AS • AMENDED BY RESOLUTION NO. 88-86 , AND WHICH ADOPTED A POLICY CONCERNING LANDSCAPING', AND SETTING OF BONDS THEREOF RESOLVED, by. the City Council of the -Town -of Los Altos Hills , County of Santa Clara, State of California, that Resolution No. 1256 adopted on January 2 , 1980 and amended by Resolution No. 88-86 adopted on June 18 , 1986 , be and it hereby is further amended by Amending Subsection (c) of Sec. 6 thereof to read as follows : SECTION 6 . The foregoing policy and guidelines shall be implemented as follows : • (c) Concerning Site Development, the Site Development • Authority shall determine the amount of the cash deposit which will be required to insure compliance. The amount of the cash deposit will be based upon the Site Development Committee ' s determination of the amount of landscaping mitigation needed regarding the subject plans . The amount of the cash deposit shall be as follows : (i) Minor mitigation - one thousand dollars ($1 , 000) ; (ii) Average mitigation - two thousand five hundred dollars ($2 , 500) ; and • (iii) Major mitigation - five thousand dollars ($5 ,000) . y Y lir The cash deposit shall be collected prior to final inspection. If the landscaping is not installed prior to the expiration of a one (1) year period following the date of final inspection, the Town will place the cash deposit in a landscape in lieu fund. The landscape in lieu fund will be used to plant and maintain landscaping within the Town to soften the impact of new buildings , swimming pools , tennis courts or driveways and arti= ficial cuts and. fills. The landscaping in lieu fund may be used to plant and maintain landscaping on public property, or, where appropriate agreements with property owners are obtained for right of entry, private property. If required landscaping is installed prior to the expira- tion of a one (1) year period, 50% of the cash deposit shall be returned to the depositor following inspection of the landscaping by the Town. Th:e =remaining 50% of the deposit shall be retained for an additional one (1) year period following the date of the inspection to insure adequate maintenance. At the end of the one (1) year period, an inspection will be Performed by the _Town and if the required landscaping is healthy, the remaining 50% of the deposit will be returned to the depositor. If, however, the Town determines that the condition of the required landscaping is unsatisfactory the remaining 50% of the deposit will be placed in the landscape in lieu fund.
