RESOLUTION NO. 122-88
A RESOLUTION APPROVING TENTATIVE PARCEL MAP
OF LANDS OF GAITHER
RESOLVED, by the City Council of the Town of Los Altos Hills, County of
Santa Clara, State of California, that
WHEREAS, the City Council having examined the proposed Tentative
Parcel Map entitled
"Tentative Map Francemont Estates being all of
Lot 4 as shown on the certain map entitled Tract
No. 3627, Recorded in Book 190 of Maps, at Page
22, Santa Clara County Recorder"
herein referred to as the "Tentative Map"; and
WHEREAS, the Tentative Map having been reviewed by any other
public agencies entitled to do so, and the recommendations of any such public
agencies having been considered by the City Council prior to its taking action
on the Tentative map; and
WHEREAS, the City Council having conducted a hearing concerning the
Tentative Map and having considered the evidence presented at the hearing;
and
WHEREAS, the City Council having determine that the Tentative Map is
in conformity with the requirements of Chapter 4 entitled "Subdivision" of
Title 9 of the Los Altos Hills Municipal Code; and the Subdivision Map Act of
the State of California commencing at Section 66410 of the Government Code;
and

WHEREAS, the City Council having read and considered the proposed
conditions of approval concerning the Tentative Map which have been
recommended by the Planning Commission,
NOW, THEREFORE, IT IS HEREBY FOUND, ORDERED AND DETERMINED as
follows:
1. The City Council of the Town of Los Altos Hills hereby approves the
above-described Tentative Map subject to performance of and compliance
with each of the Conditions of Approval which are set forth in Exhibit "A"
attached hereto, entitled"Conditions of Approval Tentative Map", and which
conditions are incorporated herein by reference and made a part of this
Resolution as though set forth fully herein.
REGULARLY passed and adopted this 16th day of November, 1988.

LAND AND EASEMENT DEDICATIONS:
1 . A Conservation Easement, as shown on the Tentative Map above
the 575 contour , shall be recorded with the Final Map.

2. The applicant shall dedi to a 20-foot wjde meandering ease-
ment from the lands of Loo\ Altos Hills flong the top of the
southern bank of Adobe CreV to Francfont Avenue .
3a. The applicant shall dedicatIta pathw easement from Moody
Road over the Francemont Ave ue bridge and along the wester-
ly side of Francemont Avenue , to the top of the bulb.
3b. Continue the path easement ove tae® road to the 575 ft. con-
tour turning westerly with a 20 Aide path easement to the
property line between the 575 & g00 ft. contours . Construct
a native path within this appro i ately 100' to the satis-
faction of the Pathway Committ e and Town Staff. This 100'
segment is to access the paths„ in \ he Lands of Bellucci .
4. If Lot #3 above the 700 ft. ontour s not developed , the
applicant shall dedicate a 20' wide eandering path easement
over the existing driveway cut betwee the 575 & 700 ft.
contours and thence up the ridge to Wi d Mill Meadow of
MPROSD ; if this lot is de eloped , the plicant shall dedi-
cate a path easement ove/the driveway nd construct a na-
tive path within a 20' ide meandering p th easement around
the building site to ti ridge top to the satisfaction of
the Pathway Committee and the Town' s Engi eering Staff.
4;_a. Francemont Avenue shall be dedicated to the Town of Los
Altos Hills as a public street as shown on Tentative Map
with a road right-of-way of fifty feet (50' ) , as far as the
end of the proposed bulb shown on the Tentative Map.
5. A storm drainage easement is to be dedicated to the Town
over the creek, within the parameters of the 100 year flood ,
for maintenance purposes.
6. Easements for existing and proposed sewer and water lines
shall be shown on Final Map.
7. The applicant shall dedicate a Conservation Easement along
Adobe Creek /twenty-five feet (25 ' ) from top of the bank to
the edge of Moody Road . The Final Map shall reflect this

