HomeMy WebLinkAbout49-88 RESOLUTION NO. 49-88 A RESOLUTION OF THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS DECLARING THE INTENTION OF SAID TOWN TO VACATE AND ABANDON A PORTION OF A CERTAIN STREET UNDER THE PROVISIONS OF THE "PUBLIC STREETS, HIGHWAYS AND SERVICE EASEMENTS VACATION LAW", SECTION 8300, ET SEQ., OF THE STREETS AND HIGHWAYS CODE OF CALIFORNIA It appearing to the City Council of the Town of Los Altos Hills that a portion of a certain street hereinafter more particularly described and located within the Town of Los Altos Hills, California, should be vacated and abandoned for the reason that the portion of the public street is unnecessary for present or prospective public use, and that the best interests of the citizens of Los Altos Hills will be served by such vacation and abandonment; And, pursuant to the provisions of the "Public Streets, Highways and Service Easements Vacation Law", Section 8300, et seq., of the Streets and Highways Code, such. action is authorized if it is unnecessary for present or prospective public use, NOW, THEREFORE, BE IT AND IT HEREBY IS RESOLVED by the City Council of the Town of Los Altos Hills as follows: 1. The CityCouncil does herebydeclare its intention to vacate and abandon a portion of a certain public street described in Exhibit "A" attached hereto an incorporated herein by reference, and being located in the vicinity of Page Mill Road. 2. The lawful or official name by which this street is commonly known is Three Forks Lane. 3. A hearing on said proposed vacation and abandonment of said hereinabove described be, and the same is hereby fixed for Wednesday, • • June 15, 1988 at the hour of 7:15 p.m. of said day at the Council Chambers, Town Hall, 26379 Fremont Road, Los Altos Hills, California, notice of which hearing is hereby given, at which time and place all persons interested in or objecting to said proposed vacation and abandonment may appear and present objections to said proposed vacation and abandonment, and submit to said City Council evidence in support thereof, under and in conformity with the provisions of said "Public Streets, Highways and Service Easements Vacation law". 4. Reference is hereby made to the map and/or plat of the above- described, on file in the Office of the City Clerk, Town Hall, 26379 Fremont Road, Los Altos Hills, California, for further particulars and said map/or plat is incorporated herein and made a part hereof. 5. The proposed vacation and abandonment of a portion of a public street shall be submitted to the Planning Commission, to be considered by said body and a recommendation returned to the City Council at said hearing. 6. The City Council has determined that the public convenience and necessity require the reservation of easements, and there shall be reserved and excepted from the proposed vacation of the portion of the public street described above the permanent easement and right at any time, or from time to time, to construct, maintain, operate, replace, remove and renew water pipelines, sanitary sewers and storm drains and other public utilities and appurtenant structures in, upon, over and across the portion of the public street proposed to be vacated, and pursuant to any existing franchises or renewals thereof, or otherwise, to install, construct, maintain, repair, operate, replace, remove, renew and enlarge lines of pipe, conduits, cables, wires, poles and other convenient structures, equipment and fixtures in, upon, over and across the portion of the public street proposed to be vacated for the operation of gas pipelines, telegraphic and telephone lines, and for the -2- • • transportation or distribution of electric energy, petroleum and its products, ammonia, water and incidental purposes, including access and the right to keep the property free from inflammable materials and wood growth, and otherwise protect the same from all hazards in, upon and over the portion of the public street proposed to be vacated. The proceedings shall be taken subject to such reservations and exceptions. 7. That for two (2) successive weeks prior to the Hearing this Resolution be published in the Peninsula Times Tribune, a newspaper published and circulated in the County of Santa Clara, there being no newspaper published or circulated in the Town of Los Altos Hills. That at least three (3) notices of said vacation and abandonment, which notices shall state the passage of this Resolution of Intention and of the day, hour and place of hearing thereunder, shall be posted not more than 300 feet apart along the portion of Three forks Lane proposed to be abandoned, at least two (2) weeks before the day set for the hearing, or as provided in the "Public Streets, Highways and Service Easements Vacation Law". MAYOR ATTEST: CITY CLEW' -3- 51288 • • • EXHIBIT "A" All that certain real property situated in the CITY OF LOS ALTOS HILLS, COUNTY OF SANTA, STATE OF CALIFORINIA, described as follows: Beginning at the northeasterly corner of that certain strip of land 20 feet wide designated Three Forks Lane as said strip and Lane are delineated on that certain Parcel Map recorded in Book 459 of Maps Pages 1 and 2, in the Office of the Recorder of Santa Clara County, California; And running thence along the easterly line of said Three Forks Lane, South 0°52'05" East, 213.54 feet; Thence leaving last said line and running northwesterly along a curve to the left having a radius of 90.00 feet tangent to a line that bears North 46°49'30" West, through a central angle- of 15°48'55" an arc distance of 24.84 feet to a point in the westerly line of said Three Forks Lane; Thence along last said line North 0°52'05" West 137.20 feet to a point in the southeasterly line of Page Mill Road as said road is shown on the Parcel Map herein above referred to: Thence along last said line of Page Mill Road along a curve to the left, having a radius of 205 feet, tangent to a line that bears North 16°25'59" East, through a central angle of 17°08'43" for an arc distance of 61.34 feet; Thence North 0°42'44" West, 1.32 feet; Thence leaving said line of Page Mill Road North 89°07'55" East, 10.72 feet to said Point of Beginning.
