1. CALL TO ORDER, ROLL CALL, AND PLEDGE OF ALLEGIANCE
Mayor Tryon called the Regular Meeting of the City Council to order at 3:05
p.m. in the Council Chambers at Town Hall.
Present: Mayor Tryon and Councilmembers Dauber, Hubbard,
Johnson and Siegel
Absent: None

2. CONSENT CALENDAR
Item Removed: 2.1d) (Dauber)
MOTION SECONDED AND CARRIED: Moved by Johnson, seconded by Hubbard
and passed unanimously to approve the balance of the Consent Calendar,
specifically:
2.1 Decided Not To Review the following Planning Commission Actions at
Its Meeting on September 23 , 1992:
2.1a Lands of Ivy, 27281 Byrne Park Lane: request for a site development
permit for a minor addition to an existing single family dwelling

The Town Planner presented an overview of this project and Council discussed
various aspects of the house including the driveway and roof. They also
commented on the importance of diversity, the use of eaves and horizontal aspects
when designing a home. The concern expressed was that with the individual
` homes being built on La Paloma by one contracter a subdivision was actually going
in without the overall issues being addressed which are handled at the subdivision
level.
Bob Owen, applicant, commented on the roof and the fact that the neighbors did not
have a problem with the two driveways. He also stated that the houses did not line
up and diversity was also important to him.
MOTION SECONDED AND CARRIED: Moved by Johnson, seconded by Hubbard
and passed unanimously to decide not to review the request for a site development
permit for a new residence and pool for Lands of Owen at 13930 La Paloma Road.
3. DISCUSSION OF ENVIRONMENTAL IMPACT REPORT FOR THE
VIDOVICH GENERAL PLAN AMENDMENT AND OTHER NEARY
QUARRY ISSUES
Council had before them background information on the Neary Quarry as well as
reports from the Council Sub-Committee (Dauber and Siegel), These reports which
are on file at Town Hall also included several recommendations concerning the

proposed Vidovich General Plan Amendment, annexation to the Town of the
quarry property and the possibility of a memorandum of understanding between the
Town and the developer. It was noted that while the Neary Quarry was in the
Town's Sphere of Influence, it had never been added to the Urban Service Area.
Dauber believed that if the Town wanted to annex the quarry property, they should
do it now. Hubbard believed that annexation was inevitable but at this time he
recommended a development agreement between the County, developer and Town
to facilitate the process. Siegel commented that annexation at this time would be a
time-consuming burden on staff. Already staff time was being used as well as
consultant's time (William Cotton) for which the Town was not being reimbursed
and the Town would not be able to recoup any costs if the County was subdividing
the property. Siegel also believed that a residential subdivision in the quarry was a
good option -- better than having the old quarry back. However, this did not mean
that he believed a lake should be included. Johnson suggested that the Council
decide what end result they wanted. He thought if this decision was made, the
various factors would fall into place. Council also discussed the issue of sewers for
the property and noted that they did have control over this aspect of the project.
Jean Struthers, 13690 Robleda, asked who was responsible for the quarry reclamation
plan and also if it included restoring Hale Creek. Mrs. Struthers also noted that the
trail system was very important.
Siegel responded to Mrs. Struthers' question by saying that if the quarry was annexed
to the Town, the Town would be in control of the reclamation plan. Further the
City Attorney noted that two years ago she and the Director of Public Works, Bill
Ekern, had asked the County if the Town annexed the property would the County be
in a position to provide a contract for reclamation plan service. The County had
indicated they were not interested in this option. On the subject of liability the City
Attorney also commented that if the lake and road were private there would be no
liability to the Town. On the other hand if the lake and road were public, the Town
would be liable.
Muriel Knudsen, 27992 Central, stated her concerns about sewers going through the
preserve. She was not in favor of this.
Captain Robert Wilson, Sheriff's Department, commented on the proposed lake and
noted that this could prove to be dangerous attraction.

Stu Farwell, Assistant Los Altos Fire Chief, commented that the area had good street
access. On the subject of the lake, he noted that although there was the danger of
drownings, the water also provided a good supply in case of fire.
Siegel suggested that a letter of understanding be prepared between the developer
and the Town. Johnson did not agree with a development agreement but did
concur with the suggestion of a letter of understanding (a series of mini agreements
as issues were addresssed and agreed upon). Johnson believed the sub-committee
could meet with the developer and the County to reach consensus on these
agreements. Hubbard stated that he saw a lot of public input going into a
development agreement and Dauber reiterated her question as to whether or not
the Town wanted to annex this property. Tryon commented on the Town moving
toward having this property developed in such a manner that it would be
annexable. Johnson believed that if in the future agreement could be reached on the
details of the project, such as the number of lots appropriate for the property under
discussion, the Town would annex the land.
Paul Hogan, Mr. Vidovich's representative, stated that they would be delighted to
work with the Council sub-committee.
Council discussed whether or not to change the Council sub-committee on this
subject because of Councilmembers' travel plans and the upcoming meeting
41/ schedule on quarry issues but it was determined that it would be beneficial to keep
the sub-committee the same (Dauber and Siegel). Council also asked that the City
Manager contact Mr. Vidovich immediately requesting that they arrange a meeting
on this issue as soon as possible.
MOTION SECONDED AND CARRIED: Moved by Siegel, seconded by
Johnson and passed unanimously to state that the Town of Los Altos Hills is
opposed to the adoption by the County of Santa Clara of the Quarry Hills
General Plan Amendment. It believes a residential subdivision of the quarry
area should occur under the jurisdiction and in accordance with the
regulations and standards of the Town. The Town is willing to negotiate
with the owner, Mr. John Vidovich, a pre-annexation agreement setting forth
major conditions for the subdivision and amendments to the reclamation
plan. When such agreement is adopted, the Town will annex the property.