PUBLIC UTILITIES:
8. All lots shall be connected to the Los Altos Sewer District

9. All lots shall be connected to Purissima Hills County Mutual
Water District .
10. Per Municipal Code Section 9-1 .1105, all utilities , includ-
ing cable television, shall be undergrounded .
11 . Fire hydrants shall be installed at locations selected by
the Los Altos Fire Department on Francemont Avenue . Each
hydrant shall be capable of flowing 1 ,000 GPM or better .
The hydrants shall be installed prior to recordation of
Final Map, or a bond to the satisfaction of the Director of
Public Works posted to ensure the completion of the required
work prior to issuance of Building Permits.
12. Fire protection shall be provided for all lots to the satis-
faction of the Los Altos Fire Department.
13. All wells on the property shall be properly registered with
Santa Clara Valley Water District and either maintained or
abandoned in accordance with their standards.
IMPROVEMENTS:
14. Sewer design and construction, including any required con-
struction of an additional sewer line between this subdivi-
sion and a point below Adobe Lane is to be approved by the
Town and the City of Los Altos . All required sewer improve-
ments shall be completed prior to recordation of Final Map,
or the Final Map, or a bond to the satisfaction of the
Director of Public Works posted to ensure the completion of
the required work prior to issuance of Building Permits.
15. Francemont Avenue shall be constructed to Town Standards for
public roads where it is to be dedicated as a Public Street .
The roadway within the existing 32' driveway easement is to
be improved to private road standards from the bulb end of
Francemont Avenue to the Lands of Boboricken. Improvements
shall be completed prior to recordation of the Final Map, or

a bond to the satisfaction of the Director of Public Works
posted to ensure the completion of the required work prior
to issuance of Building Permits.
16. All creek crossing designs are to be approved by the Town,
SCVWD, and Department of Fish & Game . Improvements shall
be completed prior to recordation of Final Map, or or a bond
to the satisfaction of the Director of Public Works posted
to ensure the completion of the required work prior to is-
suance of Building Permits.
17. Storm drain improvements relating to culverts on Moody Road
which deposit water within the subdivision are to be in-
cluded in the improvement plans . Improvements shall be
completed prior to recordation of Final Map, or or a bond to
the satisfaction of the Director of Public Works posted to
ensure the completion of the required work prior to issuance
of Building Permits.
18. Design of the Francemont Avenue bridge improvements shall be
approved by the Town, SCVWD and the Department of Fish &
Game . Improvements shall be completed prior to recordation
of Final Map, or or a bond to the satisfaction of the Direc-
tor of Public Works posted to ensure the completion of the
required work prior to issuance of Building Permits. The
bridge shall contain adequate pedestrian/equestrian crossing

19. The applicant shall install an adequate culvert and fill to
accomodate the wet weather spring flow near the easterly end
of the pathway easement described in Condition #2 above .
20. The applicant shall install a Type IIB path with header
boards south of the bridge over the approximately 375 ft of
pathway easement described in Condition #3a above .
21 . The applicant shall construct a native path within the ap-
proximately 100-foot long pathway easement described in Con-
dition #3b above . The path shall be constructed to the
satisfaction of the Pathway Committee and Town Staff.

