THE CITY COUNCIL OF THE TOWN OF LOS ALTOS HILLS ESTABLISHING A POLICY CONCERNING .VOTING ON LAND USE MATTERS RESOLVED, by the City Council of the Town of Los Altos Hills, County of Santa Clara, State of California, that WHEREAS, the Political Reform Act (Government Code Section 81r000 et.seQ) prohibits any person from participating in a governmental action or decision in which he or she knows or has reason to believe that .that person has a financial interest, that is if the decision would have a material financial affect on the business or property that person has destinguished from the effect of the action or decision on the public generallg: and WHEREAS, the City Council has .become aware of other potential conflicts. of interest which may arise by reason of the proximity of a property which is the subject of a particular land use application to the property owned or leased by members of various Committees or Commissions or of the Council who may be required to participate in a governmental action . or decision on such an application; and WHEREAS, the City Council desires to establish a policy to guide the members of such Committees or Commissions and of the Council itself in determining whether to vote on a particular land use application. �J • • NOW, THEREFORE, BE !T FURTHER RESOLVED a:3 follows: No member of a Commission or Committee or of the City Council of the Town of Los altos Hills shall vote on any application concerning or dealing with the use of land, or any portion or aspect thereof, which is before a Commission or Committee or the City Council itself if the member owns or . leases real property within three hundred (300) feet of the property tib which is the subject of the application, in order to avoid the appearance of any potential conflict of interest. • Whether the property of a member of a Commission, Committe or the Council is within three hundred (3 00) feet of the property which is the subject of a particular application, shall be determined in the same manner as is used to identify other properties within three hundred (300) feet of the subject property for the purpose of ► i .in+ notice to property owners as required in the Planning and Zoning Law (Government Code S,ecti on 65,000 0 et.seq.).
