HomeMy WebLinkAbout119-88 - - • a,: RESOLUTION NO. 119-88 A RESOLUTION APPROVING THE ADOPTED POLICY OF THE SANTA CLARA COUNTY DEPARTMENT OF ENVIRONMENTAL HEALTH CONCERNING ON-SITE SEWAGE DISPOSAL REQUIREMENTS APPLICABLE TO BUILDING CONSTRUCTION, AS MODIFIED RESOLVED, by the City Council of the Town of Los Altos Hills, County of Santa Clara, State of California, that WHEREAS, the City Council has read and considered the Policy Regarding Life Extending Construction concerning the repair or improvement of an on-site disposal system in conjucntion with life-extending residential building construction, and which was adopted by the Santa Clara County Department of Environmental Health effective as of March 1, 1988; and WHEREAS, the City Council has determined that the public health, safety and welfare require the adoption of the Policy described above, with certain modification thereto, namely, (1) that connection to sanitary sewage comply with Los Altos Hills Municipal Code Sec 6-4.102 and (2) conditions applicable to a "minor expansion" also shall be made applicable to a "major expansion," NOW, THEREFORE, IT IS HEREBY FOUND, ORDERED AND DETERMINED as follows: _ , • • ' 1. CITY CLERK 101388 -2- • • DEPARTMENT OF PLANNING AND DEVELOPMENT POLICY REGARDING LIFE-EXTENDING CONSTRUCTION effective March 1, 1988 SUBJECT: On-Site Sewage Disposal Requirements Applicable to Life-Extending Building Construction. SCOPE: This policy is applicable in those circumstances where the repair or improvement of an on-site sewage disposal system is warranted in conjunction with life-extending building construction. This policy is applicable County-wide to residential structures only, and is intended to supplement existing Ordinances. In all cases, connection to sanitary sewerage shall be required consistent with the provisions of Section 6-4.102 of the Los Altos Hills Municipal Code instead of Section B11-16 of the Santa Clara County Ordinance Code. CATEGORY I - Major Expansion and/or Major Intensification of Use. Where construction associated with an existing structure will result in a major expansion of the structure (greater than 500 cumulative square feet of all additions) or where such construction will result in a major intensification of the use of the property, the on-site sewage disposal system shall meet the minimum prevailing sewage disposal requirements of the Santa Clara County Ordinance Code. Provided, however, each condition made applicable to a "minor expansion" below also shall be applicable to a "major expansion." CATEGORY II - Minor Expansion. Where construction associated with an existing structure will result in a minor expansion of the structure (500 cumulative square feet or less of all additions), the following conditions are applicable: A. Require on-site inspection by Environmental Health Services (EHS) to determine adequacy and safe functioning of existing sewage disposal system. B. Require exposure and pumping of existing septic tank except EXHIBIT "A" • where applicant can document tank has been pumped within the last three years; a receipt for service from a licensed septic tank pumping firm will be considered sufficient documentation. C. Determination of location of existing leachlines and identification of area where future leachline expansion may occur. Septic tank file will then be updated by EHS. D. EHS may require improvement and/or expansion of the existing sewage disposal system when, in the judgment of EHS, the system is determined to be inadequate to accept current and/or projected waste flows. Such determinations are to be made based on size and functioning of the current system, coupled with slope, soil, hydrological and related factors. Where inspection results in a determination that the sewage disposal system is failing, can reasonably be expected to fail or to contaminate surface or ground waters, EHS shall require the replacement or improvement of the sewage disposal system pursuant to Section B11-25 of the Santa Clara County Ordinance Code. E. Where improvement and/or expansion of the sewage disposal system is required, but required repairs cannot be made, EHS shall disallow the application. CATEGORY III - Remodeling or Repair. Where the existing sewage disposal system is marginally acceptable, is functioning safely but cannot be improved, construction shall be limited to the remodeling or repair (as defined in the Uniform Building Code) of the existing structure provided: A. The construction will not constitute expansion or intensification of the use of the property or structure. B. Construction will not result in conversion of nonhabitable area(s) such as a garage, deck, porch, patio or similar area(s) to habitable area(s). NOTE: For purpose of implementing this policy, the term "intensification of use" shall mean a change which will place an additional demand on the sewage disposal system of a property. The magnitude of the intensification (major or minor) shall be determined by EHS. -2- 101388
