City Council Meeting
Wednesday, November 7, 1990, 6:00 P.M.

1. CALL TO ORDER AND ROLL CALL
Mayor Siegel called the Adjourned Regular Meeting of the City Council to
order at 6:05 p.m. in the Council Chambers at Town Hall.
Present: Mayor Siegel and Councilmembers Casey, Hubbard, Johnson,
and Tryon.
Absent: None
C Staff: City Manager Thomas Frutchey; Director of Public Works Bill
Ekern; Planning Director Ann Jamison; and City Clerk Pat Dowd

2. CONTINUATION OF DISCUSSION REGARDING: DEVELOPMENT
REVIEW AND APPEAL PROCESS
Tryon reported on the sub-committee she and Sid Hubbard served
on to review the site analysis process. Several issues were addressed
such as: the preparation of a handout; should site analysis be
mandatory or should there be a waiver option; should the $100 site
analysis fee be credited to the site development permit costs; should
site analysis be done at the staff level. It was pointed out that at site
analysis the applicant could learn about the issues and then could go
to the Planning Commission for a preliminary review if they so
wished. Site Analysis could be a positive experience and could
provide an early warning system for the applicant regarding possible
problems with the project.
Casey stated that she thought the Planning Commission and perhaps
even the Council should be involved in the site analysis process. She

through the site analysis process, as well as other planning processes,
to get their input. Casey also commented that she did not think the
site analysis process should be mandatory and staff should not tell
an applicant exactly what could or could not be done with their
project as each application was subject to interpretation.
Planning Commissioner Noel commented that the Commission would
be hearing the Lands of Hansen for site analysis review and he
would appreciate direction from the Council on this project.
The Planning Director explained the report that was prepared for the
applicant after the site analysis process was completed. She also
commented that the policy direction at this time was not clear which
made the process more difficult. Applicants wanted to know what
they could or could not do with their project and staff gave them the
best advice they could. Staff did not make recommendations but did
make suggestions. Johnson commented that Council direction to staff
should be for them to give an applicant all available options with
their lot.
Council also discussed whether the neighbors were notified of site
analysis and were advised they were not. Siegel suggested that the
applicant should be encouraged to talk to his neighbors about the
project but neighbors should not be included in the actual site
analysis meeting. In addition Council discussed site analysis at the
subdivision level and ways of reaching new owners in Town.
It was agreed that a site analysis handout would be prepared which
would include a waiver form and a mission statement. It was
further agreed that the City Manager would contact the City Attorney
regarding the preparation of possible ordinances relating to site
analysis and, if necessary, these would be brought back to the
Council at a later date.
MOTION SECONDED AND CARRIED: Moved by Tryon, seconded by
Siegel and passed unanimously to credit the $100 Site Analysis Fee
to the Site Development Permit Fees.

AYES: Mayor Siegel and Councilmembers Hubbard, Johnson and
Tryon
NOES: Councilmember Casey
MOTION SECONDED AND CARRIED: Moved by Tryon, seconded by
Johnson and passed unanimously to make site analysis mandatory
unless a waiver is signed by the applicant and to include the waiver
form in the site analysis handout.
The issue of the composition of the site development committee was
raised and Siegel noted that this subject was scheduled for discussion
at the 6:00 p.m. adjourned regular meeting on December 5, 1990.
The Planning Commission was invited to attend and participate at
that meeting. Hubbard also raised the issue of fences, especially
regarding the unfenced pool almost across from Bullis School and
asked that this be addressed by the Council.
