altos Council discussed whether or not annexation of this property should be required. Hubbard believed a policy statement was needed regarding the annexation of these bordering properties. Siegel commented that deferred annexation would not prevent this project from being built under County standards. Siegel supported the proposed two -lot subdivision which conformed to the Town's regulations but not a three -lot subdivision which would be allowed in the County. The City Attorney commented that technically if this property was annexed it would not create an 'island'. Dot Schreiner, representing the Pathways Recreation and Parks Committee, stated that they would like to see the County adopt the Town's standards, particularly since all of Ravensbury was a connector road. MOTION SECONDED AND CARRIED: Moved by Hubbard, seconded by Tryon and passed unanimously to state that the proposed subdivision of Lands of Oleynik at 10225 W. Loyola Drive in Los Altos which was within the Town's Urban Service Area, was in conformance with the Town's General Plan, Subdivision Ordinance and Zoning Ordinance. It was further determined that the project was major and qualified for annexation prior to development. Application may not be accepted by the County without a written waiver from the Town. 6.2 Request from the Strengthen Our Schools Committee for support of Measure B -- school bond issue Ginny Lear, Chairman of the SOS Strengthen Our Schools Committee, briefly explained Measure B, its placement on the April ballot and the importance of its passage to the school district. She noted that tours had been conducted of the schools and the necessity of obtaining these funds was apparent. Mrs. Lear noted that the support of the Council was very important towards the passage of this measure which required a two-thirds vote of the residents in the school district. Dr. Don Phillips, Superintendent of the Mountain View -Los Altos Union High School District, noted that there were several important reasons why this measure needed to pass. These included the fact that they were facing growth as a school district, there was no adequate classroom space, the present facilities were 30 to 40 years old and the educational program needed to be changed. Dr. Phillips commented on the minimal impact of this measure on the taxpayers and asked Council for their support. January 5, 1994 4 Council agreed that the facilities were inadequate and these funds were needed. br Johnson did comment that while he had confidence in those supporting this measure and believed the bond was necessary, he questioned whether the amount of 'not to exceed $68.5 million' was the right amount. It could be that it was too much or even too little to accomplish the goal. MOTION SECONDED AND CARRIED: Moved by Tryon, seconded by Hubbard and passed unanimously to support Measure B on the April 12, 1994 ballot concerning the passage of general obligation bonds to provide the funds necessary to rehabilitate, construct and modernize classrooms and facilities at both Los Altos and Mountain View High Schools and to request the residents of the Town to turn out for a yes vote on this measure. 7. REPORTS FROM COMMITTEES. SUB -COMMITTEES, AND COUNCILMEMBERS ON OUTSIDE AGENCIES 7.1 Residential Design Guidelines Subcommittee Dauber reported that a meeting was scheduled for January 19th to look at the final drawings with the consultant. The final version of the design guidelines will be brought back to Council at the February 2nd meeting. 7.2 Town Handbook Subcommittee Tryon presented to the Council a draft of the handbook. A discussion followed on the pictures to be included, the budget, the stock of paper and whether to use four color or duo tone. Tryon believed the color issue was an aesthetic decision which Council needed to make. Siegel asked how much money would be saved by using duo -tone and also stated that there should be a clear understanding of what the total cost of this project is including mailing and postage. Dauber wanted to be sure that the additional materials (safety flags, pathway map, directory) fit in the back pocket of the handbook. Candace Oanbrecht, PRX, commented that she was prepared to answer any questions the Council had on the handbook. She noted that the picture depicting the large gate and pillars needed to be replaced by another more appropriate picture. This would change the timetable for the completion of the project. She would redo the schedule and provide the Council with an update. It was also agreed that at the next Council meeting a report on the actual costs of the project would be provided as well as a report on the inserts for the packet in the handbook and whether or not they will all fit. January 5, 1994 Dot Schreiner, Planning Commissioner, reported that she and Carol Gottlieb, Chairman of the Pathways Recreation and Parks Committee, had met in December with the City Manager to discuss the pathway map to be included in the handbook packet. She noted that it was rather bulky and they were working on three different sizes with clarity being an important issue. They were finishing the work with the graphic artist and the City Manager would be putting this project out to bid. Mrs. Schreiner asked for a copy of the new timetable when it was available. It was agreed this issue would be brought back to the Council Meeting on the 19th. 7.3 Quarry Subcommittee 7.4 Water District Subcommittee 7.5 Packard Subcommittee 7.6 Composting Subcommittee Dauber reported that to date there had been 33 responses and Friday, January 7th was the deadline. The demonstration date was scheduled for Saturday, January 22nd at Town Hall. 7.7 Library Commission Dauber commented that the library was connecting to a new Inter -Net program which should be available in about a year. It was an exciting program which hopefully the schools would also connect to in the near future. Anyone with a computer and modem at home would be able to participate and E -Mail addresses would be available through the library. 