RESOLUTION NO. 84-88
A RESOLUTION APPROVING TENTATIVE PARCEL MAP
OF LANDS OF LOTUS INVESTORS
RESOLVED, by the City Council of the Town of Los Altos Hills, County of
Santa Clara, State of California, that
WHEREAS, the City Council having examined the proposed Tentative
Parcel Map entitled
"Lands of Lotus Investors being a portion of Lots 6 &
7, as shown upon that certain map entitled "Map of
the Subd. Lot 3 of the Taaffe Partition Rancho La
Purissima Concepcion" filed for record in Book I of
Maps Pages 70 and 71 Santa Clara County Records;
also being a portion of Parcel 4 in the final order of
condemnation No. P-7124 recorded in Volume 6801
Official Records Page 342 Santa Clara County Records,
Town of Los Altos Hills, California"
herein referred to as the "Tentative Map"; and
WHEREAS, the Tentative Map having been reviewed by any other
public agencies entitled to do so, and the recommendations of any such public
agencies having been considered by the City Council prior to its taking action
on the p,
Tentative ma map; and
WHEREAS, the City Council having conducted a hearing concerning the
Tentative Map and having considered the evidence presented at the hearing;
and
WHEREAS, the City Council having determine that the Tentative Map is
in conformity with the requirements of Chapter 4 entitled "Subdivision" of
Title 9 of the Los Altos Hills Municipal Code; and the Subdivision Map Act of
the State of California commencing at Section 66410 of the Government Code;
and
WHEREAS, the City Council having read and considered the proposed
conditions of approval concerning the Tentative Map which have been
recommended by the Planning Commission,
NOW, THEREFORE, IT IS HEREBY FOUND, ORDERED AND DETERMINED as
follows:
1. The City Council of the Town of Los Altos Hills hereby approves the
above-described Tentative Map subject to performance of and compliance
with each of the Conditions of Approval which are set forth in Exhibit "A"
attached hereto, entitled"Conditions of Approval Tentative Map", and which
conditions are incorporated herein by reference and made a part of this
Resolution as though set forth fully herein.
REGULARLY passed and adopted this 17th day of August, 1988.

EXHIBIT "A"
. LAND AND EASEMENT DEDICATIONS:
1 . The applicant shall improve Elena Road at half width
along the frontage of Lots 1 and 3 to Town Standards .
' 2 . The applicant shall dedicate a 35 ' wide right-of-way for
a private street as shown on the Tentative Map. The
Final Map shall reflect this right-of-way dedication.
3 . A recorded drainage easement shall be obtained onto the
Lands of the State of California , for any and all
drainage directed across this property by virtue of im-
• provements to this subdivision, prior to recordation of
final map.
4 . The applicant shall submit grading and drainage plans to
the State of California Department of Transportation, and
receive the Department' s determination that proposed
grading and drainage improvements will not have an ad-
verse effect on State facilities prior to recordation of
the Final Map.

5 . The applicant shall dedicate a ten foot (10 ' )
pedestrian/equestrian easement along the northerly prop-
erty line of Lots 1 and 2 .
•
PUBLIC UTILITIES :
6 . All utilities added are to be underground.
•
7 . All lots shall he connected to the Purissima Hills County
Water District prior to recordation of the final map.
8 . All requirements of the County Health Department for the
• septic tanks on all parcels shall be fulfilled prior to
• issuance of a building permit.

9 . The land within the path easement required in Condition
#5 , above, shall be cleared of all trees and shrubs .

' 10 . Improve the pathway to Type IIB standards .along Elena
Road .
•
11 . A State highway encroachment permit shall he obtained for
any work to be done within the State highway right-of-
way.
•
GEOLOGY AND SOILS :
•
12 . Geotechnical Plan Review - A Deed Restriction shall be
recorded with the Final Map and a Note recorded on the
face of the Final Map as follows:
•
Geotechnical Plan Review - The applicant' s geotechnical
consultant shall review and approve all geotechnical
aspects of the development plans ( i . e. , site preparation
• and grading , site drainage improvements and design param-
• eters for foundations and roadways ) to ensure that his
• recommendations have been properly incorporated.
•
• The results of the plan review shall he summarized by the
geotechnical consultant in a letter and submitted to the
• Town Engineer for review and approval prior to issuance
' of building permits.
13 . Geotechnical Field Inspection - A Deed Restriction shall
be recorded with the Final Map and a Note recorded on the
• face of the Final Map as follows :
• Geotechnical Field Inspection - The geotechnical consul-
tant shall inspect , test (as needed) - and approve all
• geotechnical aspects of project construction. The in-
spections should include , but not necessarily be limited
to: site preparation and grading , site surface and sub-
• surface drainage improvements, and excavations for foun-
dations and retaining walls prior to the placement of
steel and concrete.

. cal consultant in a letter and submitted to the Town
Engineer for review prior to approval of site development
permits .
. NOISE AND VISUAL IMPACT MITIGATION:
14 . The following note shall be placed on the Final Map;
"All lots in this subdivision are visible from the
freeway and are subjected to freeway noise. Restrictions
may he placed on development on these lots by the Town of
Los Altos Hills to mitigate visibility and noise. "
15 . Each residence shall be designed in a manner that the
• noise level within the residence shall not exceed an an-
nual CNEL of 45 dba , as determined by a qualified consul-
tant selected by the owner and approved by the Town. No
final inspection of any residence shall be approved until
the interior noise level does not exceed an annual CNEL
of 45 dba.
16 . Landscaped earthen berms to protect outdoor living areas
from freeway noise and to mitigate visual impacts of de-
velopment on the project site shall be constructed as
recommended by the Noise Study prepared by Charles M.
Salter Associates Inc. , dated March , 1988 and the supple-
ment to that report dated 12 July , 1988 . A qualified
Acoustical Consultant approved by the Town shall review
• the final drawings and designs for noise barriers to
• ensure compliance. with required noise reduction measures .
The earthen berm noise barriers shall be constructed
prior to recordation of the Final Map.

17 . Additional noise mitigation measures as recommended by
the Noise Study prepared by Charles M . Salter Associates
Inc. , dated March , 1988 and the supplement to that report
dated 12 July , 1988 , shall be constructed prior to the
issuance of Final Occupancy permits for residences on
lots in the subdivision. A qualified Acoustical Consul-
• tant approved by the Town shall review the final drawings .
and designs for noise barriers to ensure compliance with
required noise reduction measures . Visual impact mitiga-
tion measures to the satisfaction of the Site Development
Committee shall be constructed at the same time as the
• additional noise mitigation measures. A Deed Restriction

shall be recorded with the Final Map and a note placed on
the face of the Final Map stating this condition.
PLANNING AND ZONING:
18. All structures made non-conforming by the lot lines cre-
ated by this subdivision shall be removed , or a bond pro-
vided to the satisfaction of the Public Works Director to
ensure their removal , prior to recordation of the Final
Map.