GEOLOGY AND SOILS:
22.1 Flood Evaluation: The limits of the 100-year flood shall be
evaluated in detail for the subject property by the project
engineer. The potential for constriction of flood waters or
damming of debris by the remains of a previous bridge north
of Lot 2 shall be addressed by the engineer in a report sub-
mitted to the Town prior to recordation of the Final Map.
22.2 Appropriate measures shall be recommended to ensure proper
control of flood waters through the property. Abutments of
the proposed bridge shall be protected against erosion as
recommended by the project geotechnical consultant.
23. Each of the following restrictions shall be set forth in the
Declaration of Conditions , Covenants and Restrictions to be
executed and recorded by the Subdivider concurrently with
the recording of the Final Map, and the form of which shall
be approved by the Town.
23. 1 The feasibility of development for Lot #3 shall be reviewed
and approved by the Town Geologist.
23.2 A subsurface investigation program shall be completed for
any proposed building site on Lot #3 . The stability of lo-
cal slopes shall be evaluated and appropriate geotechnical
design criteria for proposed improvements shall be prepared.
The project geotechnical consultant shall verify the
feasiblity of the proposed building area. An original
engineering geologic map and cross section( s) shall be
prepared illustrating the surface and subsurface distribu-
tion of site earth materials (i.e . colluvium, artificial
fill and bedrock) below the 550-foot contour elevation. Em-
phasis shall be placed on characterizing the extent and
long-term stability of existing site fill materials .
23.3 If additional geotechnical design recommendations are
determined by the Town Geologist to be necessary when site
development plans are available . The results of this sup-
plemental investigation shall be submitted to the Town for
review by the Town Engineer and the Town Geologist prior to
approval of site grading or building permits on Lot #3 .

PLANNING AND ZONING:
24. All structures made non-conforming by the lot lines created
by the subdivision shall be removed prior to recordation of
the Final Map unless a variance is approved prior to recor-
dation of the Final Map to allow those structures to remain.
25. Each of the following restrictions shall be set forth in the
Declaration of Conditions, Covenants and Restrictions to be
executed and recorded by the Subdivider concurrently with
the recording of the Final Map, and the form of which shall
be approve d by the Town. The Conditions., Covenants and Restrictions shall
not be amended without Council approval. (AMENDED BY COUNCIL 11/16/88)
25 .1 . No further subdivision of Lot #3.
25 .2. No fences shall be installed which prohibit wildlife access
through creek
25.3 The house on Lot #3 shall be a-single':story home as it on a ridge line.

The City Council at their regular meeting on November 16, 1988 amended Conditions
#2, 3a, 3b and 4 to read as follows:
2. The applicant shall dedicate a ten foot (10') wide meandering path easement
for a five foot (5') path from the Lands- of the Town of. Los Altos Hllls to
Franceront Avenue. One of two alternative routes shall be acceptable._Alter-
native 1 will require applicant to construct an equestrian bridge .crossing
Adobe Creek, a native path, steps which ramp up to Moody.Road, and .a. Type IIB
path (or equal) along Moody Road including a guard rail, if necessary.
Alternative 2 will follow a route along the southerly boundary of Lot 1, over
the Lands of McClerry, and ,along the toe of the hills of .Lots 1 and 2 to
Francemont Avenue' (contour 425') . Approval of .the final.map shall be conditioned
upon the satisfactory recommendation of the Town Engineer and the Pathways,
Recreation-ard'Parks Committee, and, as required,- a path easement dedication
from McClerry.
3. The applicant shall dedicate a path easement from Moody Road over the bridge
and along the westerly side of .Francemont Avenue' to the end of the bulb and
install a Type IIB path with header boards south of th..bridge::.over this
approximately 375 feet. The path easement .shall.continue over tha_road to the
575 foot contour' turning westerly .wit1ia ten foot . (.10') :.wide path easement to
the property line between, the 575 and 600. foot contours. A native path shall be
constructed within this'approximately 100 feet to the satisfaction of the
Pathways, Recreation and Parks Committee-and Town Staff. .(Note: This 100 foot
segment is to access the paths. in:_.the Lands: of Bellucci.
4. If Lot #3 above the 700' contour is not developed, the applicant shall dedicate
a 10 foot wide meandering path easement over the existing :driveway cut between
the 575 and 700 foot contours and thence up the ridge to .Wind Mill Meadow of
the Midpeninsula Regional Open Space -District. If this lot is developed, the
applicant shall dedicate a path easement over the driveway and shall construct
a native, five foot (5') path within a ten foot (10') ,wide meandering path
easement around the building site to the ridge top to the satisfaction of the
Pathways, Recreation' arid Parks Committee and the Town's Engineering Staff.
