HomeMy WebLinkAbout30-87 r 411 RESOLUTION NO. 30-87 RESOLUTION APPROVING TENTATIVE LOT LINE ADJUSTMENT MAR FOR.THE LANDS OF MILLER RESOLVED, by the City Council of the Town of Los Altos Hills , County of Santa Clara, State of California, that WHEREAS, the City Council having examined the proposed Tentative Lot Line Adjustment Map entitled "Tentative Map Lot Line Adjustment, Lots 8 & 9 Tract 4169 Rhus Ridge Ranchos and Southerly Acreage" and WHEREAS, the City Council having determined that the Tentative Lot Line Adjustment Map is in conformity with the requirements of Chapter 4 entitled "Sub-division" of Title 9 of the Los Altos Hills Municipal Code; and the Subdivision Map Act of the State of California commencing at Section 66410 of the Government Code; and. WHEREAS , the City Council having read and considered the proposed conditions of approval concerning the Tentative Lot Line Adjustment Map which have been recommended by the Planning Commission, • NOW, THEREFORE . IT IS HEREBY FOUND, ORDERED AND DETERMINED as follows : 1. The City Council of the Town of Los. Altos Hills hereby approved the above-described Tentative Lot Line Adjustment Map subject to performance of and compliance with each of the 41- 411 III Conditions of:Approval which are set forth in Exhibit "A" attached hereto, entitled "Conditions of Approval Tentative Map For Lot Line Adjustment, " and which conditions are incorporated herein by reference and made a part of this Resolution as though set forth fully herein. REGULARLY passed and adopted this 15th day of April, 1987 . MAYOR ATTEST: CITY CLE .K 4&41111111WAtO 26379 FREMONT ROAD, LOS ALTOS HILLS, CALIFORNIA 94022 (415)941-7222 o r California �^ CONDITIONS OF APPROVAL red • Januzc'1 TENTATIVE MAP FOR LOT LINE ADJUSTMENT TO: HONORABLE MAYOR AND CITY COUNCIL MEMBERS EXHIBIT "A" FROM: CHAIRMAN, PLANNING COMMISSION SUBJECT: LANDS OF MILLER, FILE TM 6-86 11920 RHUS RIDGE ROAD APN ' s 336-43-02 and 336-31-25 LOT LINE ADJUSTMENT The Planning Commission at their meeting of February 25 , 1987, approved the above subject lot line adjustment with the condition that the final approval of the Lot Line Adjustment occur upon recordation of a parcel map, to the satisfaction of the City Engineer , and with the following conditions : 1 . LAND AND EASEMENT DEDICATIONS: 1 .A. The owner shall enter into Agreement to dedicate Right- of-Way along Peck Road for roadway purposes in the event of future subdivision of the sixteen (16) acre Duveneck parcel , to the satisfaction of the City Attorney and City Engineer. 1 .B. The owner shall dedicate a Conservation Easement as redlined by Staff on the Tentative Map , to the satisfaction of the City Engineer and Town Planner . No structures or grading shall be allowed within the easement . Vegetation removal shall be subject to approval of the Site Development Authority. 1 .C. The owner shall dedicate easement for pathway purposes coincident with his 1 /2 street portion of Rhus Ridge Road . 2. IMPROVEMENTS: 2.A. Vegetation shall be trimmed back and/or removed along Rhus Ridge Road for pathway travel , to the satisfaction of the Pathway Committee and City Engineer . 3 . MISCELLANEOUS: 3 .A. An agreement shall be recorded whereby the owner or any future owner of Lot #9 shall be responsible for all costs associated with moving or protecting the structures within the road right-of-way should the future repair or relocation of Rhus Ridge Road become necessary. This agreement shall be drawn to the ® satisfaction of the City Attorney and City Engineer. 111 S. Page Two Conditions• of Approval Lands of Miller, File #TM 6-86 3 . MISCELLANEOUS: (continued). 3.B. The Owner shall obtain an encroachment permit for the tennis court in order to allow it within the road right-of-way , to be dedicated . 3. C. The owner shall obtain Building Permits for all structures constructed without permits, as identified in Staff Report dated February 18 , 1987, prior to recordation of Parcel Map for Lot Line Adjustment.