7.8 Safety Committee Dauber reported that the Safety Committee had met with the Sheriff's Department concerning clearer identification of homes so that they could be found more easily in an emergency. 8. STAFF REPORTS 8.1 City Manager 8.2 City Attorney The City Attorney reported that she had added the Town to a list of t approximately 100 cities supporting Glendale in a case regarding restricted �r January 5, 1994 ` development on a ridgeline. The developer had sued stating Glendale or was taking his property and the Court had decided to hear the case. She would advise the Council of any further actions in this matter. 8.3 City Clerk 9. COUNCIL -INITIATED ITEMS 9.1 Attendance at Planning Commission Meetings (Mayor Johnson) Johnson acknowledged recent correspondence on attendance at Planning Commission meetings by the Commissioners and noted that no further action on this issue was necessary. 9.2 Fire Protection (Councilmember Siegel) Siegel reported that Los Altos and the Fire District had formed a committee to discuss options for fire protection. 9.3 Fencing of pools (Mayor Pro Tem Dauber) Dauber asked the City Attorney for a report on recent legislation concerning fencing of pools. 9.4 Finance Committee - recommendations regarding audit (Councilmember Siegel) Siegel asked that the recommendations from the Finance Committee (the minutes of their December 7, 1993 meeting) concerning the audit report be agendized for Council discussion 9.5 Solid Waste Meetings (Councilmember Siegel) Siegel asked how the Council would be kept up to date on the discussions at these solid waste meetings. Johnson noted that this ad hoc group of Santa Clara and San Mateo cities had just had a procedural meeting and was in the process of developing a work program. The next meeting was scheduled for mid-February and Council would be receiving written reports. 10. PRESENTATIONS FROM THE FLOOR 11. PUBLIC HEARINGS January 5, 1994 11.1 Request for a Site Development Permit for a major addition including [. a secondary unit, Lands of Helliwell, 2240 Old Page Mill Road The Town Planner, at the request of the Mayor, commented on the letter from Mr. Spangenberg which the Council had just received that afternoon. She reported that all the standards of the Town had been met on the Helliwell project and a topographical survey had been submitted by the applicant. She further commented that the Americans with Disabilities Act requirements did not apply to single family homes. Eric Spangenberg, attorney representing Mrs. Spangenberg at 2100 Old Page Mill Road, referred to his letter to the Council dated 1/5/94. In this letter he addressed several reasons why he believed this project was inappropriate and alternative realities should have been pursued by Dr. Helliwell. Mr. Spangenberg stated that he did not feel the Town followed its own ordinances. He did not agree with the staff's interpretation of the height ordinance and the natural grade level. He thought the height should be measured from natural grade which was before anything was done to the lot. Mr. Spangenberg also disagreed with the size of the secondary dwelling and how the square footage was determined and further he believed that the Town had not complied with the Americans with Disabilities Act standards. This project was an invasion of privacy on his mother's lot and they objected to its approval. Dr. Helliwell, applicant, commented that they had been concerned about a possible impact of their project and had addressed all of the comments raised by the Planning Commission. Their project was not visible at all from the Spangenberg's property; there was no visual impact. He noted, as a matter of fact, that the project was actually closer to their other neighbors who had no objection at all to the project. Mrs. Spangenberg, 2100 Old Page Mill Road, commented that they had had a difficult time getting the plans and reports on this project before the Planning Commission met. She further commented that they were the only neighbors bothered by this project. Dauber stated that she had gone to the Spangenberg's home and she could not see the Helliwell project at all from any room in their house. Hubbard noted that there would be a landscape plan required which would help address the privacy issue. Tryon commented that she did not agree with the practice of road right of way dedications which resulted in less than one acre and so a narrower right of way should be required. PASSED BY CONSENSUS: To change the first sentence of condition #11 to read: "A 20' half width right-of-way is required to be dedicated to the Town on Gerth Lane and in addition allowance shall be made for turn around space." January 5, 1994 MOTION SECONDED AND CARRIED: Moved by Siegel, seconded by Dauber and passed unanimously to approve the request for a site development permit for a major addition which includes a garage and a secondary dwelling for Lands of Helliwell at 2240 Old Page Mill Road, subject to the conditions of approval as recommended by the Planning Commission and amended by Council and the findings as set out in the staff report. 11.2 Review of adoption of revised Household Hazardous Waste Element and Source Reduction and Recycling Element of the General Plan This public hearing is continued to the March 16, 1993 City Council Meeting 12.
